Following those recommendations,,Xcel Energy has been working with CPW to come to an agreement and understanding of working with wildlife during a time when they are most at risk in the construction area. Below is the guidance that was drafted through a collaborative process with Xcel to minimize those risks and protect wildlife and habitat while implement¡ng this beneficial project. By implementing these best management practices, Xcel will protect wildlife through an adaptive management plan and close communication with CPW staff so that construction can be completed on the¡r desired timeline. "Colorado Parks and Wildlife understands the importance of the improvements and will commit to supporting you in that process while balancing wildlife needs on behalf of the public trust. CPW understands that the timeline slated by Excel for construction in this section will begin at the Una substation from September 2O22lhrough December 2022 before moving towards Debeque which is slated forJanuary 2023 through March 2023 when this section will be fully completed. As mentioned wildlife utilizes large landscapes throughout the year to access necessary resources; however, their movements and congregation areas are often influenced by external drivers such as weather, disturbances, or coordination. As wildlife managers, CPW has scientifically based data to predict those movements but our District Wildlife Managers and Land Use Specialists have the intrinsic knowledge to be able to apply logically base flexibility that will be key to accomplishing the project. We have developed some sideboards to help Xcel understand what this flexibility míght look like to best plan and anticipate construction activities and will do our best to refine our decisions as much as possible but due to the nature of sensitive wildlife habitats, we must tactfully maintain some ambiguity until those situations present themselves. CPW's Land Use Specialist and/or the District Wildlife Manager(s)willattend the kick-off meeting to establish a relationship with your construction team and foster this open communication strategy that will be necessary to successfully navigate this project. Big Game BMPs and Decision Expectations: o District Wildlife Managers and Land Use Specialists will support project and construction managers with as much not¡ce as possible. o Notifications to pause or alter work will be at the sole discretion of the CPW District Wildlife Manager or Land Use Specialist and may be short or long-term in nature and will be the result of weather conditions and/or herd movement observations. o Alternative plans will be developed after the District Wildflie Managers or Land Use Specialists assess the situation, the impact, and the duration of the disturbance. o Project and/or construction Managers will be expected to discuss upcoming weather events that may impact big game movements, accessibility concerns, or damage to the resource' Subject: 1 . Project and/or construction managers should pause work if elk are observed within an 800-meter buffer around the construction easement followed by a call to the District Wildlife Manager to discuss alternative plans. ¡ Project and/or construction managers should pause work if deer are observed within a 400-meter buffer around the construction area followed by a call to the District Wildlife Manager to discuss alternative plans. . Elk, deer, and other wildlife may not be hazed or moved off-site in any way. . Work can resume if the presence of big game that once was present are absent for 24 hours. Sportfish Management Waters BMPs and Decision Expectations: o Construction activities wlll lnclude close attentlon to sediment transport wlthln that aquatlc envlronment through the SWMP permit and monltored by a quallfled contracted lnspector who will inspect weekly or if a %-inch rain or snow event occurs. o Erosion control measures will be in place before any ground disturbance in the area including clearing, grubbing, construction, and reclamation. Survey work will be exempt. oTraffic crossing the Sportfish Management Waters will be restricted to a síngle crossing point to minimize damage to the banks and channel bed. o Banks and streambeds should be protected by incorporating structure or mat reinforcements. ¡ Sediment collection mechanisms will be installed within the stream bed and along the bank. Dry channels will be required to implement sediment control measures including the removal of accumulated fine material from the channel. ¡ Dust suppression that contains salts or chemicals will be avoided within the Sportfish Management Buffer zone. . Any clearing, grubbing, or stockpile materials will be managed to prevent sediment transport and may include seeding of cover crop, tackifier, and/or mechanical controls. . Noxious weeds will be controlled through chemical or mechanical treatment in any disturbed area using a Colorado-certified herbicide applicator. . Any cleared vegetation or topsoil will be treated for noxious weeds and stored outside of the Sportfish Management Water Buffer zone and include stormwater control measures. Raptor BMPs and Decision Expectations: o Raptors can begin nesting activity in November but is usually most prevalent from February 15th through July 15th. Any observed nesting activity should be avoided. o A qualified raptor consultant will be hired to conduct a raptor nest survey to identify frequently used locations and nesting activities before any work being done will help to alleviate potential conflicts or disruptions in those activities. Survey work may be excluded. o Raptors may not be hazed or moved off-site in any way. o Observations will be communicated with the District Wildlife Manager to discuss potential alternative work plans. . Work with District Wildlife Manager to find local connections for organizations or individuals that may be interested in the installation of osprey alternative nesting sites. r The flight path for helicopter work should be kept within the highway/railroad/construction easement corridor to reduce additional disturbance as much as possible. Helicopter work should avoid any wildlife that is spotted in the area and limit sightseeing diversions. L All temporary construction easements needed for access and groundwork for the 6670 Transmission Line Rebuild (Una Substation to Garfield/Mesa county line) have been secured for all landowners in Garfield County, including 5-Mile Ranch, LLC. These easements authorize Xcel to begin access and right-of-way preparation work (i.e., ground disturbance). 2. All temporary construction easements needed for pull sites (i.e., equipment set-up areas for pulling the wire through the poles), have been secured for all landowners in Garfield County except for one pull site on the Brian Bray/Nathan Porter property near the Una Substation. That pull site will not be needed until nearer to the end of construction when the crews are stringing wire, so Xcel and the landowner have agreed to wa¡t to start the terms of that easement until the exact date it is needed is known. 3. Xcel is in the process of finalizing the permanent transmission line right-of-way easement agreement with 5-Mile Ranch, LLC. The agreement will be signed before installation of the new transmission poles willcommence. Following those recommendations, Xcel Energy has been working with CPW to come to an agreement and understanding of working with wildlife during a time when they are most at risk in the construction area. Below is the guidance that was drafted through a collaborative process with Xcel to minimize those risks and protect wildlife and habitat while implementing this beneficial project. By implementing these best management practices, Xcel will protect wildlife through an adaptive management plan and close communication with CPW staff so that construction can be completed on their desired timeline. "Colorado Parks and Wildlife understands the importance of the improvements and will commit to supporting you in that process while balancing wildlife needs on beha'lrf ,of the public trust. CPW understands that the timeline slated by Excel for construction in this section will begin at the llJna substation from September 2022 through December 2022 before moving towards Debeque which is slated forJanuary 2023 through March 2023 when this section will be fully completed. As mentioned wildlife utilizes large landscapes throughout the year to access necessary resources; however, their movements and congregation areas are often influe'nced by external drivers such as weather, disturbances, or coordination. As wildlife managers, CPW has scientifically based data to predict those movements but our District Wildlife Managers and Land Use Specialists have the intrinsic knowledge to be able to apply logically base flexibility that will be key to accomplishing the project. We have developed some sideboards to help Xcel understand what this flexibility might look like to best plan and anticipateconstruction activities and will do our best to refine our decisions as much as possible but due to the nature of sensitive wildlife habitats, we must tactfully maintain some ambiguity until those situations present themselves. CPW's Land Use Specialist and/or the District Wildlife Manager(s) will attend the kick-off meeting to establish a relationshíp with your construction team and foster this open communication strategy that will be necessary to successfully navigate this pnoject. Big Game BMPs and Decision Expectations: ¡ District Wildlife Managers and Land Use Speoialists will support project and construction managers with as much notice as possible. o Notifications to pause or alter work will be a,t the sole discretion of the CPW District Wildlife Manager or Land Use Specialist and may be short or long-term in nature and will be the result of weather conditions and/or herd movement observations. o Alternative plans will be developed after the lD¡strict Wildflie Managers or Land Use Specialists assess the situation, the impact, and the duratíon of tihe disturbance. . Survey work will be exempt. r Traffic crossing the Sportfish Management Waters will be restricted to a single crossing point to minimize damage to the banks and channel bed. o iBanks and streambeds should be protected by incorporating structure or mat reinforcements. ,o'sediment collection mechanisms will be installed wíthin the stream bed and along the bank. Dry channels will be required to implement sediment control measures including the removal of accumulated fine material from the channel. o Dust suppression that contains salts or chemicals will be avoided within the Sportfish Management Buffer zone. oAny clearing, grubbing, or stockpile materials will be managed to prevent sediment transport and may include seeding of cover crop, tackifier, and/or mechanical controls. o lNoxious weeds will be controlled through chemical or mechanical treatment in any disturbed area using a Colorado-certified herbicide applicator. . Raptor IBMPs and Decision Expectations: . tRaptors can begin nesting activity in November but is usually most prevalent from February 15th through July 15th. Any observed nesting activity should be avoided. oA qualified raptor consultant will be hired to conduct a raptor nest survey to identify frequently used locations and nesting activities before any work being done will help to alleviate potential conflicts or disruptions in those activities. Survey work may be excluded. . Raptors may not be hazed or moved off-site in any way. .'Observations will be communicated with the District Wildlife Manager to discuss potential alternative work plans. . Work with District Wildlife Manager to find local connections for organizations or individuals that may be interested in the installation of osprey alternative nest¡ng sites. . The flight path for helicopter work should be kept within the highway/railroad/construction easement corrídor to reduce additional disturbance as much as possible. Helicopter work should avoid any wildlife that is spotted in the area and limit sightseeing diversions.
