To Nutrient Holdings, LLC,
Garfield County Public Health (GCPH) issued Onsite Wastewater Treatment System (OWTS) permit #s
SEPT‐7966 and SEPT‐8152 for the property located at 9108 County Road 335, New Castle, CO 81647 on
October 9, 2023. After these permits were issued, staff became aware of grading operations and heavy
equipment storage around the proposed Soil Treatment Area (STA). This is a violation of Garfield
County OWTS Regulations, Section 43.5.H: Site protection: Prior to and during construction, the
proposed soil treatment area and replacement area, if any, must be protected from disturbance,
compaction, or other damage by means of staking, fencing, posting, or other effective methods.
In addition, the OWTS design by SGM, Inc. that is part of the OWTS permit stated in Note#7: The soil
treatment area (STA) shall be protected from compaction. Vehicular traffic shall be kept off the STA and
vehicles shall not be parked on the STA. Dump trucks and heavy tired vehicles shall not be allowed on the
soil treatment area. All soil rutted or compacted shall be removed and replaced with sand. We have
attached SGM design sheet 1 of 2 of the “OWTS Layout” to this letter for your review.
Per the Agreement on page 2 of the OWTS permit (also included with this letter for your review), this
letter serves as notice to you, representatives of the parcel owner Nutrient Holdings, LLC, that GCPH is
revoking OWTS Permit #s SEPT‐7966 and SEPT‐8152 at this time.
The Agreement states, in part:
In consideration of the issuance of the permit, the applicant hereby agrees to comply
with all laws and regulations related to the zoning, location, construction, and erection
of the proposed OWTS and associated structures for which this permit is granted. The
applicant further agrees that if the above said regulations are not fully complied with in
the zoning, location, erection, and construction of the above described OWTS and
structure, the permit may then be revoked by notice from the Health Department and
immediately become null and void.

Construction of an OWTS without a valid OWTS permit is not permitted. As stated in the Garfield County
OWTS Regulations, Section 43.4.B.1: Prior to installing, altering, or repairing a system, the applicant
must obtain a permit from the local public health agency. For staff to issue a new permit for the
construction of an OWTS on this property, the original application must be updated and resubmitted for
review and approval. Information to include:
1. New location of proposed STA and/or proposed mitigation of existing impacted STA location.
2. Modify OWTS design if necessary.
Once revisions to this OWTS permit application is submitted for this property, GCPH will determine if the
OWTS is designed and located in accordance with Garfield County Onsite Wastewater Treatment

Permit Conditions:
This OWTS Permit is approved on the condition of compliance with the report and design as
submitted by SGM dated October 3, 2023. Changes to the design and permit must be approved by
Garfield County Public Health and the designer prior to construction.
The new OWTS will serve three mobile offices, a food truck restaurant, a farm store, and a
greenhouse. The system will consist of a new, two‐compartment 1,500‐gallon septic tank set level
with access to grade and a high‐head pump in the second chamber. A grease interceptor tank will be
installed between the food truck restaurant and the septic tank. Effluent will be pumped to an
automatic distributing valve set at the high point of the system that will distribute effluent to 1,872
ft2 of STA. The new STA will consist of six gravelless chamber trenches, each trench consisting of 26
chambers per trench (126 chambers total) on top of a 2‐foot‐deep unlined sand filter. Distribution
laterals are to be 1 ½ inch Schedule 40 PVC with 5/32‐inch orifices 4‐feet on center and the laterals
ending in flushing valves at the distal end of the laterals. Laterals are to be hung from the underside
of the chambers with zip‐ties. The orifices are to be facing upward, except for the first and last
orifice (which shall face downward for drainage purposes). Inspection ports are to be installed at
each end of each trench. Maintain all setbacks and elevations as designed.
Contact the designer and Garfield County Public Health at least 48 hours prior to requesting final
inspection of the installed system prior to backfill. NO OWTS COMPONENT SHALL BE BACKFILLED
WITHOUT PRIOR APPROVAL FROM GARFIELD COUNTY PUBLIC HEALTH AND THE DESIGNER.
Agreement
All installations must comply with all requirements of the Garfield County OWTS regulations
including but not limited to the conditions specified above.
In consideration of the issuance of the permit, the applicant hereby agrees to comply with all
laws and regulations related to the zoning, location, construction, and erection of the proposed
OWTS and associated structures for which this permit is granted. The applicant further agrees
that if the above said regulations are not fully complied with in the zoning, location, erection,
and construction of the above described OWTS and structure, the permit may then be revoked
by notice from the Health Department and immediately become null and void.
The issuance of a permit and specifications of terms and conditions therein will not constitute
assumption of liability, nor create presumption that the local public health agency or its
employees may be liable for the failure or malfunctioning of any system. Permit issuance will
not constitute a certification that the system, the equipment used in the system, or any
component used for system operation will ensure continuous compliance with the provision of
the OWTS Act, the regulations adopted thereunder, or any terms and conditions of a permit.
Permit Approval
Plans and specifications for the proposed OWTS have been reviewed and are considered
satisfactory. Permission is hereby given to the property owner(s) to perform the work indicated
in accordance with the Garfield County OWTS Regulation. This Permit will expire 1 year from
the date of issuance unless construction on the system has commenced. An "as‐built" drawing
must be submitted and inspection of the system must be completed by GCPH before final
approval of the system will be issued.
