RE: Grading Permit No. GRAD‐08‐23‐8282; Supplemental Submittal
Dear Mr. Plano,
This correspondence is intended to provide additional background information supporting the
application for a Major Grading Permit for McClure River Ranch submitted on August 30, 2023.
Floodplain Development Permit; Director Determination; File No. FDPA6264
As you are aware, a Floodplain Development Permit (the “Permit”) was issued for the subject property
and recorded at Reception No. 786310 on 5/21/2010. The Permit specifically authorized the “placement
of fill” within the flood‐fringe on the designated 100‐year floodplain of the subject property. The
approved Permit contains eleven conditions of approval related to the placement of that fill. We wish to
provide responses to those conditions as follows:
1. All representations of the applicant within the application shall be considered conditions of
approval unless otherwise modified by the Director Determination.
Response: This is acknowledged.
2. Prior to issuance of the Final Plat for TCI Lane Ranch PUD the Applicant shall provide a copy
of the conditional FIRM and floodway map revision approved through FEMA.
Response: This was completed, and the Conditional Letter of Map Revision (CLOMR) was
issued by FEMA on March 17, 2011, as provided in our application submittal.
3. No alterations of the floodplain may be made other than the specific improvements noted
in the application and shown on drawings by James Brzostowicz, P.E., as labeled "General
Layout Pedestrian Bridge" and "Floodplain Site Plan Lots" Sheets 1 and 2 attached hereto as
Exhibit B.

Response: The Sheets 1 & 2 referenced in this condition show proposed grading plans
including existing contours (dashed lines) and proposed contours (solid lines), which are
identical to the grading plans submitted to FEMA for the CLOMR. The intent of these
Sheets was to demonstrate the proposed grading; the lot lines are shown merely for
reference and do not constitute the approval of a subdivision or any improvements other
than the approved “placement of fill” associated with the Permit. Sheets 1 & 2 are
attached to this letter as Exhibit B of the Permit.
4. All new construction or substantial improvements shall be designed (or modified) and
adequately anchored to prevent flotation, collapse or lateral movement of the structure
resulting from hydrodynamic and hydrostatic loads, including the effects of buoyancy.
Response: We are not proposing any new construction at this time other than grading.
5. All new construction or substantial improvements shall be constructed with materials
resistant to flood damage.
Response: We are not proposing any new construction at this time other than grading.
6. All new construction or substantial improvements shall be constructed by methods and
practices that minimize flood damage.
Response: We are not proposing any new construction at this time other than grading.
7. All new construction or substantial improvements shall be constructed with electrical,
heating, ventilation, plumbing, and air conditioning equipment and other service facilities
that are designed and/or located so as to prevent water from entering or accumulating
within the components during conditions of flooding.
Response: We are not proposing any new construction at this time other than grading.
8. All new and replacement water supply systems shall be designed to minimize or eliminate
infiltration of flood waters into the system.
Response: We are not proposing any water supply systems at this time.
9. New and replacement sanitary sewage systems shall be designed to minimize or eliminate
infiltration of flood waters into the system and discharge from the systems into flood
waters.

Response: We are not proposing any sanitary sewage systems at this time.
10. On‐site waste disposal systems shall be located to avoid impairment to them or
contamination from them during flooding.
Response: We are not proposing any OWTS at this time.
11. No disturbance of a regulated wetland shall be allowed.
Response: The grading plan avoids impacts to existing wetland areas (and associated
orchid habitats).
Our grading permit application included plans prepared by Roaring Fork Engineering. Sheet 2 of those
plans shows the proposed grading, existing wetlands, and the modified floodplain area as approved by
both FEMA and Garfield County. The modified floodplain as shown on that plan corresponds exactly to
the approved Sheets 1 & 2 of the 2010 Permit. This is intentional, as the Applicant intends to comply
with the grading that was approved by the Floodplain Development Permit and the FEMA CLOMR in all
future activities on the property. The proposed grading as shown in our grading permit application is
entirely within the approved floodplain development area and does not impact wetlands or the
associated orchid habitat.
The Permit does not have an expiration date, nor has Garfield County taken any steps to revoke the
Permit, therefore, the Permit is still active and runs with the land (and shows up on title). It is our
opinion that the Applicant may exercise their rights under the Permit, so long as they comply with all
conditions including that the “placement of fill” remains within the approved area as indicated on the
referenced Sheets 1 & 2 of the Permit.
Attached to this letter I have provided a marked‐up version of the proposed grading plan, indicating the
area of the approved modified floodplain. You will find that this area corresponds precisely to the area
approved in the 2010 Floodplain Development Permit.
