RE: Director's Decision Letter - Antlers Orchard Development Plat No. 1
Amended Final Plat Tracts 5, 6, LL, L2,2L and22 - FPAA'O+'24'902O
Dear Bill and Keith:
This letter is sent to you as one of the Applicant and authorized representative for the
Antlers Orchard Development Plat No. 1 Amended Final Plat Tracts 5,6, LL, L2,21
and 22 - FPAA-04 -7,4-9020.
The Application requested amendments to reconfigure the existing [6) tracts of 10+
acres in size into the proposed configuration of 6 tracts as follows: (L) 4O-acre tract;
(1) 18.9 acre tracq & (4) 3 acre tracts. No new Tracts are created as part of the
ipplication. The Application has been reviewed in accordance with the
Administrative Review procedures contained in the Land Use and Development Code
as amended. Said provisions require a decision by the Director of the Community
Development Department on whether to approve, approve with conditions, or deny
the request.
The Director's Decision is hereby issued approving your Application with a finding
that the Applicant has completed all public notice requirements and that subiect to
compliance with conditions of approval the Antlers Orchard Development Plat No' 1
Amended Final Plat Tracts 5, 6, IL, L2, 2T and 22, meets the requirements and
standards of the Garfield County Land Use and Development Code, including the
Amended Plat Review Criteria contained in Section 5-305. The approval is subject to
the following conditions of approval.

1. All representations of the Applicant contained in the Application
submittals shall be conditions of approval unless specifically amended or
modified by the conditions contained helein.
2. Final edits to the proposed pla! including plat notes and title, shall be
completed, reviewed, and accepted by the County, including County
Attorney, Surveyor, and Assessor offices prior to recording including but
not limited to:
a, A plat note shall be required that site specific soils testing is required
for foundations and OWTS systems shall be designed by an engineer.
b. Removal of the City of Rifle Plat Certificate.
c. Plat note referencing the irrigation agreement recorded at Reception
# 557808.
d. All utility and access easements need to be shown on the Plat.
e. A plat note shall be added stating that an access permit from Road and
Bridge is required for all new driveways and that the driveways shall be
in conformance with 7-L07, as adopted.
f. The Treasurers Certificate shall be added to the Plat.
g. The Applicant shall confirm if there is a lien holder on the property.
h. Mineral owners shall be added to the flat.
3. The Applicant shall have 180 days from the date of the Director's
Decision to complete all conditions of approval and submit the Minor
Subdivision Plat for recording. Extensions may be approved by the
Director of the Community Development Department.
Per the Comments received from the Division of Water Resources, Well
Permits Nos. L57188 and 329459 will be amended to reflect the new
legal descriptions.
Thc Land Usc antl Development Code requires notification to thc Board of County
Commissioners for their review and potential call-r:p of the Director's Decision. The
Board review is for a period of 10 calendar days commencing on the date of the
Director's Decision. The call-up period shall expire on August 3L. 2024. The Amended
Final Plat will be scheduled on the Board of County Commissioner's consent agenda
after expiration of the call-up period and once all conditions of approval have been
satisfied including editing of the plat and acquisition of all necessary signatures.
Please note that you will have 180 days from the date of approval to submit a plat
suitable for recording. Extensions may be requested prior to the expiration of the

original time limit. Please contact the Community Development Department if you
