The quicker way to move forward with your project will be to not have the pool structure encroach intosetbacks. lf you have some proposed text changes to the currently adopted Land Use and Development Code, you can forward those onto the CommunityDevelopment Department Director. I think in your case, the Planníng Team are being m indful in their interpretation of the Land Use Table and the im pact ofsetting a new precedent with new exemptions. They also considered or factored in the appearance that you have available land to place the poolelsewhere. l've only worked in Garfield County for l-8 months now and have seen a few in ground pools, we more commonly see portable hot tubs and spas in terms of volume and then tend to be tucked pretty closely to the master bedroom suite or back terrace spaces. That stated, I did formerly work in Eagle Countyfor 23 years doing same work and would encounter a large number and variety of outdoor features and elements. Allowable locations vary depending upon thelot's zoning and platting.Garfield County's long time Chief Buíldíng Offícial retÍred last October, and he would have had more than 2 decades of case history to cross-reference. A líttlebit of your verbiage from guidance by Surveyor and Structural Engineer sounds a little in keeping with what Andy would include in his wording..... but for a pre-fabricated pre-manufactured hot tub or spa (that was portable and cou ld be moved ãround a property)..... and not you r case instance of the pool structure. While Kumar & Associates Location and Exploration boring 1on report22-7- 287 depicts the proposed swimmíng pool outside wholly to the EAST of said recorded 50 ft setback and flush south with the existing home. QUESTIONS: 7.a. May I re-offirm the pool is proposed as submitted on the SITE PLAN prepored by Aspen Survey? Yes 1.b. What is the approximote distance from existing outdoor residential living projections to the proposed pool? The paol is 37'from the house ond 25'from the attached deck 1.c. Will the pool design include outdoor pool barrier fence ond gate? lf so, whøt is the proposed fence materiol height, dimensions, access gate latching mechanism / details. The intentian is not to have a fence, but to rely on the automated pool cover system (ie closed when not in use) 1.d. To facilitate the revíew, I will check our currently adopted 2015 ICC swimming pool and spo code for pool barrier exceptions -- some automatic safety covers qualify as fence barrier for outdoor hot tubs and spas. However, I don't belíeve the exception extends to underground outdoor pool instollations.
