Thanks for reaching out. tor the amended final plat application, it looks like we had conditions of
approval related to items on the final plat and we were looking for additional information related to the
ditch that the application saíd was going to be abandoned. Either a letter from the operator stating that
or information on how the applicant will mítigate any ímpacts on the ditch. There were additional COI(s
for the SDU permit, but first on that list is getting the plat recorded. l've reattached both letters for your
reference.
Once you get me the ditch information, you can send me a pdf of the draft final plat so I can confirm the
other COA's on it and double check certificates/related items. This way we don't run into any issues
after going to mylar and collecting signatures.

Patrick, please see the attached Director's Decision letters. There is a l-0 day call-up
period, during which the BOCC, the applicant, or a neighbor may request the BOCC to
consíder the decisíons. After that time, the decísions are considered final. I have
attached a copy of my staff report for additional reference.

FINNBAR HOMEOIVNERS ASSOCIATION, INC., a Colorado nonprofit corporation,
whose address is 32 Buttonball [,ane, Weston, Connecticut 06883 ("St. Finnbar" or "Grantor")
and H. LAWSON \ryILLS and SHEILA KËNNEDY WILLS, whose addrcss is 1800
Medicine Bow Road, Aspen, Colorado 81611 ("Wills") and DEANSAN, LLC, a Louisiana
limited liability company whose addrEss is c/o Donald B. Wiener, 330 Marshall Strect, Suite
640, Shrcveport, Louisiana 7 1 1 01 ("Deansan") (col lectively- "Grantees").
Background:
A. The V/ills are the owners of Lot 12, St, Finnbar Farm, according to the plat thereof
rcc.ordsd January 9, 2001 at Reception No. 57473I ("Lot 12").
B. Deansan is,the owner of Lot 13, St. Finnbar Farm, according to the plat thereolrecorded
January 9, 2001 at Reception No.574731 ("Lot 13"),
C. St. Finnbar is the owner of certain water rights decreed to the l-ower Ditc'h, described in
the Ditch Realignment and Modification Agreement and Grant of Ëassmenl as recorded
May 29, 2007 at Reception No. 724360, and used uptn the land more particularly
described on the Final Plat of the St. lìinnbar Ranch as recorded on January 9,2001 at
Reception No. 57473.l .
D. The main Lower Ðitch çrosses County Road 100 where it enteru a concrete box
("splitterbox") on the St. Finnbar side of County Road 100, Then, the water can bc
directed to the north into a latcral of the Lower Ditch ("Upper Lateral") or to the south
into another lateral of the Lower Ðitch f'Lower Lateral"). The LJpper l,ateral is roughly
depictcd in orange on the map attached as Exhibit A.
E. The Upper Lateral than traverses the çenter of Lot 12 and Lot 13, through the building
envelopes ("Lot 12 and [,ot 13 Building Envelopes"), as approximately shown on thc
map attached as Exhibit A.
F. St. Finnbar owns an easement for the LJpper Lateral along its current and historic
alignment, beginning at the Splitterbox and continuing across Lot 12 and Lot f 3 (the
"F)asement").
G. In 2007, St. Finnbar, through its engineers, rcvised its irrigation plan and proposed to
cease diversions through the Upper Lateral and remove the ditch structure. That lctler is
attached as Éxhibit A.
H. St, F'innbar now wishcs to formally vacate the Easement, in accordance with the intent of
its 2007 inigation plan.

I.['[owever, the easement for the Lower Latcral as it runs across the southern boundary of
I.,ot 12 and Lot 13, as shown approximately in blue on trxhibit A, shall not be affected by
this Quit Claim Deed and Vacation of liasement and shall remain in place for the benefit
of St. Finnbar,
NO'{y THEREFOIIE, for good and valuable consideration" the receipt and suffrciency of
which is hereby acknowledged:
l. st. Finnba¡ hereby vacatss, quitclaims, abandons, and frrrevcr retinquishe s any
and all right, title, and interest it has in and to the Easement and any
prcscriptive or unrecorded easement interest it may have, if any, over and
across the Lot 12 and Lot t3 Building Envelopes, together with all benefits
and burdens whatsoever relating thereto. This vacation. abandonment, and
release of the above-described Easement shall be a full release of the
restrictions, obligations, benefits, and servitudes associated with such
ßasemcnt, shall run with title to Lot l2 and Lot 13, and shall be perpetual.

modifications necessary to çeasÊ diversion of water from the Splitterbox into
and through the Upper Lateral. St. Finnbar will be responsible for all costs
