Re: Don and Rachel Reboul Residence, Lot 4 Orr-Smith Subdivision
Mr. Reboul: I’m writing to let you know that we will not spend any billable hours or
time discussing or exploring the code compliance of the as built conditions of your house,
which through phone conversations with yourself and the building department, we are
now understanding that the magnitude of the deviations from the stamped 6.2.22
structural plan set are extensive and intentional.
I am exercising our option to terminate our contract with you based on the grounds that it
is apparent that you do not believe that our design shown on the stamped plans issued on
June 2, 2022 is the proper structure to build for your project, and that is why you went to
extensive efforts, to intentionally modify the structure of your house.
Your decision to proceed with your own “contractor options” and then send us an email
saying that “it is fine for now”, claim that I authorized you to omit the entire steel beam
and column package, and then represent us before the building department by saying that
you have a plan from us indicating that the steel beams are not included in the design
while simultaneously not being able to provide this information to the building
department (because it does not exist)…..this is not the type of client that we can
responsibly sustain or be represented by.
It is clear why you built without steel. The cost and schedule were extensive, and you did
not feel like it was required based on your experience, schedule and budget, and your
effort to claim a misinterpretation of the plans or conversations as your reason for this is
not something we are willing to believe for one instant.
We were confident that the last fix of the survey mishap on your project would be enough
momentum to successfully push your project to a great completion, but we were wrong.
We wish you the best of luck as you engage another firm to address your plan deviations.
We will notify Garfield County Building Department in the morning that we are
terminating our working relationship with you.
