RE: Director Decision Harvey Secondary Dwelling Unit (GAPA-03-22-8882)
Dear Christopher & Rebecca:
This letter is in regard to the Director's Decision for your Administrative Land Use Change
Permit Application for a Secondary Dwelling Unit (SDU) on your property located at 993
County Road 227, Rifle, CO, also known ab Parcel No. 2179-061-00-631. Your
application has been reviewed in accordance with the Administrative Review procedures
contained in the Land Use and Development Code as amended. Said provisions require
a Decision by the Director of the Community Development Department on whether to
approve, approve with conditions, or deny the request.
The Director's Decision is based on the following findings:
1. That proper public notice was provided as required for the Director' s Decision.
2. Consideration of the application was extensive and complete, that all pertinent facts,
matters, and issues were submitted and that all interested parties were given an
opportunity to provide input prior to the Director's Decision.
3. That for the above stated and other reasons, the proposed Land Use Change for the
SDU is in the best interest of the health, safety, convenience, order, prosperity, and
welfare of the citizens of Garfield County.
4. That the application is in general conformance with Garfield County's
Comprehensive Plan 2030, as amended.
5. That with the adoption of conditions and for the above stated and other reasons the
application has adequately met the requirements of the Garfield County Land Use
and Development Code, as amended

The Director's Decision is hereby issued approving the Harvey SDU Application subject
to the following conditions:
1. All representation of the applicant, contained in the application, shall be considered
conditions of approval unless specifically modified by the Director's Decision.
2. The SDU is restricted to leasehold interest in the dwelling unit and may only be
used for residential or home officeibusiness purposes in accordance with Section 7-
7A1.8 of Garfield County's Land Use and Development Code.
3. Any exterior lighting associated with the SDU must comply with the standards set
forth in Section 7-304 of Garfield County's Land Use and Development Code.
4. Prior to the issuance of a Land Use Change Permit for the SDU, the applicant shall
submit the following information for the well serving the SDU, and submit proof to
the county's Community Development Department that the applicable requirements
of the Land Use and Development Code, identified below, have been satisfied.
a. A current pump test that meets the standards in Section 4-2O3.M.1.b(s)(a) of the
Land Use and Development Code. The pump test shall include representation
by a qualified professional that the pump rate is adequate to serve both existing
and proposed uses.
b. A current water quality test that meets the standards in Section 4-203.M.1.b
(sXc) of the Land Use and Development Code. The water quality test shall
include representation by a qualified professional that the water quality meets
the state of Colorado's primary drinking water standards or identify a treatment
system that will bring the water into compliance.
5. The applicant shall maintain contracts with the West Divide Water Conservancy
District in accordance with the Colorado Division of Water Resources' well permit,
addressing referral comments from the county's consulting engineer.
6. Prior to the issuance of a Land Use Change Permit for the SDU, the applicant shall
address, to the satisfaction of the Garfield County Attorney's Office, Exception #13
in the Title Commitment.
7. Prior to the issuance of a building permit for the SDU, the applicant must submit
proof, to the county, that the SDU has its own address, separate from the primary
home on the property, and that said address be posted at the entrance of the SDU
and in a location near the intersection of the driveway and county road that provide
access to the SDU, as noted in the referral comments from Colorado River Fire
Rescue dated August 15,2022. The address identification characters shall contrast
with their background, be no less than 4-inches in size, and have a minimum stroke
width of T,-inch.

8. Prior to the issuance of a building permit for the SDU, the applicant shall submit
payment, to the county, for the applicable Road lmpact Fee, as set forth in Section
7-405 of the Land Use and Development Code.
The Land Use and Development Code requires notification to the Board of County
Comm issioners for their review and potential call-up of the Director's Decision. The Board
review is for a period of 10 calendar days commencing on the date of the Director's
Decision. The call-up period shall expire on September 2nd. Once the call-up period has
passed with no request for review or public hearing and provided all relevant conditions
of approval have been resolved the Land Use Change Permit will be issued. Pursuant to
the Land Use and Development Code, the Applicant has one year from the date of the
Director's Decision to satisfy all conditions of approval or request an extension.
