Mr. Kuerston,
Thank you for the response to items brought up during the review of this Grading Permit
submittal.
The drawings submitted and soils report are for a small subdivision that is still in an
annexation process with the City of Rifle. The drawings submitted do show some
infrastructure work in the background. You have clarified that it is shown for reference
only. The only grading approval that can be considered at this time is what is stated in
the description on the Grading Application.
Description on Application:
"Overlot oradinq after completion of de ition of existino structures and clean
uo the site. T is a lot of trash and debris left from the seller."
Surface grading is the only approval currently. No underground work is to be performed
untilthe annexation is complete. l.e.: No utilities, no electric, no water line installation,
no sewer line installation, nor storm drainage is to be installed under this grading
approval.

Mr. Kuerston,
The Community Development Department has reviewed the Grading Permit Application for the above
address. As you know this parcel is in the process of annexation into the City of Rifle.
The drawings submitted and soils report are for a small subdivision that is still in an annexation process
with the City of Rifle. The drawings do not coincide with the description on the Grading Permit, "Oveflot
orad¡nq afier completion of demolition of existinq structures and clean up the site. There is a lot
of trash and debris Ieft from the seller."
Based on the information provided and that the land is going thru an annexation process, the drawings
and soils report submitted with the application cannot be part of the Grading Permit approval. The only
grading approval that can be considered at this time is what is stated in the description on the Grading
Application.
This Grading Permit CANNOT be for the installation of the infrastructure for the future development. The
infrastructurè for the development is to be addressed after the annexation is completed with the City of
Rifle.
Please see the attached Garfield County Noxious Weed Management Plan, specifically but not limited to
sections 4.06, 4.07,4.08. Please provide the Bond for reclamation
Please provide revised drawings that do not detail any infrastructure work that may require approval from
the City of Rifle. See the attached Grading Permit Application Checklist for the appropriate drawings
needed for review.
Once the revised plans are approved, the security is in place for the reclamation/revegetation, and if
these conditions are acceptable the Grading Permit can be issued'

Following-up on our conversation regarding the property at 391 County Road 332 the I have the following comments:
t. The property owner has submitted an annexation request for the subject property. Currently, that applicat¡on ¡s
still being reviewed for technical completeness and an annexation hearing has not been scheduled.
2. Since no ent¡tlements have been obtained for the property and since there is no pre-annexation agreement in
place, the City will not allow the connection of any utilities to our system.
3. Any work is at the risk of the applicant. There are no entitlements and any annexation will have to be voted on
by Council.

Dear John,
We have been very clear with you that this property lS in the process of a potential annexatíon and
subdivision with the City of Rifle.
This Grading Permit Application is only to perform grading after we complete the demolition and clean
up of the property. The Geotechnical Report applies to the property and can be used for any purpose,
not just for a specific development. The Grading Plan does have the background information (shown in
light lines), i.e. sewer, water, curb and gutter for the proposed subdivision but the actual utility and
street plans have not been included as part of this application. This information as shown is typical for
this type of plan. Also, any infrastructure at the County level would require a Land Use Change prior to
construction.
We did communicate our intentions to you that we are not seeking to include any utilities or street
construction in this permit and did not include those design documents. We are only asking for this
permit to be able to grade this property after clean up to fill in the holes that were left from demolition
of structures and to establish drainage and stormwater controls. (CDPHE stormwater permit is in
process through SGM). lf you don't believe us, you can always just add a condition of approval to make
certain everyone is clear on the scope of work.
For you to imply that we would potentially proceed with installation of the street and utilities with only
a grading permit and not complete the annexation and subdivision process prior is unfair and just

speculation. (per your email response) We do not appreciate this accusation and have done nothing to
earn thís distrust.
The existing site is currently overrun with noxious weeds, and we will be taking care of those with this
grading action. We are currently not planning on reseeding the site if we achieve annexation and
subdivision near completion of grading. (mid to late summer.) lf we are not successful in the
annexation and subdivision process, we would have no issue with seeding the site this fall when
conditions are right. Thís grading needs done regardless of this specific project proceeding.
