SUBJECT Temporary Use Permit Start and Completion Date
PERMIT DURATION AND CONDITIONS OF APPROVAL
The Board of County Commissioners granted a temporary use permit for contractor’s yard and
helicopter pad operations on Parcel No. 217913100554. The Board approved this use on November 4,
2024, at a public hearing. The permit is attached as Exhibit A.
The applicant has provided submittals fulfilling the Conditions of Approval, including a separate grading
permit that has been approved. On December 5, 2024, a pre-construction meeting was held, at which
the applicant represented that they will begin grading activities on December 9, 2025. The six-month
window for temporary use permits will expire on June 9, 2025.
The applicant must maintain compliance with all Conditions of Approval. A bond has been issued as
revegetation security.

LAND USE CHANGE PERMIT
for
A Temporary Use Permit for Storage and Helicopter Yards, applied for by XCEL,
to support an electric transmission line rebuild. The permit is located on a parcel
in Sections 12 and 13, Township 65, Range 91W and Section 18, Township 65,
Range 92W owned by Sharon and Brit Mclln, and the Site Plan shown in
Exhibit A.

ln accordance with and pursuant to the provisions of the Garfield County Land
Use and Development Code o'f 2013, as amended, the Borad of County
Commissioners, Garfield County, State of Colorado, hereby authorizes, by Land
Use Change Permit, the following activity.
"TEMPORARY USE PERMIT FOR STORAGE
AND HELTCOPTER YARDS" (GAPA 09-24-9035)
The Temporary Use Permit is hereby conditionally issued based upon the
conditions in Exhibit B and shall be valid only during compliance with applicable
provisions of the Garfield County Land Use and Development Code of 2013, as
amended, Building Code, Conditions of Approval of the Director's Decision
Letter, and other regulations of the Board of County Commissioners of Garfield
County, Colorado.

l. All representations contained in the Application shall be conditions of approval
unless specifically amended or modified by the conditions contained herein.
2. The Temporary lJse Permit shall be subject to all applicable federal, state, and local
laws.
3. All helicopter uses and landing zone designs shall comply with applicable FAA
regulations.
4. All traffic control plans relative to the use of the Yard shall be submiffed to Garfield
County Road and Bridge for review. Copies shall be submiffed to Community
Development Staff.
5. Final CDpHE Stormwater Discharge Permit and associated SWMP plansets shall be
provided to community Development Staff prior to operations.
6. Additional information on fuel storage and safety practices shall be provided to
Community Development Staff. Prior to conducting helicopter fueling operations at
the yard, tire applicant shall submit copies of the fueling plan and applicable permits,
including grading and stormwater permits to the extent such permits are necessary'
Helicopteifueling operations that occur at the Yard shall be conducted in compliance
with applicable regulations, including requirements regarding stormwater
management and sPill Prevention.
7. prior to operations, the applicant shall provide proof of coordination with the
Colorado River Fire District to staff, and the applicant shall provide them and
Community Development Staff with appropriate Emergency Operations Plan. If any
measures are deemed necessary or required by the District, they shall be
implemented.
8. The yard shall maintain compliance with applicable noise standards' If a complaint is
received, the applicant shall coordinate with Community Development Staff to ensure
operations comply with applicable standards'
g. The applicant shall schedule a pre-construction meeting with Community
Development Staff within 180 days of approval. At that meeting, the Applicant shall
provide staff with the start date of the Mclin Temporary Use Permit for Storage and
Helicopter Yards.
10. If modified flight paths are approved by the FAA, the applicant shall move the
Ilelicoptcr t-anOing Zone further north to provide additional buffer to neighboring
residences.
1 1. Any necessary reclamation security shall be provided with a separate grading permit.
