Re: Middle Colorado Agricultural Collaborative: Ownership Approval
The following memorandum provides various documents required by Garfield County for the
Floodplain Development Permit associated with the Middle Colorado Agricultural Collaborative
(MCAC) project (Project). The following documents are attached as requested in an email from Glen
Hartmann on September 3, 2024. The request from the email (italicized text) and supporting
information is provided below.
1) Please let us know the status of the BLM approvals/authorization and if perhaps you have already
obtained them. The signatory for the BLM will need to be an individual with the proper
authority. The Attorneys have also requested a Statement of Authority from the BLM
documenting said authority.
a) Currently, the Bureau of Land Management (BLM) has stated we can start the project, and
the BLM will complete the National Environmental Policy Act requirements. Currently, the
landowner is working with the BLM to establish a permanent Right of Way for the diversion.
i) Project 2 includes replacing about 100 feet of pipe, 10 feet of concrete headwalls, and the
headgate within the BLM parcel. Formal approval from the BLM in the form of a Right
of Way is in process and will be completed. We have been told we can start the project
via email included as an attachment.
ii) Project 4 includes about 273 feet of ditch grading within the BLM parcel. This is
considered maintenance by the BLM, and approval is not required.
iii) Please see attached email correspondence from the BLM that work can proceed
(Attachment 1).
2) It would also help if you could provide a site plan that shows the location of the BLM property in
question relative to the projects. This would help us to explain the extent of their
involvement. From our site visits I don’t recall any of the in-stream work being on BLM, but I
may not be recalling that correctly. This will help us to consider best options for addressing
BLM Authorizations.

a) Site plans with parcel boundaries and numbers have been attached. (Attachment 2)
3) A Statement of Authority is also needed for Meadow Creek LLC.
a) A statement of authority is available through the Garfield County Assessors database online,
but only accessible by County employees. The Statement of Authority is 876755. Mark
Magidson is the owner of Meadow Creek, LLC. (Attachment 3)
4) A letter authorizing representation by Wright Water Engineers and/or Tim Casey may also be
appropriate.
a) Please see the attached Landowner Agreement signed by Mark Magidson, allowing access to
the property to complete the projects. (Attachment 4)
5) Provision of deeds of ownership and/or title commitments that confirm ownership.
a) A Special Warranty Deed is available through the Garfield County Assessors database online,
but only accessible by County employees. The Special Warranty Deed is 876751.

6) Double checking the 200 ft. property owner list is also needed.
a) The 200-foot property owner list has been updated and provided for your use. We were
informed that a few properties were not included. (Attachment 6)
7) Signed Agreement to Pay Form is needed as we will incur some expense from our Consulting
Engineer (see attached).
a) The signed agreement form has been attached. (Attachment 7)

We discussed it at our meeting, and you may start the project and we will do the NEPA as a CX. I
believe we discussed this option during the last meeting we all had. I have attached our SF-299
form to apply for the ROW. Please have the landowner or a representative for the landowner fill this
out. The ROW will go under the landowner’s name since they are the one with the water rights.
Unless there is a ditch company attached to this ditch then it will be them to hold the ROW.

Form Payment Agreement
PAYMENT AGREEMENT FORM
GARFIELD COUNTY (“COUNTY”) and Property Owner (“APPLICANT”) ______ ____
______________________________________________________________________ agree as follows:
1. The Applicant has submitted to the County an application for the following Project:
__________________.
2. The Applicant understands and agrees that Garfield County Resolution No. 2014-60, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final consideration by
the County of any Land Use Change or Division of Land.
