BARGAIN AND SALE DEED
(Correction Deed)
BATTLEMENT MESA PARTNERS, a Colorado general partnership, (Grantor) whose address is
73G Sipprelle Drive, Parachute, CO 81635, for Ten Dollars ($10.00) and other good and valuable
consideration in hand paid, hereby sells and conveys to GARFIELD COUNTY SCHOOL
DISTRICT 16, a political subdivision of the State of Colorado, whose address is Post Office Box 68,
Parachute, Colorado 81635-0068, (Grantee) the following described real property to wit:
Restricted Reserve "C"
Monument Creek Village, Section Two,
of the Battlement Mesa P.U.D.,
Garfield County, Colorado, containing 9.134 acres ("the Property")
With all its appurtenances, subject to (i) all encumbrances and restrictions of record prior to May 1,
1981 and (ii) the rights and title of any condemning authority.
[NOTE: This deed corrects the Bargain and Sale Deed for the Property recorded on July 8, 1993, at
Reception No. 449641 in the Garfield County Clerk and Recorder's Office ("Original Deed").
Specifically, this deed corrects and removes the scriveners' error of including "and restricting the use
of such property solely to public use" in the property description. The Grantor did not intend to
include such a restriction in the Original Deed and hereby removes, omits, abandons, and releases the
Property from that restriction. All other information, including the Grantor, Grantee, and the legal
description for the Property, remains unchanged.]
