Subject: Notice of Revocation of OWTS Permit # SEPT‐8030
4362 County Road 100
Carbondale, CO 81623
Parcel Identification Number: 239130100027
May 3, 2023
Kim and Steve Ochko,
Garfield County Public Health (GCPH) issued an Onsite Wastewater Treatment System (OWTS) permit #
SEPT‐8030 for the property located at 4362 County Road 100, Carbondale, CO 81623 on April 5, 2023.
Staff issued this permit based on design documents included at the time of application submittal, March
17, 2023. This week staff were alerted of a previously unidentified waterline in the vicinity of the
proposed OWTS that had not been indicated on submitted design plans in the original application. Due
to this new information, per the Agreement on page 2 of the permit (attached for your reference), the
letter serves as notice to you, owners of 4362 County Road 100, that GCPH is revoking OWTS Permit #
SEPT‐8030 at this time.
The Agreement states, in part:
In consideration of the issuance of the permit, the applicant hereby agrees to comply
with all laws and regulations related to the zoning, location, construction, and erection
of the proposed OWTS and associated structures for which this permit is granted. The
applicant further agrees that if the above said regulations are not fully complied with in
the zoning, location, erection, and construction of the above described OWTS and
structure, the permit may then be revoked by notice from the Health Department and
immediately become null and void.
Construction of an OWTS without a valid OWTS permit is not permitted. As stated in the Garfield County
OWTS Regulations, Section 43.4.B.1: Prior to installing, altering, or repairing a system, the applicant
must obtain a permit from the local public health agency. For staff to issue a new permit for the
construction of an OWTS on this property, the original application must be updated and resubmitted for
review and approval. Information to include:
1. Location and identified use of the existing waterline.
2. Include waterline on a design plan and include additional protections to existing waterline due
to setback requirements.
3. Modify OWTS design if necessary.

assumption of liability, nor create presumption that the local public health agency or its

not constitute a certification that the system, the equipment used in the system, or any
component used for system operation will ensure continuous compliance with the provision of
the OWTS Act, the regulations adopted thereunder, or any terms and conditions of a permit.
Permit Approval
Plans and specifications for the proposed OWTS have been reviewed and are considered
satisfactory. Permission is hereby given to the property owner(s) to perform the work indicated
