We hereby request a waiver from Garfield County’s Grading and Drainage Plan
Section 4-203.E Grading and Drainage Plan
A waiver request shall be considered based on the following criteria:
1. The applicant shows good cause for the requested waiver.
Response: There is no change to the site grading and drainage. The change of use
consists of an interior remodel of an existing structure.
2. The size, complexity, anticipated impacts, or other factors support a waiver.
Response: There are no changes to the area around the existing structure that
would affect the size, complexity or any anticipated impacts.
3. The waiver does not compromise a proper and complete review, and……
Response: Considering there is nothing being changed on the site, there is no
compromising a proper and complete review.
4. The information is not material to describing the proposal or demonstrating
compliance with the approval criteria.
Response: There is no change to the site, therefore, a grading and drainage plan
would not be material in describing the proposal or demonstrating compliance with
the approval criteria.
The fact is there is no intent of changing any of the site, which would affect the grading
and drainage. The existing condition will remain as is and are in compliance with the
County’s regulations.
We hereby request a waiver from Garfield County’s Landscape Plan
Section 4-203.F Landscape Plan
A waiver request shall be considered based on the following criteria:
1. The applicant shows good cause for the requested waiver.
Response: There are no changes to the existing landscaping or site
2. The size, complexity, anticipated impacts, or other factors support a waiver.
Response: There are no changes to the existing landscaping or site
3. The waiver does not compromise a proper and complete review, and…..
Response: The application can be properly and completely reviewed without a
landscape plan, as there are no planned changes to the existing landscaping.
4. The information is not material to describing the proposal or demonstrating
compliance with approval criteria.
Response: A landscape plan is immaterial for this application, as there is no change
to the existing conditions.
The fact is there is no intent of changing any of the site, which would affect the
landscaping. The existing conditions will remain as is and are in compliance with the
County’s regulations.
We hereby request a waiver from Garfield County’s Traffic Study
Section 4-203.L Traffic Study
A waiver request shall be considered based on the following criteria:
1. The applicant shows good cause for the requested waiver.
Response: The existing property was used as a clubhouse in the past and generated
far more traffic than the proposed employee housing that total 7 bedrooms.
Therefore, there is less impact than the previous use and a traffic study is not
necessary.
2. The size, complexity, anticipated impacts, or other factors support a waiver.
Response: We are using the same structure without any additional area being
proposed. The change of use from a clubhouse to 7 bedrooms for employee
housing has less impact, the same size area, and less complexity with traffic and use.
3. The waiver does not compromise a proper and complete review, and……
Response: The application can be properly and completely reviewed without a
traffic study.
4. The information is not material to describing the proposal or demonstrating
compliance with approval criteria.
Response: A traffic study is immaterial to describing the purpose or demonstrating
compliance with applicable approval criteria.
Traffic generation is expected to be less than what exists, and is within the County’s
regulations.
We hereby request a waiver from the Garfield County’s OWTS evaluation and potential
upgrades to be considered part of the conditions for approval
Section 7-105 Wastewater Systems
A waiver request shall be considered based on the following criteria:
1. The applicant shows good cause for the requested waiver.
Response: The existing property has a OWTS system in place and is being evaluated
for capacities and potential expansion. We would like any further analysis and
potential improvement to the system to be a condition of the approval for this
change of use, which will be part of the building permit submission.
2. The size, complexity, anticipated impacts, or other factors support a waiver.
Response: The building permit process will require a submission to environmental
health for the OWTS system to ensure it complies with the proposed change of use.
Therefore, any size increase and impacts will be tied directly to the permitting
process and review by environmental health.
3. The waiver does not compromise a proper and complete review, and…….
Response: A building permit cannot be issued on this project until environmental
health reviews the existing and proposed OWTS system. Therefore, no compromise
is being made by granting this waiver.
4. The information is not material to describing the purpose or demonstrating
compliance with approval criteria.
Response: The OWTS system already exists and is immaterial to describing the
purpose or demonstrating compliance with applicable approval criteria.
The existing OWTS system currently exists and is working order. As part of the building
permitting process, the County requires the applicant to submit drawings and details to
Environmental Health describing the existing conditions and proposed changes to the
existing system. Therefore, a condition for approval would be an appropriate action and
is consistent with the permit submission requirements.
We hereby request a waiver from the Garfield County Access and Roadways
Section 7-17 Access and Roadways
A waiver request shall be considered based on the following criteria:
1. The applicant shows good cause for the requested waiver.
Response: The current access and roadways have been in place and in use for over
50 years. The proposed change of use will reduce the amount of traffic on these
roadways, and no improvement should be required. The current roadway also
serves several single family homes without issue.
2. The size, complexity, anticipated impacts, or other factors support a waiver.
Response: The proposed impact will be less than the current clubhouse building, in
which the structure is remaining and no increase in the size of the building is being
proposed.
3. The waiver does not compromise a proper and complete review, and……….
Response: The change of use is less impactful than what the current use is, and a
waiver would not compromise a proper and complete review.
4. The information is not material to describing the purpose or demonstrating
compliance with approval criteria.
Response: There will be no change to the existing structure with the exception of
the interior being remodeled. Therefore, it is immaterial in describing or
demonstrating compliance with applicable approval criteria.
The existing structure is remaining as is and the interior is being remodeled to
accommodate employees of the golf course. The current roadways have been in
existence for over 50 years and there is not a necessity to improve or change the
existing access and roadways.
