Dear Kayand Bernard Crook:
This letter is sent to you as the applicant for GAPA-O2 -22-8879 requesting a 2-Unit Dwelling
atlot 4 within the Davis Point Subdivision Exemption (reception #482894J, The apptication
requested a Land Use Change permit to allow a Z-Unit Dwelling. The property is located
Approximately !+ mile east of the Town of Silt at parcel number 2L7902400549. The
apþicaUon has been reviewed in accordance with the Administrative Review procedures
contained in the Land Use and Development Code as amended. Said provisions require a
decision by the Director of the Community Development Department on whether to approve,
approve with conditions, or deny the request'
The Directofs Decision is based on the following findings:
1. Thatproper public notice was provided as required for the Dilector's Decision.
Z. Consideration of the Application was extensive and complete, that all peÉinent facts,
matters, and issues were submitted and that all interested parties were given an
opportunþ to provide input prior to the Director's decision.
3. That for the above stated and other reasons, the proposed 2-Unit Dwelling within the
Rural Zoned District is in the best interest ofthe health, safety, convenience, order,
prosperity, and welfare of the citizens of Garfield County.
4. Thatthe application is in general conformance with the 2030 Comprehensive Plan, as
amended.
5. That with the adoption of conditions and for the above stated and other t'easons the
applicationhas adequately metthe requirements of the Garfield County Land Use and
Development Code, as amended'
The Director's Decision is hereby issued approving your Application subject to the following
conditions of approval.
l. Al[ representations of the Applicant contained in the Application submittals shall be
cpnditions of approval unless specifically amended or modified by the conditions
contained herein.
Z. PriortotheissuanceoftheLandUseChangepermiÇtheApplicantshallprovideplans
and schedule for the improvement of the driveway from the property line to the
building site to meet the requiremenß of 7-fl7 Access and Roadways. A wavier of
standards may be included if the driveway cannot meet the full standards

3. Prior to the issuance of the Land Use Change permit, the applicantshall submitthe 4-

4. Prior to issuance of the Land Use Change permit, the applicantwill provide adequate
information demonstrating a plan and schedule for creating a Noxlous Weeds Map
and lnventory and a Weed Management Plan.
5. ln accordance with the Fire Protection District's comments, both homes shall have a
NFPA 13D fire sprinkler system installed with a water supply storage tank of 25
minutes of water for the sprinkler system. This requirement is based on the access
road being more than 1001o grade. Details of the fÏre sprinkler system can be obtained
from the Colorado River Fire Rescue's (CRFRJ Fire Marshal office.
6. At the time of building permit grading and drainage plans in frrlfillment of Sectîan 7-
707 Drainage and Erosion shall be submitted.
7 . At the time of building permiÇ adequate design for the OWTS shall be submitted.
B. Future addressing will be done in accordance with CRFR's comments in collaboration
with Garfield County Community Development,
L The Applicant has one year within which to satis$r conditions of approval and obtain
a building permit for the construction of the 2 new dwelling permits.
The Land Use and Development Code requires notification to the Board of County
Cornmissioners for their review and potential call-up of the Dilcctor's Decision The Board
review is for a period of 10 calendar days commencing on the date of the DirectoCs Decision
You may request the decision be called up to the Board during this period. The call-up perid

Change Permit will be issued. Please note that you will have one year frorn the date of
apploval to complywith the conditions of approval. Extensions maybe requestedpriortothe
expiration of the original time limiL Please contactthe Community DevelopmentDepartment
