I checked with Barrett Cyr and he said that the wett was dritted within 200 feet of the decreed location,
so there is no need to the second wett.
The pond evaporation witt be fitted by ground water f rom the pond or the wetl
lrrigation may be stored in the pond for less than 72 hours under its own priority. The pond wi[[ remain
futt at the naturaI ground water [eve[.
I deteted the second wetlfrom the apptication ptease submit if for approvatthe Barctay is wanting to
buitd the pond as soon as possibte.

I ran the Gtover for the evaporation from the Mitter Pond/Wett, the existing groundwater wett, and
proposed groundwater wett. You are correct in that they are essentiatty the same for each month from
each source. However, it is not at a uniform rate across atl months. ln other words, the Appticant can
augment the evaporation from any of the sources and the timing wil,l, not matter.
There is a sticking point in proceeding with the new contract for Lot 6. As you pointed out, the actuaI
tocation of the existing wetl is more than 200 feet from the 01CW305 decreed location. To
correct this, al,tof the domestic & irrigation uses augmented under 01CW305 for Lot 6 under Contract
324 needs to be part of this new apptication. ln order not to doubl.e augment or needtess tie up BWCD
contract suppties, BWCD witt require that Contract 324 concurrentty be amended to remove the Lot 6
depl,etions. This wil,t be the case of al,tthe l,ots within St. Finnbar that have this wett location
issue. Therefore, it may be much cteaner and easier for the HOA to simuttaneousty amend Contract
324 and get a new umbretl,a ptan contract as necessary for the groundwdter wetts and inctude
contemplated wett/ponds as part of that new contract. The HOA could conduct a special assessment
asappropriateforeach totowner. lf you stittwantto proceedwith just Lots6 and7, p[easeadjustthe
appl.ications as necessary and submit an amendment apptication for Contract 324.

wetts (as described in the appl.ication); and/or the Middte Ditch, or any combination thereof.
Locations are provided in the appl,ication except for the Middte Ditch [ega[ description, which is

it. The apptieation on Page 5 stitt states that intiat pond fitting eae h year is to be eoverd by the
contract whereas Scott Mil,l,er has described that occuring under free river conditions in a subsquent
emai[. This shoutd also be corrected so that the contract can be property noticed.
Middle Ditch: The headgate is located on the north bank of said channel near the eastern line of the
land claimed by Alexander Patterson, near the north Bank of the Roaring Fork River on or near
Section 32,T 7 S, R 87 W of the 6th P.M.
UTM NAD83 213: Northing- 4363735, Easting - 315720
The appticant is not requesting additionaI water for irrigation. Water f rom the Middte Ditch may be
diverted under its own priority when avaitabte. Understood.
The domestic water and Limited irrigation (8300 sq. ft.) is currentty diverted from a separate wetl
augmented under (tot 6 Wett) 01CW0305. lf possibte, we were requesting that the domestic water
and the pond evaporation be diverted f rom either of two wetl as an atternate point of diversion for
the originat wett. Pond evaporation coutd be added as a separate contract. Once the contract is
obtained the Appticant wil,l, need to revise the -F wetl permit to reference both BWCD contracts.

I am assuming this appl,ication is simitar to Lot 6 owned by St. Finnbar Farm, LLC. However, in ltem
5 you don't mention Wett #1 , LotT , but rather the Laterat ditches or pumps off
the Middte Ditch. Further down, the appl,ication onty describes Wett #1, Lot 7 as the fitt
source. Based on further review of the appl,ication, it appears to be both. If so, ptease add the Legat
description for both the Middte Ditch point of diversion off of the Roaring Fork River and the we[t,
ptease add the existing wel.t permit number, and ctarify the description of the fitt sources.
For both this appl,ication and St. Finnbar Farms, I need to know the amount of water (other than
evaporation)for every month each Appticant wants. Scott Mil.l,er had previously mentioned the wetts
witl al.so be used for shoul.der season fil.ting, topping off, or any time the Middte Ditch water is not
avaitabte. As such, I need a more specific augmentation retease schedute. BWCD sets the retease
schedute based on the apptication and can onty be subsequentty modified by an amendment. Given
the pond/wetts are not [ined, there is tikety a significant amount of seepage loss when the ditch is off
as the water tevel in each pond/wett wil,l, want to reach an equil,ibrium with the groundwater. ln other
words, the appl,icants coutd be pumpin 92417 just to keep up with the exfittration rate during those
times. Att of this water woutd atso be considered 100% deptetive f rom the wetl to the wett/pond so
the contract witt get quite expensive.
The St. Finnbar Farm, LLC apptication is currentty on hotd untiL the retease schedute is
addressed. As such, ptease inctude a retease schedute for the Lot 7 apptication before submitting
