Will Serve Letter – Blue Heron Properties, LLC
Westbank Ranch Homeowners Association (“Westbank”) owns and operates a domestic water
system supplied by water wells, serving its members who are owners of single-family residential
properties in Westbank Ranch Subdivision (the “Subdivision”). Westbank also provides a domestic water
supply to the Ironbridge Maintenance Facility, formerly the Westbank Golf Course clubhouse (the
“Facility”), located at 1007 Westbank Road. The Facility is owned by Blue Heron Properties, LLC (“Blue
Heron”), and is physically located inside the geographical boundaries of the Subdivision. Westbank’s
supplying of domestic water to the facility has historically been for golf course-related uses, and not
residential uses.
Blue Heron is proposing to convert a portion of the Facility to four (4) residential apartment units
for employee housing (the “Project”). Blue Heron has requested a “Will Serve Letter” from Westbank, as
evidence to present to Garfield County that Blue Heron will have a domestic water supply from Westbank
if the Project is approved by Garfield County. This letter is Westbank’s “Will Serve Letter” to supply
domestic water to the Facility, including the Project, subject to the following conditions:
1. The Project will be subject to the review and approval, or denial, of applicable Garfield
County authorities, including a public hearing before the Garfield County Commissioners. Blue Heron will
assure that Westbank and its members in the vicinity of the Facility will receive advance written notice of
all public hearings.
2. In providing this Will Serve Letter, Westbank is not agreeing with, approving or endorsing
the Project. Westbank and its members reserve the right to oppose the Project when it is presented to
applicable Garfield County authorities, or to request that Garfield County impose conditions of approval
that Westbank or its members believe to be necessary, appropriate, or in their best interest.
3. Blue Heron has previously provided to Westbank a letter from water engineer Thomas A.
Zancanella dated August 18, 2022 (the “Zancanella Letter”), setting forth water demands for the proposed
Project. A copy of the Zancanella Letter without attachments is attached to this Letter. If the Project is
approved by Garfield County and constructed, Westbank shall not be obligated to provide water in excess
of the volumes set forth in the Zancanella Letter.
4. If the Project is approved by Garfield County and constructed, all water service to the
Facility will be subject to all rules, regulations, rates and charges of the Westbank Water System. Blue
Heron will install separate water meters for each of the four (4) residential apartment units, and for the
remaining golf course maintenance at the Facility, totaling five (5) water meters, and will pay separate
water charges for all five (5) accounts.
