That the Applicant comply with all Federat, State and Local Regulations including but not limited to'fäderal Emergency Management Agency (FEMA) requirements, Army Corp of Engineers Requiremeìts and Floodplain Development requirements of the earï¡elO Co-unty Land Use and Development Code applicable to the proposed development. 2. That all representations made by the Applicant in the application and Floodplain Report including tne UpOated Engineeriñg Report, dated 12l8l23from Sopris Engineering shall be conditions of approval unless sþecifically altered by the conditions of approval contained herein, prior io the issuance of the Floodplain Development Permit a stamped copy of the Updated Report shall be provided and the report shall be supplemented with a zero-rise statement. 3. All structures constructed within the 1OO-year floodplain shall have a finished floor elevation a minimum of 1 foot above the calculated base flood elevation reflected in the Applicant's Engineering Report. In addition, as represented in the Floodplain Report all other structures outsidã of the 1O0-year floodplain shall also have finished floor elevations a minimum of 1 ft. above the base flood elevation' 4. All structures shall be constructed with engineered foundations designed to resist any hydrologic or hydrostatic forces resulting from flood water impacts and with infiastiucturð improvements designed to be watertight should flood waters impacts the site. S. That the Applicant shall comply with all conditions of approval for the 2008 Fioodplain Development Permit issued for the site on 5121120A8 and recorded a Reception No. z+gö73 unless specifically altered by the conditions of approval contained hereiñ. The Applicant has represented that outside storage of Recreation Vehicles is being phased out. ln the interim the Applicant shall provide confirmation that they are in "orþli"n.e with all conditions related to outside storage of Recreation_al Vehicles on the site including maintaining them as operationalfor removal prior to any flooding events on the site. 6. That the Applicant shall comply the County Vegetation Management referral comments dated jltzztzg including provision of a weed inventory on the site and an acceptable weed management plan-. The plan shall be provided no later than 61112024 unless extended by thJ County Vegetation Manager and shall include removal of any Russian Olive trees on the site by the end of the 2024 calendar year. 3 EXHIBIT "B'' (page 2 o1 2l CONDITIONS OF APPROVAL 7. That the Applicant shall comply with the Army Corp. of Engineers Wetland determination including limiting development activities to the already improved paved and disturbed eastern portion of the site with the exception of weed management and removal of non-native trees. Prior to issuance of the Floodplain Development Permit, the Applicant's site plan shall be updated to reflect this limitation, designation of a 35 ft, buffer outside the development area, and reservation of the west end of the site for stormwater drainage and detention as represented in the Floodplain Reports and Firwood Engineering "Storm Repoil". 8. All storage contracts or leases for storage units shall include provisions prohibiting storage of any hazardous materials, flammable liquids or fuels within storage units. 9. That the Applicant shall construct the proposed flood conveyance swale during the initial phase of construction with completion prior to any certificates of occupancy for structures within the 1O0-year floodplain. The swale shall be maintained with removal of cjebris anci keeping vegetation iow fbr a "grass swale in good condition" as represented in the updated Engineering Report. 10.
