Please clarify reference on pg. 19 to the CDRMS Application location in the submittals. Maps referenced on page 19 are included in the CDRMS Application which is located in Appendix 4/Tab 13 of the binder. The maps for the CDRMS application are also the maps for the Garfield County application as to avoid duplicative inclusion of large drawings. 2. The permit summary in Tab 2 needs to be updated to include a Floodplain Development Permit from Garfield County. Please find the updated permit process graphic located in the dropbox folder and to be included in any future application copies. 3. Please note that storage of flammable liquids is not a permitted use in the floodplain. Application representations regarding fuel storage and fuel farm need to address this issue. All flammable liquids shall be stored in self contained double walled trailer mounted fuel tanks that will be located above the floodplain elevation and they will be easy to move off site in the event of a high water year or 100 year storm. A spec sheet for a double walled fuel trailer is located in the dropbox folder. 4. Additional details on the Augmentation Agreements/Plans status of approval by the Division of Water Resources and potential need for a waiver request to allow it to be addressed as a condition of approval. A letter from West Divide water conservancy district addressing augmentation water is located in the dropbox folder and will be included on any future application copies. 5. Ditch relocation easement needs to be addressed on the site plans and in the narrative.Map G-2, identifying all easements and details for the ditch relocation has been added to the application and is located in the dropbox folder. 6. Section 7-107 needs to address specific design for the access road (width, grade, surfacing, typical cross section, etc.). This section also needs to address any CDOT Access Requirements. The applicant suggests that a condition of approval for this application shall be the successful receipt of a CDOT access permit. The access permit shall identify CDOT's preferred/proposed road construction specifications. The applicant agrees to follow the criteria set forth by CDOT and comply. Engineering of the roadway prior to obtaining CDOT approvals may prove to be inefficient from a timing and resource perspective. 7. Traffic Study need to update the County Road references and CDOT Frontage Road references to include CDOT Access Permitting Requirements. Addressing for adjacent properties is using a North County Road 346 address for this area. The traffic study has been updated to reflect the North County 346 Address. A copy is included in the dropbox folder and will be included in any future application copies. 8. Sections on Waterbody Setbacks (7-203) need to address that the 35 ft. setback is applicable to all wetland areas. The Application calls for a 30 ft. setback in the Initial phase. Compliance with the setback and/or additional waiver requests are necessary to implement the mitigation plans. The Narrative portion of the application has been corrected to identify the waterbody setback at all wetlands as 30' (not 35'). The applicant shall conform to this standard. A copy of the specific page is included in the dropbox folder and will be included in any future application copies. 9. Additional details/documentation on proposed berms for screening need to be provided.The mining snapshot, Drawing C-4 , has been updated to the application and dropbox folder. This drawing illlustrates multiple sections within the mining snapshot as well as indicates slopes, etc. 10. Contact Information for all Ditches on the site and/or affected by the development need to be provided. Your letter from the Ditch Company needs to be included in the electronic and hardcopy applications. Additional specification on the ditch re- route, piping and easements need to be provided. An additional copy of the Bernudy Ditch Relocation approval has been included in the dropbox file and will also be include in any future application copies. 11. A copy of the pre-application meeting summary should be included. The applicant has never received the pre-application document from the planning department. 12. Referral to the Town of Silt prior to a determination of completeness will be required.The applicant acknowledges this and has provided a letter form the town of Silt from preliminary discussions about the application. 13. Please review the list of equipment documented in the noise study to ensure consistency with your operations.The appllicant confirms that the equipment is consistent. 14.Section 7-1002.A.1. LUDC requires the submittal of a letter from the fire district finding that the proposal is adequate. The fire district letter is noted in the table of contents but does not appear to have been included in Tab 16. A copy of this letter has been included in the dropbox folder and will be included in any future application copies. 15.In regard to noise mitigation, the site plans do not appear to document in the processing area the noise mitigation elements included in the noise study. The mining snapshot, Drawing C-4 , has been updated to the application and dropbox folder. This drawing illlustrates multiple sections within the mining snapshot as well as indicates slopes, etc. This additional information illustrates specific noise mitigation strategies listed in the noise study. The applicant will comply with the standards set forth in the noise study document. 16. Please address specific compliance with provisions/standards in Section 7- 1002(H) Reclamation.Please find a response to section 7-1002H in the drop box folder and will be included in any future application copies 17.Please provide specific responses to Section 7-1002(I) including timing issues in Section 1. and include any waiver requests as necessary. The surface use waiver document has been added to the Dropbox folder and will be included in any future application copies. 1 June 30, 2023 Travis Stewart Western Slope Materials, LLC PO Box 1319 Carbondale, CO 81623 Reference: Major Impact Review for North Hangs Gravel Pit (File No. MIPA–04-23-8952) Dear Travis: Thanks again for meeting with us on your submittals for the Western Slope Materials, LLC’s application for a Major Impact Review Land Use Change Permit, known as the North Hangs Gravel Pit (located on Parcel No. 2179-092-00-106). Also thanks the additional materials you provided in response to our meeting and my previous email. We have finalized our completeness review including input from the County Attorney’s Office. Timing for the Floodplain Permit application should also be addressed in the project narrative. In addition, please note that the Land Use and Development Code stipulates that the applicant shall correct the deficiencies within 60 calendar days, or the application will be deemed withdrawn.
