HomeMy WebLinkAboutFloodplain Development Permit 08.23.2023FLOODPLAIN DEVELOPMENT PERMIT LAND USE CHANGE PERMIT for PROPERTY OWNED BY ECODWELLING LLC, LOCATED AT 301 w' I6TH ST' ADJACENT TO THE CITY OF RIFLE, IN SECTION 9, TOWNSHIP 6 SOUTH, RANGE 93 WEST AND MORE FULLY DESCRIBED IN EXHIBIT A, LEGAL DESRIPTION PARCEL NO. 2177-092-00-045 File No. FDPA-02-23-8943 ln accordance with and pursuant to provisions of the Garfield County Land Use and Development Code, as amended, including but not limited to Section 4'109, Development in the 100 Year Floodplain, the Director of the Community Development Department hereby authorizes the following activity: FLOODPLAIN DEVELOPMENT PERMIT FOR THE PLACEMENT OF FILL WITHIN THE IOO YEAR FLOODPLAIN FOR CONSTRUCTION OF AN EMERGENCY ACCESS ROADWAY This Land Use Change Permit - Floodplain Development Permit is issued subject to the conditions set forth in Exhibit B, the Site Plan included as Exhibit C, and the Director's Decision issued on July 17, 2023 and shall be valid only during compliance with such conditions and other applicable provisions of the Land Use and Development Code, aS amended, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. That the Applicant comply with all Federal, State and Local Regulations including but not limited to Federal Emergency Management Agency (FEMA) requirements, Army Corp of Engineers Requirements and Floodplain Development requirements of the Garfield County Land Use and Development Code applicable to the proposed development. Z. That all representations made by the Applicant in the application, Floodplain Report, and supplemental wetlands memorandum/analysis shall be conditions of approval unless specifically altered by the conditions of approval contained herein. 3. Prior to the issuance of the Floodplain Development Permit, the Applicant shall provide an updated and revised site plan as follows: Delineate the stream channel alignment and Typical and Ordinary High-Water Line. Mapping needs to confirm compliance with 35'ft. setback. Delineation of disturbed areas to be revegetated with riparian vegetation in addition to the straw waddle placemenf. ln addition to the FEMA 100 year floodplain please include and label the calculated/modelled floodplain based on current topography. 4. Prior to the issuance of the Floodplain Development Permit, the Applicant shall provide responses to the County Consultíng Engineer referral comments dated 3121123, that adequately address his concerns including but not limited to slope grades, retaining walls, erosion and scour protection. S. Prior to the issuance of the Floodplain Development Permit a more detailed revegetation/reseeding plan shall be provided including best management practíces and timing. 6. That the Applicant shall remove Russian Olive Trees from site pursuant to the referral comment from the County Vegetation Manager. Removal including timing shall be coordinated with the County Vegetation Manager' 7. Priorto issuance of the Floodplain Development Permit, theApplicantshallprovide a recorded copy of the Statement of Authority and shall address the legal creation of the Applicant's parcel. 3 a. b. c. Prior to issuance of the Floodplain Development Permit, the Applicant's Engineer shall provide a specific Zero Rise Statement or addendum to the Floodplain Engineering Report. 9. Rifle, CO,81650 John Kuersten 13 Powerline Rd Rifle, CO 91650 RE Director's Decision, ECO Dwelling LLC Floodplain Development Permit (File No. FDPA-02-23-8943) Dear John: This letter is sent to you as the representative for the ECO Dwelling LLC Floodplain Development Permit Application, located in Sections 9, T65 R93W located at 301 W. 16th St. adjacent to the City of Rifle. The proper$ is known by Assessor's Parcel No. 2177-092-00-045. The Director's Decision for approval of the Application is based on the following findings: 1. That proper public notice was provided as required for the Director's Decision. 2. Consideration of the Application was extensive and complete, that all pertinent iacts, matters and issues were submitted and that all interested parties were given the opportunity to provide input prior to the Director's Decision. 3. That for the above stated and other reasons the proposed ECO Dwelling LLC Floodplain permit associated with fillfor an emergency access road is in the best interest of the'health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended' 1 5. That with the adoBtions of candititrns the appfication has adequately met the requirements of the Garfiold County Land Use and Development Code, and Floodplain Development requirements, as amended. The Director's Decision is hereby issued approving the EGO Dwelling LLC Floodplain Development Permit, subject to the following conditions: 1. This Director's Decision will be fonryarded to the Board of County Commissioners for a period of 10 days so that they may determine whether or not to call up the application for further review. Once this time period has passed with no request for review or public hearing, and provided all relevant conditions of approval have been met the Floodplain Development permit will be issued. Pursuant to the Land Use and Development Code, the Applicant has one yearfrom the date of the Director's Decision to satisff allconditions of approval or request an extension.
