Respectfully, NOTE: If you are constructing dwelling on --a building site est blished by subdivision process or by SB 35 Exemption prior to 4/20/81 or if the parcel of land is more than 35 acres you may be subject to assessment of a $200.00 School Impact Fee prior to the issuance of a building permit, as provided in Garfield County Resolution No. 81-263 as an amendment to the building code. Section 1. That the Garfield County Building Code Reso- lotion of 1978, be and hereby is amended by the addition of a new section identified as Section IV.B.(3)c. IV.B.(3)c. Section 303(e) A new Section identified as Section 303(e) shall be added which shall read as follows: Sec. 303(e) SCHOOL IMPACT FEE: (i) In.addition to any other fee herein provided for a building to be used for residential purposes prior to the issuance of any building permit, there shall be paid to Garfield County a fee to be determined by the Board of County Commissioners of Garfield County, which fee shall be collected and credited to the account created and maintained pursuant to C.R.S. 1973, 30-28--133 (4) (a) for the use and benefit of the school district in which any development occurs, to be withdrawn and paid to such school district upon application and documentation of the purposes to which the funds are to be applied within the purposes permitted by C.R_S. 1973, 30--28-133 (4) (a) . This fee shall not apply only in the instance of residential sites which have already been the subject of dedication of property for schools or payment of a fee in lieu of dedication. (ii) For the purposes of this section, the term "site" shall include any division of air space for residential ;:;c we71 as anv division of land. NOW, THEREFORE, BE IT RESOLVED, BY THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO: Section 2. That the fee to be imposed upon residential sites in accordance with the above amendment shall be $200.00 per residential site, until otherwise ordered by the Board of County Commissioners..
