CERTIFICATION OF MINERAL OWNER RESEARCH
This form is to be completed and submitted with any application for a Land Use Change Permit.
Mineral interests may be severed from surface right interests in real property. C.R .S. § 24-65.5-101, et seq,
requires notification to mineral owners when a landowner applies for an application for development from a
local government. As such, the landowner must research the current owners of mineral interests for the
property.
The Garfield County Land Use and Development Code of 2013 ("LUDC") Section 4-101(E)(l)(b)(4) requires
written notice to owners of mineral interests in the subject property in accordance with C.R.S. § 24-65.5-101,
et seq, "as such owners can be identified through the records in the office of the Clerk and Recorder or
Assessor, or through other means." This form is proof of applicant's compliance with the Colorado Revised
Statutes and the LUDC.
The undersigned applicant certifies that mineral owners have been researched for the subject property as
required pursuant to C.R.S. § 24-65.5-101, et seq, and Section 4-101 (E)(1)(b)(4) of the Garfield County Land
Use and Development Code, as amended. As a result of that research, the undersigned applicant certifies

I represent Aspen Polo Partners, LLP, a Colorado limi ted liability limited partnership, the
owner of the property now known as McClure River Ranch (the "Property") and described in the
deed recorded June 1, 20 17, as Reception No. 893042 of the Garfie ld County Records. This
letter is intended to provide to you a list of the owners of any subsurface mineral interests. I
reviewed the deeds from the original patent issued by the U.S . Government to Thomas McClure
dated June 30, 1892, to the deed to the current owner of the property.
There are only two documents of record that create a re served right in mineral interests.
These are as fo ll ows.
1. The Warranty Deed dated December 29, 1943 , and recorded in Book 208 at Page 584
as Reception No. 105766 whereby the Property was conveyed from Posic Cerise and
Ollie Cerise to Margaret Phipps. In that deed, Posie Cerise and Ollie Cerise reserved
to themselves an undivided one-half interest in all oil and gas rights in or under the
Property. There is no address given for the holders of the res erve d interest and we are
unable to locate any further conveyances of this re served interest. A copy of this
deed is attached.
2. The Quit Claim Deed dated February 20, 196 1, and recorded in Book 333 at Page 302
as Reception No. 2 13359 whereby a very small portion of the Property was conveyed
from Oscar Cerise and Wilma Cerise to Posie Cerise and Ollie Cerise. In that deed,
Oscar Cerise and Wilma Cerise reserved to themselves an undivided one-half interest
in all oil and gas rights in or under the Property. There is no address given for the
holders of the reserved interest and we are unable to locate any f uither conveyances
of this reserved interest. The property conveyed by this deed was primarily the

adjacent property known as the Catherine Trai ler Park immediately to the northwest
of the Property. However, a small portion of the property transferred by such deed
was within the boundary of the Prope1ty as it exists today. A copy of this deed is
attached.
I am aware that in a letter provided to you dated October 10 , 2017 with a prior
application related to the Property there was a reference to reserved mineral interests in another
deed. The additional deed referenced in tha t letter was a Deed from Margaret Phipps to Oscar
Cerise and Wilma Cerise recorded in Book 257 at Page 110 as Reception No. 175244. However,
that deed did not include a new or different reservation. That deeds states that "there is also
excepted and reserved hcrefrom all oi l and gas heretofore reserved by instruments of record."
That language means that the Property was being transferred subject to the prior reservation of a
one-half interest in a ll oil and gas pursuant to the deed described in No. 1 above -this was not a
new or different reservation.
