The PUD Guide does not specífícally speak to or address a private home being used by a non-profít organization providing full-time care to unrelated persons with disabilities. l'm being careful ín the application reviews to ensure there isn't risk of future code enforcement issues due to the use. The Battlement Mesa PUD GUIDE expresses allowable use{s) on lots as a single-family residence but ít mute moot or sílent on defíning what type of individuals occupy a prívate residence. FINDINGS ON USE BY MOUNTAIN VALLEY DEVELOPMENT SERVICES 1 The Executive Director represents in email the purchased home will retain use as a private single-unit dwelling. Further represents the operation and occupancy DOES not fall under State of Colorado licensure requirements or mandates for a "group home". Further represents 2-3 adult persons with disabilities wíll be long-term residents Further represents not short-term líving stay Fr¡rther represents the home will be supervised by in-attendance paid professional staff providing care for the long-term residents. Further represents that staff may or may not sleep"during the night - depends upon the care needs of the disabled residents, will be on duty to respond to the disabled resident needs and circumstances and awake when needed. WEARING the BUILDING CODE HAT: l've read through the residential occupancy sections in the adopted IBC and IRC - Buildíng Code official can allow this remodel as a single-unít dwelling with 5 or fewer residents supervísed under care by care professionals - complying with the IRC as a single-family dwelling PROVIDED the building has a fire-sprinkler system installed. The IBC residential occupancy classifications and definitions do not place this remodel work into the "group home" category because a group home has a higher occupancy load with group homes residents being capable of self- preservation and escape during an emergency. lf the applícants usc is allowcd by ZONING (BATTLEMENT MESA PUD) - then I will propose to include the following BUILDING CONDITIONS OF PERMIT: CONDITION #l APPROVED AS A SINGLE.DWELLING UNIT UNDER CURRENTLY ADOPTED IRC.
