Water augmentaƟon plans in the State of Colorado require approval from the Colorado Division of Water
Resources and Colorado water courts. This process involves months of review and public comment in
most cases. Furthermore, the water requirements for augmentaƟon are dependent on approved mining
and reclamaƟon plans from State and Local permits. Therefore, water augmentaƟon plans are typically
pursued following the issuance of State reclamaƟon permits and Local land use approval. Western Slope
Materials will apply for its water augmentaƟon plan once the Garfield County use permit and Colorado
Division of ReclamaƟon, Mining, and Safety permit are issued. To facilitate condiƟonal approval of the
Garfield County use permit, a will‐serve leƩer from West Divide water conservancy district is included to
demonstrate that water is available to meet North Hangs augmentaƟon needs when the Ɵme comes.

The letter is being provided to document the availability of legal water supply for property owned
by North Hangs Ranch, LLC located in Section 9, Township 6S, Range 92W of the 6^“^ P.M with
Parcel Identification Number 217909200106.
This property lies within the West Divide Water Conservancy District's (WDWCD) Colorado River
Service Area which has a decreed plan for augmentation in Case No. 02CW123. After reviewing
Case No. 06CW121, which quantified 48.44 acre-feet of Historical Consumptive Use credits in
excess of the amount required to augment the full build-out gravel pit operation, it is assumed
that approximately 43 acre-feet of augmentation water will be required from WDWCD to fully
augment evaporative depletions related to the gravel pit operations (Table 1). These water rights
should be verified by the Applicants water rights attorney or engineer prior to applying for a
contract.

WDWCD has water supplies available to augment the North Hangs Gravel Pit at this level of
demand if and when an augmentation contract is needed.
