List: Section: Section: Section: Section: File Number:Fee Paid: $ COUNTY ROAD 154 – JKS BUSINESS CENTER REZONING NARRATIVE On April 8, 2025, Code Enforcement received a complaint regarding a business where Moser’s Irrigation provides irrigation, landscaping and snow plowing services at 5052 County Road 154 (JKS Business Complex LLC) in Glenwood Springs, Garfield County, Colorado. In addition, vehicles, equipment, and snowplows are stored on the property including material that regularly stores tree branches, logs, leaves, and grass clipping in view according to the complainant that lives across the street. During the investigation, Code Enforcement found two Resolution Numbers (78-71) and (92-005) that clearly provide different information than what our current zoning map depicts. The resolutions discuss exhibits and certain parcels being rezoned from residential suburban to commercial limited where Moser’s Irrigation is being operated in the JKS Business Complex. After further research into Resolution (92-005) and the legal description of the assessor parcels involved (239501100036, 239501200141, .61 acre parcel, .48 acre parcel and .34 acre parcel), within the JKS Business Complex it was determined the area will need to be rezoned pursuant to section 4-113 (B2) in our Land Use Development Code to show the correct zone district of commercial limited as our current zoning map is inconsistent in that area. Community Development Department REZONING JUSTIFICATION REPORT The following report is provided in conjunction with the County Road 154 JKS Business Center Complex – Zoning Correction Application. The report responds to the Zoning Review Criteria in Section 4-113 (C). Responses: C.1. The proposed correction rezoning is adjacent to other commercially zoned properties, has previously been developed with commercial uses and would be consistent with orderly development patterns and does not constitute spot zoning. C.2. The area had previously changed and was approved for Rezoning to Commercial Limited in accordance with Resolution No. 92-005 of the Board of County Commissioners. It is in the public interest to properly correct the Zone District Mapping for consistency with the existing commercial uses and development. C.3. Properly documenting the previously approved Zone District for the property addresses the community need for consistency and accurate Official Zoning Mapping. The existing facilities and services on the property are consistent with the proposed rezoning. C.4. The proposed zoning is consistent with the Comprehensive Plan including the Future Land Use Map which designates the property as Mixed Use. Referral to the City of Glenwood Springs for comments will be provided consistent with the IGA between the County and Municipalities.
