Date: June 28, 2024 Re: Middle Colorado Ag Collaborative Fish Passage Design: Mineral Rights Owners Wright Water Engineers, Inc. (WWE) is pleased to provide this memorandum detailing the research completed to date regarding potential mineral rights owners on the properties affected by Projects 1, 2, and 4 of the Middle Colorado Ag Collaborative Fish Passage Design (Project). The Project includes abandonment of the Ryden No. 1 and Ryden No. 2 diversion locations as well as improvements to the CO&CP Pierson, Benson Pierson Nelson and Roseman diversion structures including, but not limited to; modifications to the diversion crest elevation, construction of a concrete diversion structure with a trash rack, fish screen, upgraded headgate, sediment sluice, automation, and telemetry. All diversion structures and work associated with the Project will take place on the following Garfield County (County) parcels: • 21251400125 (Owner: Meadow Creek LLC) • 212510200955 (Owner: Bureau of Land Management) • 212522400958 (Owner: Bureau of Land Management) WWE began research by reaching out to Meadow Creek LLC to understand the mineral rights located on their property. A mineral rights study was performed before the current owner purchased the property. The mineral rights study found that all mineral rights on the parcel were previously owned by Exxon. When the property was sold, Exon signed over the mineral rights with the property to Meadow Creek LLC. Attachment A shows an email from Patrick L Barker of Karp Neu Hanlon, showing the status of mineral rights. WWE continued research on the BLM-owned parcels by reaching out to the BLM Realty Specialist, who referred us to their Geologist. Based on email correspondence with Brittany Cocina (BLM Geologist) on June 25, 2024, there are not any active mineral claims in either of the areas that pertain to our project. As a result, the BLM owns the mineral rights in their parcels. The email correspondence with Brittany Cocina is included with this letter as Attachment B.
