The operation will excavate, process, and send offsite construction materials from a 72.8 acre permit and affected are. Access will be from the existing County Road 346 connection for the property. The owner of the land is North Hangs Ranch LLC. The operator and permittee is Western Slope Materials LLC. The current site condition is predominantly rangeland. The mined portion of the site will be reclaimed to a groundwater lake and surrounding rangeland. Details of mining and reclamation plans can be seen on the maps in Appendix 4. The North Hangs Mine will operate as a new construction materials source for Western Slope Materials as they wind down operations at their Grand River Park Pit. The Grand River Park Pit is currently operating southeast of the North Hangs property, on the South side of I-70. With North Hangs, Western Slope Materials will continue to serve the local construction market with quality materials for years to come, without increasing impacts to the local environment or public infrastructure. 1. Plans and Goals Western Slope Materials is committed to beginning impact mitigation and minimization efforts as soon as possible when all conditional approvals for this gravel mine are in place. By beginning mitigation work several years before the commencement of mining, items such as landscaping, specifically tree plantings and infilling, will be more mature and effective when mining begins. With approval of this SUP, mitigation and other pre-mining activities will be able to move forward, a benefit to both the operator and the community at large. Western Slope Materials has developed mining and reclamation plans that will see the North Hangs Mine operate with minimum impact on the surrounding community throughout its life. These plans include phased mining, concurrent reclamation, wetlands development, screening and berms, and operational best management practices. The North Hangs Mine will operate in multiple mining phases that allows for concurrent reclamation. Mining will consist of excavating raw material to supply Western Slope Materials needs in the local construction market. Reclamation will see the site become a lake surrounded by wetland and riparian fields. These stages can be visualized in Figure 1 and 2. C.R.S. § 24-65.5-101, et seq, requires notification to mineral owners when a landowner applies for an application for development from a local government. I conducted a thorough research project of the chain of title, from patent to present. There are two patents for the subject lands, said patents conveyed the surface and mineral interests to the patentees. The deed recorded at Reception Number 166614 reserved one-quarter (1/4) of the oil, gas mineral interests to the Grantor, Barney Wright. No other reservations of the subject minerals occurred until Gypsum Ranch LLC conveyed the subject surface lands to North Hangs Ranch LLC, through recordation of the Warranty Deed at Reception Number 932600. This deed includes all sand, gravel and aggregates, however reserves and excepts “all of Grantor’s right, title and interest in all oil and gas in, under and that may be produced from the property.” Hence, Gypsum Ranch owns three-quarters (3/4) of the mineral rights. The mineral interests of Barney Wright reserved in the aforementioned deed have passed down through numerous generations, a list of current owners is provided herewith. Material will be mined, crushed, screened and washed at the North Hangs Mine before being transported offsite for further use. Material from this operation will be used in a variety of necessary uses in the area including infrastructure projects, road and highway maintenance, the production of readymix concrete and asphalt at off-site facilities, residential, and commercial construction. There is sufficient topsoil and overburden onsite to successfully reclaim the site to its final condition of a lake with rangeland slopes. No asphalt manufacturing will take place onsite. Western Slope Materials intends to use the North Hangs Mine to support its ongoing presence in the community. To that end, it has designed the operation to incorporate upfront landscaping work, wetlands development, and final reclamation into a lake and associated wetlands. This Project Description will outline the need for the operation, provide detailed information about the project including timelines, schedule of operations, employee presence, project size, and explanation of all functional aspect of the proposed development including mining and reclamation plans. Statement of Need Western Slope Materials (WSM) has provided the area with the highest quality aggregates for over a decade. Locating, managing and conserving sand and gravel reserves in Garfield County is of the highest priority for local producers and the County alike as it is a limited resource. As the Colorado River valley has become developed and populations have grown, opportunities to secure gravel reserves have become increasingly fewer. After years of North Hangs Mine February 2023 11 research and study, Western Slope Materials has concluded that only a handful of such sites actually exist. With typically long permitting durations, WSM recognizes the need to start the process well in advance of the actual mining activities occurring. The North Hangs site provides an excellent resource that can be utilized to support projects, maintenance and development while being responsibly managed for years to come. An ancillary benefit to a site like this will be the opportunity to create future water storage if future approvals are able to be obtained. 3. Mining Stage A phased mining plan will be used to minimize the cumulative impacts of the mining operation. Concurrent reclamation will facilitate the healthy development of expanded and enhanced wetlands on the property while mining takes place. Berms and buffers will minimize the offsite impacts of the operation. Figure 2 shows a render of what the site will look like during mining. The start of operations at the North Hangs Mine is currently scheduled to occur in 2025-2026. There are items that WSM will ultimately need to have in place, including a water augmentation plan and an approved wetlands plan from the Army Corps of Engineers that will require significant time to develop. These items however, are not required until specific activities in the mining timeline occur. For example, a wetlands mitigation plan through the U.S. Army Corps of Engineers is not required until wetlands are disturbed, an event that will occur with the beginning of Area B several years into mining. Similarly, the water augmentation plan will not be required until groundwater is exposed during mining, which will occur early in mining, but not for several years from the time of this application. Conditional approval of this SUP by the County will allow early development work to be conducted onsite. This early development work will maximize the effectiveness of impact mitigation efforts over the life of the mine. No wetlands will be disturbed without an approved mitigation plan and/or permit from the USACOE. No groundwater will be exposed without an augmentation plan in place. Mining & Reclamation Plans The site of the proposed North Hangs Mine is 72.8 acres and is currently rangeland/shrubland (see Map C-1). The Bernudy Ditch (WDID 4500524)1 is located within the permit area. The North Hangs Mine will be accessed from County Road 346. Mining will take place in two principal phases. The first phase will mine around the Bernudy Ditch and wetlands onsite. The second phase will mine out the ditch path and associated wetlands. Following mining of Area A, wetlands will be established as part of reclamation that are greater in total area than the wetlands to be disturbed by mining. Also, the Bernudy Ditch will be rerouted via a buried pipe around the mining area. Maps C-1 shows the mining plan. A 20-ft wide maintenance easement will be recorded upon installation of the pipe reroute. Map G-2 shows the pipe reroute details. 1 https://dwr.state.co.us/Tools/Structures/4500524 North Hangs Mine February 2023 12 Prior to beginning activities on the site, the boundaries of the affected area will be clearly marked. Signs and markers will be posted at the mine entrance listing the name of the Operator, Western Slope Materials, and the operation name, “North Hangs Mine”; a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and the DRMS permit number. The current access to the property will be used for mining (Maps C-1 & C-2). Internal roads and ramps will be used throughout the life of the mining operation as needed and will all be reclaimed. Map C-2 shows the total mining extents. Map C-4 shows a snapshot of mining and reclamation activity as it progresses. Topsoil and overburden will be stripped at North Hangs Mine and placed in stockpiles and berms. This stripping will take place in advance of mining of areas but is not anticipated to happen all at once. Map C-3 shows the topsoil stripping in advance of mining in the cross sections. Berms will be installed at the start of operations on the site as part of stormwater controls (Maps C-2). Further details on the berms can be seen on Map G-1. Topsoil that is stripped and not required for the construction of the berms will be immediately placed as part of contemporaneous reclamation, stockpiled on-site in the topsoil storage area, or shipped offsite. Temporary stockpiles of overburden or topsoil required for reclamation will typically be 20 feet in height. Temporary stockpiles will be located in the designated area shown on Map C-2. Overburden present on site will be stripped during mining and either placed directly on mined out ground as part of reclamation, stored in the stockpile area, or be sold as fill. Mining to final slopes and the direct placement of overburden onto reclamation slopes will reduce the need to stockpile overburden material and shorten the time that it will take to reclaim the mine. Details on topsoil and overburden quantities and material balance can be found in the CDRMS permit exhibits attached as Appendix 4. The groundwater table is roughly seven feet below ground level based on site investigations. Since groundwater will be exposed/encountered during mining, the entire pit will be dewatered using a pump. Details regarding this dewatering can be found in CDRMS Exhibit G in Appendix 4. Throughout the mine life the minimum setbacks shown on Map C-2 will be maintained. All mining will be within the 100-year floodplain, but no permanent fill will take place in this area. A floodplain impact analysis has been conducted and can be found in this application with the Floodplain Development Permit. Storm water control berms and stockpiles will be present during mining but removed during reclamation. Additionally, the excavation of topsoil and overburden from the site will create storage volume for storm and flood events onsite. See Map G-1 and Exhibit G of the CDRMS application in Appendix 4 for more information on surface water management. Further details of mining and reclamation activities can be found in the CDRMS permit application in Appendix 4. North Hangs Mine February 2023 13 Wetlands Western Slope Materials commissioned a wetlands survey of the site conducted by Environmental Solutions Inc (ESI) prior to any disturbance to determine the extent of wetlands that are present onsite. This survey is attached to the CDRMS application Exhibit J. Figure 4. shows the extent of wetlands as mapped during a survey conducted by Environmental Solutions Inc, see the attached ‘Wetlands Delineation Report’, found in Appendix 7. Area A will be mined in such a manner as to leave a setback of at least 35 feet from all existing wetlands. Prior to the initiation of Area B mining, Area A will be back-filled and allowed to revert to wetlands (see Map F-1). These backfilled portions of Phase 1 will be intentionally developed as wetlands to mitigate anticipated future wetland disturbances onsite. This new wetland area will be 5.9 acres in size, larger than the 3.8 total acres of wetlands that are currently cataloged as existing on the site. By creating a wetland that is larger than the total amount of wetlands currently on the site, WSM is assuring that mining that disturbs wetlands will not have an overall deleterious effect on the wetlands on the site. It is in this manner that the overall area of wetlands contained within the affected parcel will either remain the same or will increase in size as mining progresses. The value of the property as a wildlife area will be greatly enhanced with this increase in wetland, groundwater lake and edge habitat (see Wildlife/Vegetation below). No wetland disturbance will take place prior to USACOE approval of a mitigation plan. Figure 3. Existing 3.8 acres of wetlands as determined during site survey. Figure 5. indicates the extent of wetlands that will exist after all reclamation is complete. The wetlands in the southeast section of the site will be completed prior to the start of Area B mining. This wetland will encompass 5.9 acres. North Hangs Mine February 2023 14 Figure 4. Final extent of proposed wetlands after reclamation is complete. Figure 5 gives the existing view that an automobile driver traveling eastbound on I-70 has of the wetland area on the southeastern portion of the permit area. During Area A mining, this area of the site, excluding the existing wetlands, will be mined first. Prior to the start of mining in Area B, this area will be backfilled and allowed to revert to wetlands. The total area that will be allowed to convert to wetlands prior to the start of Area B is 5.9 acres, more than the 0.23 acres of wetlands currently existing in this area, and more than the total of 3.8 acres of wetlands mapped on the entire site by Environmental Solutions Inc. By completing the reclamation of this section of the site prior to the start of Area B, WSM will be achieving two goals: 1) reducing the visual impacts of mining to the I-70 travel corridor and 2) mitigating the effects of mining on the site’s wetlands inventory. This view will remain essentially unchanged after this area is mined and reclaimed. Prior to disturbing any wetlands onsite, the applicant will secure any applicable US Army Corps of Engineers permits. Conditional approval of this SUP and Mitigation Plan will enable WSM to obtain the required US Army Corps of Engineers permits. Western Slope Materials plans to have constructed and enlarged the total area of wetlands on the site before any wetlands are disturbed. Water Consumption Water for the operation will be purchased as needed. Exposure of groundwater and dewatering of the mine will require a substitute water supply plan (SWSP), augmentation plan, and a gravel well permit. Water consumption for the North Hangs Mine will fall into five main categories. • Control Dust on the Haul Roads and Excavation Areas • Control Dust for Crushing and Screening Plant Operations North Hangs Mine February 2023 16 • Wash Plant Operations • Loss of groundwater to evaporation Due to the fact that the majority of mining will take place below the water table, material excavated from the mine will be inherently wet and thus pose a low risk of generating excessive dust. Water application for dust control on haul roads and excavation areas will take place as needed. Active stockpiles and others may require additional watering to ensure material stays wet. Additional watering may be needed during very dry windy conditions during mining operations. The facility manager will determine when and where this is needed during operations. Long term topsoil stockpiles will be vegetated to minimize water consumption for dust control as well as to prevent soil loss from said stockpiles. The crushing/screening plant uses water to control dust with water sprays at the entrance and on the screen deck. It is anticipated that the material will not require a large amount of water to control dust during processing due to its inherently wet nature. The wash plant will be used to remove fines from the material. This will produce fines in the bottom of the wash ponds adjacent to the plant. These ponds will be inspected monthly for capacity. Fines will need to be removed periodically from the wash ponds. The frequency of this clean out will depend on production rates. Fines removed from the wash ponds via cleanout will either be sold as a product or mixed in with the backfill in the pits. These fines will never be placed outside of storm water controls. An augmentation plan will be required to offset the evaporative losses from the groundwater lakes created as part of the final use of the mine. Until such an augmentation plan is in place and approved by the State of Colorado, no groundwater exposure will take place. WSM proposes to have the SUP and the Mitigation Plan conditionally approved prior to the finalization of an augmentation plan, which will be in place before the start of mining (see timeline Table 1). Similarly, the CDRMS permit will be limited to above groundwater excavation until an augmentation plan is approved. Water augmentation plans in the State of Colorado require approval from the Colorado Division of Water Resources and Colorado water courts. This process involves months of review and public comment in most cases. Furthermore, the water requirements for augmentation are dependent on approved mining and reclamation plans from State and Local permits. Therefore, water augmentation plans are typically pursued following the issuance of State reclamation permits and Local land use approval. Western Slope Materials will apply for its water augmentation plan once the Garfield County use permit and Colorado Division of Reclamation, Mining, and Safety permit are issued. To facilitate conditional approval of the Garfield County use permit, a will-serve letter from West Divide water conservancy district is included to demonstrate that water is available to meet North Hangs augmentation needs when the time comes. North Hangs Mine February 2023 17 Timetable An approximate maximum timetable for the North Hangs Mine operation is shown on Table 2. This timeline will allow Western Slope Materials to satisfy the need for construction material and services in the Colorado River valley and surrounding community. Table 2. Schedule of Operations Hours of operation at the North Hangs Mine will be limited to Monday thru Saturday, 7am to 7 pm. Operations may be limited during winter months due to freezing conditions and market demands. Only emergency maintenance will take place at night. Lighting to support such emergency work will be downcast and limited. 5. Number of Employees The operation will employ approximately five full time employees. This number may vary based on seasonal demands for products. 6. Equipment and Facilities The anticipated equipment and facilities that will be used at the North Hangs Mine are listed in Table 3. All facilities will be portable, with the exception of the truck scale. Table 3. Location and size of signs for the purpose of identification etc. North Hangs Mine February 2023 21 Grading and Drainage Plan The North Hangs Mine affected area is located adjacent to the Colorado River. The disturbance area of the site will be at least 100 feet from the Colorado River, southwest of the river. Groundwater is roughly four feet below the natural grade and is the alluvial aquifer of the Colorado River. The 100-YR FEMA floodplain encompasses the entire mining area. There is no mapped floodway within the property. Temporary stormwater control berms, topsoil, and overburden stockpiles will exist during mining, but will be removed for reclamation. Exhibit G of the CDRMS application in Appendix 4 contains all hydrologic calculations. Maps showing the applicable information required by the Garfield Land Use and Development Code for Grading and Drainage Plans are listed in Table 4. Table 4. Erosion and Sediment Control Measures - Estimate Cost Temporary soil erosion control measures include the construction, maintenance, and removal of stormwater berms. Temporary seeding of stormwater berms. Temporary seeding of stockpiles as needed. Occasional watering for dust suppression as needed. Erosion control measures can be seen on Map G-1, which is attached to this application. The total cost of these measures is estimated to be $ 25,000. 4. Neighboring Areas Neighboring areas of the North Hangs Mine are shown in Figure 6. N. Zoning for neighboring parcels is shown, with the North Hangs property highlighted in red. Stormwater Management Plan A stormwater management plan has been developed for North Hangs, in accordance with CDPHE guidance for such plans. The SWMP has not been submitted to CDPHE as no discharge permit has been applied for yet. Upon approval of this land use change permit, permits such as the CDPHE discharge permit will secured in advance of operations. A copy of the proposed SWMP can be found in Appendix 6. North Hangs Mine February 2023 24 Reclamation Plan This section describes the plans and processes involved in reclaiming and landscaping the site in order to transform it to its ultimate post-mining use as rangeland and a groundwater lake. The landscape plans are scaled at 1 inch to 20 feet and are as shown on Map F-1. Reclamation will occur contemporaneously throughout mining. Current use of the permit area is that of a rangeland. Final use of the permit area is proposed to be rangeland with a groundwater lake for the benefit of local wildlife. Details on reclamation procedures for the site can be found in Exhibit E of the CDRMS application in Appendix 4. 6. Seeding Plan Details regarding the seed mix, mulching, and areas to be seeded can be found in Exhibit E of the CDRMS application in Appendix 4. 7. Topsoil Handling Plan Details regarding the stripping, handling, storage, and replacement of topsoil can be found in Exhibit E of the CDRMS application in Appendix 4. 8. Weed Management Plan All disturbance proposed for the North Hangs Mine is for the long-term function of the site. Therefore, a weed management plan is not required. Nevertheless, a weed control plan can be found in Exhibit E of the CDRMS application in Appendix 4 as it is required by CDRMS. 9. Revegetation Security A bond for reclamation will be in place for North Hangs Mine in accordance with state law, prior to any site disturbance. This bond will include revegetation costs as calculated by the CDRMS. No additional Garfield County bond is necessary. 10. Hydraulic Calculations Details regarding the hydraulic calculations for the North Hangs Mine can be found in Exhibit G of the CDRMS application in Appendix 4. 11. Maintenance Requirements Maintenance of all proposed best management practices (BMPs) and stormwater control measures (SCMs) will take place in the due course of the mining operation at North Hangs. North Hangs Mine February 2023 25 Access to all areas requiring maintenance will be achieved via the primary site access. Western Slope Materials, in accordance with the necessary state permits and agencies regulating water discharge and mining, will be responsible for maintaining all BMPs and SCMs at North Hangs. 12. Spill Prevention and Countermeasures Plan A Spill Prevention and Countermeasure Plan (SPCC Plan), prepared under the supervision of a Colorado licensed professional engineer, has been developed for North Hangs. It is attached in Appendix 5. North Hangs Mine February 2023 26 Landscape Plan As the North Hangs Mine is an industrial use, a landscape plan is not required according to Section 7-303 of the Garfield County LDC. Reclamation and revegetation plans can be found in Exhibit E of the CDRMS permit application attached in Appendix 4. North Hangs Mine February 2023 27 Impact Analysis Sections 7-1002 and 7-1003 of the Garfield County Land Use and Development Code (Code) address mitigation efforts required for permitted gravel mining operations in Garfield County. Garfield County requires adherence to Colorado State Statutes (CRS) §25-12, which establishes statewide standards for noise level limits for various time periods and areas. 1. General Impact Mitigation All impacts discussed in this section are primarily mitigated by two factors: 1) the inherent topographical differences between the mining operations onsite and 2) the surrounding land and groves of trees along the Colorado River that will be maintained. All mining activities will take place in an area of the site that sits below the existing grade, with the exception of topsoil stripping and initial stockpiling. Processing will occur several feet below ground level to reduce noise propagation. Topsoil stripping will be conducted in short term periods of the year, typically in the early spring or late fall. Trees will be planted to in-fill the existing vegetation along the Colorado River and along the south side of processing and stockpiling. These trees will mitigate the visual and noise impacts of the operation to the Town of Silt, Colorado and the I-70 corridor. Note that any reference to ‘Exhibits’ or ‘Maps’ refers to Exhibits and Maps contained within the attached Colorado Division of Reclamation, Mining, and Safety (CDRMS) application components for the North Hangs Mine unless specifically stated otherwise. 2. Adjacent Land Use The proposed Land Use Change would allow for the development of a gravel mine at the location. This use is consistent with the industrial/commercial aspect of adjacent land including an existing gravel mine 1000 feet southeast of the proposed North Hangs Mine and the I-70 corridor along the southern boundary of the property. To the west is agricultural land used as irrigated pasture for cattle. To the north is the Colorado River, with Colorado Parks and Wildlife open space across the river to the northeast. Across the river to the northwest is agricultural land consisting of rangeland and a single residence. 3. Site Features Map C-1 of the CDRMS permit application in Appendix 4 shows the site features including floodplain area, wetlands, water pathways, ditches, topography, vegetative cover, and more. 4. Soil Characteristics A soil report was generated using the United States Department of Agriculture’s NRCS Web Soil Survey (WSS) and is included in the CDRMS permit application in Appendix 4 as part of Exhibit I. The WSS provides soil data and information produced by the National Cooperative North Hangs Mine February 2023 28 Soil Survey. The majority of the site (89.6%) is split between three soil types, Wann, Halaquepts, and Torrifluvents (see Map C-1). Each of these primary soil types are described on the following pages. Suitability for Reclamation and Landscaping All three soil types provide an average of at least 12 inches of suitable material for revegetation. All three soils are listed as class VII without irrigation. Class VII are not suitable for cultivation and are restricted to grazing by domestic animals or wildlife; all are listed as climatically limited soils. Geology and Hazard A geologic hazards study by Kumar & Associates was conducted on the property. It can be found in Appendix 3. 6. Groundwater and Aquifer Recharge Areas Mining activity at the North Hangs Mine will be conducted below the groundwater table. This is facilitated through the dewatering process during mining; dewatering pumps drain the active pit of groundwater to allow for mining activity to take place below natural grade. The dewatering of the pits will take place under an approve CDPHE discharge permit and CDWR gravel well permit. Groundwater is located approximately four feet below the surface of the ground onsite. No wells are located within 600 feet of the proposed pit 2. Mining activity will expose groundwater from the very beginning of operations. Dewatering of the pit will take place to bring the groundwater table below the operating floor. This allows equipment to safely and effectively mine the alluvial deposit. The pit pump will be active continuously during the mining season, which typically is mid-April to early-November, depending on weather. The pit pump will not run during flood events or when temperatures drop below freezing. The only known aquifer in the area is the shallow alluvial aquifer of the Colorado River. Depth to water table in the permit area varies depending on location and time of year but averages roughly four feet below ground surface. According to the U.S. Geological Survey’s Ground Water Atlas of the United States, the only groundwater aquifer system below the alluvial one in this area is the Unita-Animas Aquifer System. This is located beneath the Mancos Shale that underlays the site alluvium and will not be reach by mining or affected by mining Wastewater and sewage will be stored in a portable vault toilet that will be service by a contractor. This will prevent sewage or effluent from wastewater from entering the Colorado River alluvial aquifer. The 100-YR floodplain of the Colorado River encompasses the entire site. proposed 73-acre gravel pit development to be located at the east end of County Road 346 (CR-346)/Frontage Road in Garfield County, Colorado. It is expected that the gravel pit will be open by the end of 2025 and that excavation will occur for 15 years with pit operations ending around 2040; therefore, analysis was completed for the 2025 short-term opening and 2040 long-term closing horizons. The purpose of this study is to identify project traffic generation characteristics, to identify potential project traffic related impacts on the local street system, and to develop mitigation measures required for identified impacts. The following intersections were identified for incorporation and evaluation within this study: · County Road 315 (CR-315) and CR-346/Frontage Road · Interstate 70 (I-70) Westbound Ramp and CR-315 (Interchange 94) · I-70 Eastbound Ramp and CR-315 (Interchange 94) Regional access to the project will be provided by Interstate 70 (I-70), while primary access will be provided by CR-315. Direct access to the site will be provided at the east end of CR- 346/Frontage Road. North Hangs Pit is expected to generate approximately 42 daily trips with nine (9) trips occurring during each of the morning and afternoon peak hours. Distribution of project traffic on the street system was based on the area street system characteristics, existing traffic patterns and volumes, demographic information, and the proposed access system for the project. Assignment of project traffic was based upon the trip generation described previously and the distributions developed. Based on the analysis presented in this report, Kimley-Horn believes North Hangs Pit will be successfully incorporated into the existing and future roadway network without the need for any traffic improvements. All project intersections are expected to operate acceptably throughout the 2040 long-term study horizon with their existing lane configuration and control. However, based on traffic projections, the addition of project traffic on the south of CR-346/Frontage Road and Kimley-Horn and Associates, Inc. 196171000 – North Hangs Pit Page 2 CR-315 is anticipated to increase existing traffic by more than 20 percent. Therefore, an access permit is anticipated to be needed at this intersection as development occurs. A vicinity map illustrating the project site location is shown in Figure 1. It is expected that the gravel pit will be open by the end of 2025 and that excavation will occur for 15 years with pit operations ending around 2040; therefore, analysis was completed for the 2025 short-term opening and 2040 long-term closing horizons. The purpose of this study is to identify project traffic generation characteristics, to identify potential project traffic related impacts on the local street system, and to develop mitigation measures required for identified impacts. The following intersections were identified for incorporation and evaluation within this study: · County Road 315 (CR-315) and CR-346/Frontage Road · Interstate 70 (I-70) Westbound Ramp and CR-315 (Interchange 94) · I-70 Eastbound Ramp and CR-315 (Interchange 94) Regional access to the project will be provided by Interstate 70 (I-70), while primary access will be provided by CR-315. Direct access to the site will be provided at the east end of CR- 346/Frontage Road. 70 Kimley-Horn and Associates, Inc. 196171000 – North Hangs Pit Page 5 3.0 EXISTING AND FUTURE CONDITIONS 3.1 Existing Study Area The existing site and adjacent area surrounding the site is vacant land. The Colorado River borders the site to the north. The Garfield County Regional Airport is located west of the site on the south side of I-70. The City of Rifle is located west of the project site. To the northeast is the Town of Silt. The land uses and roadway network surrounding the site within the project study area are shown in the aerial of Figure 2. 3.2 Existing Roadway Network CR-346/Frontage Road currently provides a single through lane of travel in each direction eastbound and westbound. Both the I-70 Westbound and Eastbound Ramps provide single lanes on the on and off ramps. CR-315 provides one through lane in each direction northbound and southbound with a speed limit of 35 miles per hour southbound and 20 miles per hour northbound as traffic approaches the Interstate 70 interchange. The intersection of CR-346/Frontage Road and CR-315 operates with yield control on the eastbound and westbound approaches. The eastbound approach consists of a shared through/right turn lane. The westbound approach consists of a shared left turn/through lane. The northbound approach consists of a shared left turn/right turn lane. This intersection is shown in the following photo. I-70 Eastbound Ramp with CR-315 Kimley-Horn and Associates, Inc. 196171000 – North Hangs Pit Page 8 The intersection lane configuration and control for the study area intersections are shown in Figure 3. 3.3 Existing Traffic Volumes Existing peak hour turning movement counts were conducted on Tuesday, March 9, 2021, Wednesday, March 10, 2021, and Thursday, March 11, 2021. The counts were conducted during the morning and afternoon peak hours of adjacent street traffic in 15-minute intervals from 7:00 AM to 9:00 AM and 4:00 PM to 6:00 PM on these count dates. The turning movement counts are shown in Figure 4 with count sheets provided in Appendix A. 3.4 Unspecified Development Traffic Growth Based on a comparison of existing and anticipated future traffic volumes in this overall study area from review of the City of Rifle Transportation Master Plan, traffic volumes within this study area are anticipated to increase by an annual approximate two (2) percent growth rate. It is believed that applying this growth rate to the key study intersections in the project area will provide a conservative analysis as this equates to a 45 percent traffic volume increase by 2040. This annual growth rate of two (2) percent was used as a basis for determining the 2025 short- term and 2040 long-term horizon years. It is anticipated that up to 100,000 tons of aggregates could be moved from the site in a year. No aggregate dump trucks will be stored onsite as all aggregate material will be moved by third party companies. The pit is anticipated to be open for operations from 6:30 am to 4:30 pm for a total of 10 hours per day. With 25-ton aggregate dump trucks, the yearly 100,000 tons of material excavated per year would equate to a total of 4,000 dump truck round trips in a year. With approximately 260 working days throughout a year, the 4,000 yearly dump truck round trips would equate to an average of 16 aggregate truck round trips per day (32 total dump truck trips per day). This equates to 1.6 aggregate dump truck round trips during each hour. To provide a conservative analysis, it was assumed that two (2) aggregate dump trucks would arrive and depart during each studied peak hour. The gravel pit is anticipated to have a total of five (5) employees for the aggregate operations. It was assumed that these five (5) employees would all arrive during the morning peak hour and would all depart in the afternoon peak hour in single occupant vehicles to provide a conservative analysis. Based on this information of the anticipated pit operations, it was determined North Hangs Pit would generate approximately 21 daily round trips (42 daily total trips) with nine (9) trips occurring during each of the morning and afternoon peak hours.Table 1 summarizes the anticipated trips that will be generated in association with the facility. The trip generation derivations are included in Appendix B. The directional distribution of traffic is a means to quantify the percentage of site-generated traffic that approaches the site from a given direction and departs the site back to the original source. The project trip distribution is illustrated in Figure 7. 4.3 Traffic Assignment Project traffic assignment was obtained by applying the project trip distribution to the estimated traffic generation of the development shown in Table 1. Total project traffic assignment is shown in Figure 8. 4.4 Total (Background Plus Project) Traffic Project traffic volumes were added to the background volumes to represent estimated traffic conditions for the short-term 2025 and long-term 2040 horizons.Figure 9 illustrates the background plus project traffic volumes for the 2025 horizon at the study key intersections. The acknowledged source for determining overall capacity is the Highway Capacity Manual1. 5.1 Analysis Methodology Capacity analysis results are listed in terms of Level of Service (LOS). LOS is a qualitative term describing operating conditions a driver will experience while traveling on a particular street or highway during a specific time interval. It ranges from A (very little delay) to F (long delays and congestion). For intersections and roadways in this study area, standard traffic engineering practice identifies overall LOS D for signalized intersections and LOS E for movements and approaches of unsignalized intersections as the minimum threshold for acceptable operations. Table 2 shows the definition of level of service for signalized and unsignalized intersections. Study area intersections were analyzed based on average total delay analysis for unsignalized intersections. Under the unsignalized analysis, the level of service (LOS) for a two-way stop- controlled intersection is determined by the computed or measured control delay and is defined for each minor movement. Level of service for a two-way stop-controlled intersection is not defined for the intersection as a whole. The existing year analysis is based on the lane geometry and intersection control shown in Figure 3.The existing peak hour factors were utilized in the existing, 2025 horizon, and 2040 horizon analyses. Due to the low volumes at the key intersections, the existing peak hour factors were used for the 2040 analysis instead of the recommended HCM urban area peak hour factor of 0.92. Synchro traffic analysis software was used to analyze the study intersections and access driveways for level of service. CR-346/Frontage Road and CR-315 The existing unsignalized intersection of CR-346/Frontage Road and CR-315 operates with yield control on the eastbound and westbound approaches. With the existing control and lane configuration, the intersection is anticipated to operate acceptably throughout the 2040 horizon with the addition of North Hangs Pit project traffic. Therefore, no improvements or modifications are anticipated to be needed.Table 3 provides the results of the level of service at this intersection. Based on traffic projections, the addition of project traffic on the south of CR-346/Frontage Road and CR-315 is anticipated to increase existing traffic by more than 20 percent. Therefore, an access permit is anticipated to be needed at this intersection as development occurs. CR-346/Frontage Road is categorized as an F-R roadway with an assumed 35 mile per hour speed limit, as such turn lanes requirements are to be designed per the State Highway Access Code (SHAC). According to the State Highway Access Code for category Frontage Road (F-R) roadways the turn lane warrants are as follows: Kimley-Horn and Associates, Inc. 196171000 – North Hangs Pit Page 23 · A left turn lane with storage length plus taper length is required for any access with a projected peak hour left ingress turning volume greater than 25 vph. If the posted speed is greater than 40 mph, a deceleration lane and taper is required for any access with a projected peak hour left ingress turning volume greater than 10 vph. The taper length will be included within the deceleration length. · A right turn lane with storage length plus taper length is required for any access with a projected peak hour right ingress turning volume greater than 50 vph. If the posted speed is greater than 40 mph, a right turn deceleration lane with taper is required for any access with a projected peak hour right ingress turning volume greater than 25 vph. The taper length will be included within the deceleration length. · A right turn acceleration lane with taper is required for any access with a projected peak hour right turning volume greater than 50 vph when the posted speed on the highway is greater than 40 mph and the highway has only one lane for through traffic in the direction of the right turn. A right turn acceleration lane is not required on multi-lane highways of this category. The taper length will be included within the required acceleration length. Based on the 2040 traffic volume projections, turn lane requirements at the intersection of CR- 346/Frontage Road and CR-315 are as follows: · A westbound left turn lane is not warranted based on projected 2040 background plus project traffic volumes being 10 westbound left turns during the peak hour and the threshold being 25 vph. · An eastbound right turn lane is not warranted based on projected 2040 background plus project traffic volumes being 10 eastbound right turns during the peak hour and the threshold being 50 vph. · An eastbound acceleration lane along CR-346/Frontage Road from the CR-315 northbound right turn is not warranted based on projected 2040 background plus project traffic volumes being 20 northbound right turns during the peak hour and the threshold being 50 vph. All project intersections are expected to operate acceptably throughout the 2040 long-term study horizon with their existing lane configuration and control. However, based on traffic projections, the addition of project traffic on the south of CR-346/Frontage Road and CR-315 is anticipated to increase existing traffic by more than 20 percent. Therefore, an access permit is anticipated to be needed at this intersection as development occurs. INSTRUCTIONS FOR COMPLETING APPLICATION FOR ACCESS PERMIT (CDOT FORM NO. 137) January 2010 To construct, relocate, close, or modify access(es) to a State Highway or when there are changes in use of such access point(s), an application for access permit must be submitted to the Colorado Department of Transportation (CDOT) or the local jurisdiction serving as the issuing authority for State Highway Access Permits. The planned land uses as they will be when the site is fully developed are used to project the amount of traffic that the site will generate, peak hour traffic levels and the type of vehicles that can be expected as a result of the planned land uses. There may be exceptional circumstances that would allow phased installation of access requirements. This is at the discretion of the CDOT Regional Access Unit or issuing authority staff. 16.Estimated Traffic Count: Provide a reasonable estimate of the traffic volume expected to use the access. Note the type of vehicles that will use the access along with the volume (number of vehicles in and out at either the peak hour or average daily rates) for each type of vehicle. A vehicle leaving the property and then returning counts as two trips. If 40 customers are expected to visit the business daily, there would be 80 trips in addition to the trips made by all employees and other visitors (such as delivery and trash removal vehicles). If the PDF on-line version of this application is being used, the fields for each type of vehicle will automatically be added together to populate the last field on the page. 17.Documents and Plans: The CDOT Regional Access Manager or issuing authority staff will determine which of these items must be provided to make the application complete. Incomplete applications will not be accepted. If an incomplete application is received via U.S. mail or through means other than in the hand of the Access Manager or issuing authority staff, it will not be processed. It is the responsibility of the applicant to verify with the CDOT Regional Access Manager or issuing authority staff whether the application is complete at the time of submission. Signature: Generally, if the applicant is not the property owner, then the property owner or a legally authorized representative must sign the application. With narrow exceptions, proof of the property owner ’s consent is required to be submitted with the application (proof may be a power of attorney or a similar consent instrument). The CDOT Regional Access Manager or issuing authority staff will determine if the exception provided in the Access Code (2.3 (3) (b)) is applicable. Instructions for completing Application for Access Permit (CDOT Form #137), January 2010 Page 3 North Hangs Mine February 2023 35 Water Supply/Distribution Plan The proposed North Hangs Mine will not be served by a Water Service Entity. All potable water onsite will be provided in the form of bottled water or similar service provided by Western Slope Materials to its employees. Therefore, a waiver according to Section 4-118 and 4-202.M of the Garfield County LDC are requested. It is anticipated that five employees will work at the North Hangs Mine. The US Mine Safety and Health Administration (MSHA) does not specify an amount of water for employees at a mine. Given the hours of operation of 7 am to 7 pm, Monday thru Saturday, 3 gallons of water per employee per day, Western Slope Materials will need to provide 18 gallons of water per week per employee or 90 gallons total per week. Western Slope Materials regularly provides such water supply to its current employees at Grand River Sand and Gravel to the southeast via a potable water contract. This practice would continue at the North Hangs Mine. North Hangs Mine February 2023 36 Wastewater Man./Treatment Plan The North Hangs Mine will not be served by an existing public collection system and treatment facilities; portable toilets will be maintained onsite. Therefore, a waiver according to Sections 4- 118 and 4-202.N of the Garfield County LDC are requested. Wastewater services are not available from the City of Rifle or the Town of Silt. Mining of the site means an on-site wastewater treatment system (OWTS) is impractical. Portable toilets, serviced by a contractor, will provide sufficient wastewater systems for employees. Additionally, these toilets will be removed following mining and reclamation at the end of operation life, meaning no demolition or close-out of them will be needed. North Hangs Mine February 2023 37 Floodplain Analysis See the attached floodplain analysis. North Hangs Mine February 2023 38 Article 7 Standards Divisions 1, 2, 3, and portions of 10 of Article 7 of the Garfield County LDC are applicable to the North Hangs Mine. Divisions 1, 2, and 3 are addressed in this section, or this section directs to the portions of the SUP and/or CDRMS permit application where the standards is addressed. The applicable portions of Division 10, 7-1001 Industrial Uses and 7-1002 Gravel Extraction are addressed in their own sections. 1. Division 1. General Approval Standards 7-101 Zone District Standards The North Hangs Mine is currently zoned Rural. This zone district provides for the use of natural resources. Gravel operations are allowed via the Major Impact Review land use permit process. 7-102 Comprehensive Plan and Intergovernmental Agreements The Garfield County Comprehensive Plan Future Land Use Map (FLUM) designates the North Hangs Mine as part of the Urban Growth Area for the Town of Silt. This means that the Town of Silt input and insight during the review process will be a key component of the Garfield County review of this special use permit. The Town of Silt identifies this property as “Public/Quasi Public Parks & Open Space” in its Comprehensive Plan. It should be noted that the area to the south of I-70, which hosts an active gravel pit, is also identified as “Public/Quasi Public Parks & Open Space”. Land to the west, north, and southwest is all identified as “Natural Resource Extraction/Future Public Quasi-Public Parks & Open Space”, which is a designation intended to cover areas with active gravel pits as well as logical locations of future mines on existing deposits. Given the presence of the Colorado River between the property and the Town of Silt, and the fact that growth around Silt tends to be concentrated north of the River, the development of the North Hangs Mine into an active gravel pit and then lakes with wetlands will fit into Town goals. The mined out North Hangs Mine will provide quality recreation space and wildlife habitat upon reclamation. The wildlife benefits will come before mining is even finished, as delineated in the mining plans for the operation. The applicant has reached out and met with the Town of Silt to create additional transparency during the permitting process. 7-103 Compatibility The North Hangs Mine is situated amongst industrial, agricultural, and major transport land uses. The existing Grand River Sand & Gravel operation (also known as the Silt Pit) is located to the southeast, across from I-70. Interstate 70 is the primary adjacent land use to the south and east. The Colorado River and associated riparian areas lie along the north and east sides of the North Hangs property, providing substantial buffer between the operation and local residences and businesses in Silt. The Shidelerosa farm owns the agricultural land to the west. North Hangs Mine February 2023 39 Agricultural activities are thoroughly compatible with sand and gravel mines. Major transportation corridors are essentially industrial uses themselves, which are compatible with adjacent sand and gravel mines. The nearest residential and commercial properties are at least half a mile away in the Town of Silt. The North Hangs Mine is compatible with surrounding land uses and activity. 7-104 Source of Water The North Hangs Mine will consume water in two primary ways: potable water for employees and water used in operations. Potable water is addressed under the Water Supply/Distribution Plan earlier in this application. Water for use in operations involves water for dust control, material washing, and water evaporation from exposed groundwater following reclamation. Water for dust control and material washing will be covered either by an augmentation plan or substitute water supply plan through the Colorado Division of Water Resources. Water supply for either an SWSP or augmentation plan may be one of the following: • Conversion or purchase of water rights for use as an augmentation and industrial water supply. • Purchase of water for augmentation from a reservoir. • A combination of the above two options Water supply for operations must be secured and in place in order to secure a gravel well permit from the Colorado Division of Water Resources. A gravel well permit from CDWR is required to legally operate a mine such as the North Hangs Mine. The North Hangs Mine Major Impact Review land use change permit is being pursued in advance of finalizing the water source for operations. The mine will not be opening for several years, and thus there is time for Western Slope Materials to procure necessary water supply for the operation. Prior to mining operations at the North Hangs Mine, Western Slope Materials will provide Garfield County with proof of a gravel well permit, including proof of water supply for operations. 7-105 Central Water Distribution and Wastewater Systems. See the Water Supply/Distribution Plan and Wastewater Man./Treatment Plan sections earlier in this application. 7-106 Public Utilities Utilities required at the North Hangs Mine are minimal. A power transmission line is available to supply power to portable plants and the scale. No natural gas systems will be required onsite. Map C-1 shows the location of all known utility easements, and no new easements are proposed. North Hangs Mine February 2023 40 7-107 Access and Roadways The North Hangs Mine will have legal and physical access to North County Road 346, as shown on Map C-2. Details regarding the access improvements needed can be found in the Traffic Study section of this application. No roadways are needed for the operation, and the mine will not be open to the public. 7-108 Use of Land Subject to Natural Hazards The North Hangs Mine property is not subject to any potential natural hazards like falling rock, landslides, mud flows, or radiation. Flooding and the presence of a high water table will not negatively affect the mining operation. The Floodplain Analysis section clearly demonstrates that mining activity will not exacerbate flood risks in the area. The presence of a high water table will not interfere with mining or damage and proposed structures. Dewatering activities will move groundwater out to the Colorado River during mining. Once mining and reclamation area complete, the high water table will lead to high quality groundwater lakes and associated wetland habitat. See the Geologic Hazard section for more information. 7-109 Fire Protection A water tank for dust control and fire suppression will be maintained onsite at the fuel farm. The tank will be at least 2500 gallons. North Hangs Mine February 2023 41 2. Division 2. General Resource Protection Standards 7-201 Agricultural Lands The North Hangs Mine will not limit the viability of existing agricultural operations on adjacent land or adversely affect them. Fences will be maintained around the property to prevent the uncontrolled migration of livestock. The Bernudy Ditch that passes through the site will be maintained in its current form until a reroute pipe is constructed. At that time the ditch will be mined out. Access to the ditch will be maintained throughout mining and reclamation. Prior to any mining in the ditch footprint or setback, a new ditch easement for the pipe reroute will be recorded with Garfield County along with approval of the ditch reroute from the Bernudy Ditch owners. 7-202 Wildlife Habitat Areas Western Slope Materials consulted with a professional biologist in developing the North Hangs Mine plans and designs. The analysis of this professional can be found in the Impact Analysis – Environmental Impacts section of this application. No critical wildlife habitats will be affected by this operation. 7-203 Protection of Waterbodies A minimum setback of 100’ is maintained from the Colorado River in the maximum extents of mining shown on Map C-2. During the majority of the mine’s life, this setback will be 250’+. Prior to mining within the 250’ setback, Western Slope Materials will provide Garfield County with inflow/outflow structure designs that are approved by the CDRMS. These structures will be constructed as part of final mining and reclamation, if Western Slope Materials mines within 250’ of the Colorado River. Map C-4 also shows the setbacks in a snapshot of operations. 7-204 Drainage and Erosion A CDPHE discharge permit will be secured for all discharge activities at the North Hangs Mine. Drainage and stormwater runoff is addressed in detail in Exhibit G of the CDRMS application in Appendix 4 as well as the Stormwater Runoff sub-section of Section 7-1002 Gravel Extraction further on in this application. 7-205 Environmental Quality Air permits will be secured from CDPHE prior to operations onsite. All hazardous materials will be stored in accordance with all applicable State and Federal regulations. 7-206 Wildfire Hazards The North Hangs Mine will not increase the hazards associated with wildfire in this area. North Hangs Mine February 2023 42 7-207 Natural and Geologic Hazards The North Hangs Mine is not in an avalanche, landslide, alluvial fan, or rockfall hazard area. No development will occur on steep slopes, on expansive soils, on corrosive rock, in mudflow areas, or over faults. 7-208 Reclamation The detailed reclamation plan for the North Hangs Mine can be found within Exhibit E of the CDRMS permit application in Appendix 4. North Hangs Mine February 2023 43 3. Division 3. Site Planning and Development Standards 7-301 Compatible Design The North Hangs Mine is designed to be compatible with surrounding land uses. Buffers and setbacks ensure that mining activity does not negatively impact agricultural activity to the west, the Colorado River to the north and east, and I-70 to the east and south. As shown in the Noise Analysis in Appendix 1, all operations will be in complete compliance with State noise statutes. 7-302 Off-Street Parking and Loading Standards Over 250,000 square feet of open ground will be available within the Processing Area to accommodate parking and loading for the North Hangs Mine. All parking areas will be graveled to minimize dust generation. As the operation access is located at the end of a county road, vehicle ingress/egress, parking, and loading, will not interfere with any offsite traffic flow patterns. 7-303 Landscaping Standards The North Hangs Mine is an industrial use, and is therefore exempt from this section. 7-304 Lighting Standards Lighting will only be for emergency repairs and maintenance at North Hangs. It will always be downcast and limited in use. 7-305 Snow Storage Standards With over 250,000 square feet of open ground within the processing area, the North Hangs Mine will have more than enough space to store snow and allow for employee (estimated at 5 people) parking. Snowmelt will be handled by stormwater control measures onsite. See the SWMP. 7-306 Trail and Walkway Standards No trails or walkways are proposed at North Hangs Mine. North Hangs Mine February 2023 44 Section 7-1001 Industrial Uses The North Hangs Mine complies with all components of Section 7-1001 of the Garfield County Land Development Code. 1. Residential Subdivisions The North Hangs Mine is not located in or adjacent to any platted subdivision. 2. Setbacks All activity on the North Hangs Mine is at least 100 feet from adjacent residential property lines. 3. Concealing and Screening Almost all storage, fabrication, service, and repair operations on the North Hangs Mine will be screened by trees and distance from neighboring properties. Stockpiles will be screened as much as possible due to physical limits of the site. Topsoil storage will take place in stockpiles and/or berms along the site perimeter, and while those will be visible, they will be vegetated and landscaped to blend into the environment. 4. Storing All materials will be stored in a manner that prevents their off-property transfer by forseeable natural cause or force. This includes watering of material stockpiles, vegetation of long term topsoil stockpiles, and de-peaking of piles as needed. Mine Safety and Health Administration (MSHA) regulations will be followed for all storage onsite. No storage will be within 100 feet of a property line. Petroleum products will be stored in accordance with EPA rules and the SPCC plan for the site. 5. Industrial Wastes No industrial wastes will be produced onsite. 6. Noise North Hangs Mine operations will operate within state noise limits. North Hangs Mine February 2023 45 7. Ground Vibration Operations at the North Hangs Mine will not produce ground vibration that is perceptible without instruments at the property line. Sand and gravel mining will not involve blasting and vibrations associated with processing plants are perceived only as sound. 8. Hours of Operation Hours of operation at the North Hangs Mine will be limited to Monday thru Saturday, 7am to 7 pm. 9. Interference, Nuisance, or Hazard The North Hangs Mine will be operated in a manner so that it does not emit heat, glare, radiation, or fumes that substantially interfere with the existing use of adjoining property or that constitutes a public nuisance or hazard. North Hangs Mine February 2023 46 Section 7-1002 Gravel Extraction 1. Water Quantity and Quality Impacts/ Floodplain Impacts The North Hangs Mine shall comply with the applicable standards of section 3-301, Floodplain Overlay Regulations, and will be subject to section 4-109, Development in 100-Year Floodplain. The following sections will discuss specific items in more detail. Flammable or Explosive Solids or Gases No flammable or explosive solids or gases will be stored on site. Storage of Materials Stockpiles of materials will be located within the processing and stockpiling area and will be contained within stormwater berms to prevent the movement of materials offsite. No materials will be stored or placed outside of stormwater berms. No permanent overburden or product piles will be generated during the course of the North Hangs Mine operation. Topsoil will be either used immediately for reclamation or placed in temporary stockpiles in the stockpile area, until needed for reclamation. Floodplain/Floodway The North Hangs Mine affected area is located adjacent to the Colorado River. The disturbance area of the site will be a minimum of 100 feet from the river during mining. The entire site is within the Federal Emergency Management Administration (FEMA) Floodplain Zone A (100-YR event). No floodway is mapped in this area, according to FEMA. The 100-year floodplain is shown on Exhibit C and F maps. A Floodplain Analysis can be found earlier in this application. Dewatering pathways and methodologies are detailed on Map C-2 of the CDRMS application. North Hangs Mine February 2023 47 2. Air Quality The CDPHE regulates both air pollution and fugitive dust that are sourced from businesses in Colorado. A general air permit will be obtained for fugitive dust, and any required Air Pollutant Emission Notices (APEN) will be submitted prior to the commencement of mining. Air Quality Protection . The following best management practices will be in place for the operation: • All mining will occur below the existing topography, which will act to limit the migration of dust and air pollution from the site. • Disturbance footprint will be limited to the smallest for feasible operations • Crushing and screening equipment will be equipped with water sprays in order to keep material wet • Haul roads, processing and stockpiles floor, and the mining area floor will be watered as needed • Haul roads and processing and stockpiles floor will be graveled once they have been constructed • Product stockpiles will be maintained moist either from processing or from truck watering • Product stockpiles will be de-peaked. • Topsoil stockpiles to be in place longer than 90 days will be seeded with the permanent seed mix • Site access will be paved to the main entrance • Topsoiled reclaimed slopes will be seeded in the first favorable season following the placement of topsoil • All internal roads will be gravel If additional dust suppression is needed at any time, additional watering will take place. This will be determined by the Facility Manager. In the event of a dust ‘incident’, the Facility Manager will determine if the incident can be corrected via additional controls or if operation shut down is needed. The Facility Manager, and his/her designees will be responsible for maintaining a day- to-day, hour-by-hour sense of the conditions on site and their propensity to generate dust. Similarly, the Facility Manager would be aware that high afternoon temperatures during the summer dry out watered areas of the site faster and increase the likelihood of dust generation at that time of day. Therefore, the Facility Manager would task the water truck to spray active areas of the site additional times in the hot summer afternoon. It is in this flexible manner that the dust coming from the North Hangs Mine can and will be minimized. The fact that the North Hangs Mine February 2023 48 majority of the excavation will be conducted below the water table will also greatly reduce the generation of air pollution. North Hangs Mine February 2023 49 3. Noise/Vibration Prior to the initiation of mining activities, Hankard Environmental Inc (HEI) conducted a noise impact analysis for the proposed North Hangs Mine. Hankard Environmental Inc. gathered detailed information regarding the noise sources, including makes and models of mining equipment, crushers, screens, etc., as well as existing and future topography, and mining and reclamation details. Based on this data, source noise levels were drawn from the HEI measurement database of similar equipment. Where data was limited, HEI made assumptions based on their experience and/or gather publicly available GIS data. Noise source measurements were also conducted by HEI and are included in the attached report. Hankard Environmental Inc. created a map of the applicable noise limits surrounding the Project per CRS §25-12 for review and approval by the North Hangs Mine. Hankard Environmental Inc. created noise models (i.e.: pre-mining, full-mining, reclamation) as necessary to determine the worst- case model. Mitigation was modeled as needed for the worst-case model. The noise models include point predictions at noise sensitive receptors and noise level contours. Noise models were created using SoundPLAN v8.2 software that applied the International Organization for Standardization 9613-2. See the attached HEI report for further details and results of the noise impact analysis. A variety of best management practices will be employed to mitigate noise and vibration impacts. They include: • No use of explosives • Non-beeping back up alarms • Containing all mining activity behind the topsoil berm and the natural and augmented screen of trees as much as possible • Containing all processing activity behind berms as much as possible • Locating all processing plants as far away from neighbors as possible • All mining will be conducted below the existing grade • Mining and plant activities are limited to daylight hours (half an hour before sunrise to half an hour after sunset) • Haul trucks will not use J-brakes In the event that equipment or activity generates nuisance noise in a manner that was unanticipated, such activity or equipment will be taken offline until it can be operated in a non- nuisance manner. The Facility Manager can be contacted by anyone in the area or by any Garfield County personal that detects a nuisance noise. Contractor equipment will be required to operate under the same constraints as that of the operator. North Hangs Mine February 2023 50 4. Visual Mitigation Due to the fact that the North Hangs Mine is larger than 30 acres, it will be sequenced in a logical manner so as to minimize the visual impact of the operation. This will entail beginning the mining in the south portion of the permit area and progressing northwards. In order to minimize the visual impacts, reclamation will occur as soon as possible in all mined out areas, and will begin no later than 6 months after the commencement of a new phase of mining. Additionally, landscaping along the south side of the operation will be developed in advance of mining operations. Visual renders were created of the North Hangs site to demonstrate what the mine will potentially look like through all phases of mining and reclamation. Photos were captured at six key observation points to demonstrate what is visible of the mine from the nearest neighbors and adjacent highway with the visual mitigation measures in place. Four of the observation points are located along the adjacent I-70 highway to the south as these are the closest views the public will see of the North Hangs mine. These locations are dispersed along the spread of the site in the areas where the mine is most visible to show what the public will see as they drive by. The remaining two observation points are located to the north of the site along Highway 6 where the closest neighbors will be able to see the mine. The site is most visible to the public from I-70. Screening from trees will hide the majority of the processing area near the site entrance. The trees that will be used for screening during mining will be transplanted from the existing vegetation on site prior to mining. Transplanting large vegetation maximizes its effectiveness as a screening tool. Some smaller vegetation will be planted from seed as well and provide infill screening over time. In the areas without berms and trees in place, the pit will be visible from the road. However, the topography will provide natural cover from the activities occurring on the mining floor. The key observation point (KOP) locations and the directions they were taken in are shown in Figure 7. For each location, renders were created to show mining and final reclamation. This location is facing the western portion of the processing area with the mining area in the background. During mining, transplanted trees near the site entrance screen the view of the processing area and pit. After reclamation, the lake will be visible in the distance with screening from the trees placed during mining and as well as newly planted trees. This point is in view of the processing area and site entrance, with the mining area in the background. The background vegetation will be thinned out and more of the ridge in the distance will become visible as the trees within the mining area are removed. After final reclamation, the eastern portion of the reclamation pond and some wetlands will be visible through the trees. This point is facing the southwest portion of the site where the southern portion of the pit will extend. After final reclamation, the area will show rangeland and wetlands. The North Hangs site can be seen in the distance to the southwest. This location represents the view from residents on the western end of the Town of Silt. As shown in the photo, the topography along the south side of Highway 6 obscures a significant amount of the view. The eastern half of the site is visible from the nearest neighbor showing most of the processing area and the eastern portion of the pit. Because the site is barely visible in the distance, few changes between the different areas of mining will be visible. After final reclamation, the entire visible area is rangeland and wetlands. The photo was taken from the driveway of the other nearest neighbor that can view the mine. The North Hangs site can be seen in the distance to the southeast. The western side of the site can be seen in this direction showing the site during mining. After reclamation the lake is primarily what will be seen from this view. KOP 6 Reclamation Render North Hangs Mine February 2023 76 Screening Trees Trees will be planted in two locations on the site in order to provide a visual screen for the Town of Silt and the I-70 corridor. Trees will be planted to in-fill the existing trees on the north side of the site along the Colorado River in order to mitigate the visual impacts to the Town of Silt. These infill trees will be planted near the Colorado River in locations that will not be affected by mining. Trees will also be planted along the south edge of the processing area and stockpile area to mitigate the visual impacts to the I-70 corridor. These trees will be a mix of new seeding and transplanted trees removed from areas to be mined. See Map F-1 for the locations of tree plantings. In addition to the installation of screening trees, the phasing of the mining operation will contribute to the mitigation of the visual impacts of the operation. Mining will maintain the natural tree stands on the site along the Colorado River. Tree removal will be limited to those trees that are within the proposed mining areas. 5. County Road System Prior to the commencement of mining activities, a traffic study was conducted by Kimley-Horn and Associates Inc. (Kimley-Horn) for the proposed North Hangs Mine, a copy of which is attached to this application. Based on the analysis presented in the report, Kimley-Horn believes North Hangs Mine will be successfully incorporated into the existing and future roadway network without the need for any traffic improvements. All project intersections are expected to operate acceptably throughout the 2037 study horizon with their existing lane configuration and control. Operational practices to control traffic will include: • Installation of any improvements at the intersection of North County Road 346 and Mamm Creek Road (County Road 315) as required by Garfield County • Maintenance of signage and speed limits for truck traffic entering and leaving the County Road 346 • Usage of a one-way traffic routing in the facilities area to minimize customer truck travel distance and time • Maintenance of a designated parking area away from stockpiles and internal traffic • Usage of a designated maintenance area for all minor equipment maintenance such as greasing and refueling in the facilities area • Tracking pads will be used at all entrances to the site to ensure sediment and mud control North Hangs Mine February 2023 77 6. Compatibility with Surrounding Land Uses The North Hangs Mine is compatible with the surrounding land uses which include; an existing gravel pit, the I-70 transportation corridor, and rangeland. The final uses of the North Hangs Mine after reclamation will be rangeland, a groundwater lake, and wetlands. These uses are also compatible with the current surrounding land uses. 7. Revegetation and Reclamation Revegetation and Reclamation of the North Hangs Mine will be conducted as described in Exhibit E of the CDRMS permit application in Appendix 4. Prior to mining, a weed survey will be conducted and an inventory of county and state-listed weeds along with a detailed weed management plan will be provided to Garfield County. 8. Wildlife/Vegetation Prior to the commencement of mining activities, a wildlife/vegetation study was conducted for the proposed North Hangs Mine by Steve D. Dahmer, Principal Ecologist at Environmental Solutions, Inc., a copy of which is attached to this mitigation plan. The proposed project will result in removal of a significant amount of rock and gravel resources below the existing grade, which will result in the creation of one large groundwater lake on the Property. As part of the mitigation measures, pond depth, shoreline slopes and layout as well as submerged slopes will all be designed to establish a variety of habitat types to meet requirements of a diverse array of wildlife species. This will include creation of fish habitat, including deepwater habitats, as well as perennial wetland vegetation communities, both emergent and wet-meadow types. Mitigation will include planting of a broad selection of wetland and upland species to maximize the productivity and diversity of habitats on the Property. Creation of the lake will result in increased diversity by adding a variety of fish habitat, including deep water, and a great deal of “edge”, which is how biologists define the convergence of two or more habitat types. In general, the final use of the site will increase the value of the Property as a wildlife area. 9. Section 7-1002.I.1. Waiver Western Slope Materials requests a waiver from the requirement outlined in Section 7-1002(I) of the Garfield County LUDC. Several Local, State, and Federal permits cannot be applied for without conditional land use approval from Garfield County.
