The issuance of this permit does not ensure that no injury witl occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. The construction of this wett shatl be in compliance with the Water Wet[ Construction Rules 2 CCR 402-2, untess approval of a variance has been granted by the State Board of Examiners of Water We[[ Construction and Pump lnstallation Contractors in accordance with Rute 18. Approved pursuant to CRS 37-90-137(2) on the condition that this wett (ground water pond) is operated as an alternate point of diversion to the Basalt Conduit (if appticabte per decree) and in accordance with one or more of the augmentation ptans approved by the Div. 5 Water Court for the Basatt Water Conservancy District in Case Nos. 87CW01 55, 93CW0319, 98CW0026/98CW0089, 01CW0305, &. 02CW0077 (and Case No. 10CW0047 if in Area A-3 as described in decree), or operating pursuant to an approved substitute water supply ptan. lf this well is not operated in accordance with the terms of said decree(s) or SWSP, it witt be subject to administration including orders to cease diverting water. BWCD contract #863. This wett pond is known as the Reagan Pond wetl. The use of ground water from this welt pond, in addition to evaporation, is timited to recreation, fish propagation, and fire protection. The pumping rate of this wetl shall not exceed 100 GPM for fire protection. A[[ other uses are in'situ. The annual amount of groundwater to be appropriated sha[[ not exceed 0.465 acre-feet (for evaporative [oss), with a maximum surface area of 0.13 acre. The owner shatt mark the we[[ (pond) in a conspicuous location with well permit number(s), name of the aquifer, and court case number(s) as appropriate. The owner shatl take necessary means and precautions to preserve these markings. Permanent records of all diversions from the wetl pond and the surface area of ground water exposure shatl be maintained by the wett owner (recorded at least annually) and submitted to the Division Engineer upon request. Applicants shatl install and maintain at their expense necessary meters, gauges, or other measuring devices as required by the Division Engineer. lf a pump is used to divert water, a totatizing flow meter must be installed so as to measure any pumping from this we[[ pond and maintained in good working order. The boundaries of the pond shatt be located more than 600 feet from any existing well completed in the same aquifer and more than 1/4 mile from any prior geothermal operation utilizing water from the same aquifer that is not owned by the applicant, excluding wetl permit nos. 56620-F and 85208-F (spacing waivers received). This well pond shalt be constructed not more than 200 feet from the location specified on this permit. Pursuant to Rul,e 9.3.3 of the Water We[[ Construction Rules, ground water ponds and gravel pit wells are exempt from the minimum well construction and location standards except for contamination considerations as stated in the Rule. NOTE: This permit witl expire on the expiration date unless ground water has been exposed by that date and a cross-section drawing (in accordance with Rute 17.1.51must be submitted to the Division of Water Resources.
