As you are aware the RVSMD Board of Directors has discussed the recent street and uti- lity problem with both their engineering staff and legal council. Subsequent to those conversations it was discussed at the last regular meeting of the Board and the attached letter was authorized for issuance. However, prior to mailing it, 1 spoke with both you and your contractor to see if there might be some way to informally expedite a solution more to your benefit . 1 was informed by both of you that you would re- establish proper depth of the line by lowering it at your expense, if Metro would waive the normal procedures and any ongoing maintenance requirements. As a favor to you (and to avoid any delays to your development from interrupted service) I tabled the attached letter and granted the special concessions you requested. In order to further expedite matters, I personally hand - delivered it to your representative at the develop- ment site, whereupon he informed me that it had been decided not to fulfil your verbal commitments and that no alternative proposal or remedial action would be provided. Subsequent conversations with yourself and a second gentlemen (I presume Mr. Hardrick) indicated the following: 1. Any action taken by you would be charged to Metro. 2. Regardless of concessions or assistance from Metro, you would proceed with some sort of legal action. 3. A strong desire that the entire matter be handled in a totally formal manner complete with all the applicable procedures requirements reviews, plans, specifications, approvals, etc., etc. After over an hour of discussions, it became obvious that a quick informal solution was no longer your intent, and 1 was left no alternative but to withdraw our concessions and authorization. Therefore, you are hereby notified that, due to circumstances beyond our control, water service will be interrupted and the lines drained on Remington between Colt and Browning in the Rifle Village South Subdivision, Garfield County, Co. This interruption is imperative to the protection of the health and well -being of the residents of the district and will not effect any residences currently occupied or approved for occupancy. It is anticipated that service will be resumed upon completion of any one of the following: r Mr. and Mrs. 1- lardrick Page Two 1. Metro's completion of the road to the specifications of the county and the approval of all concerned (i.e., Metro State Health, West Divide, all residents on both sides of Remington, Planning Commission, County Road Dept., County Commissioners, L.P.A., grant prioritization committee, Joint Budget Committee allocation of funds, Governor's appropriation, etc.) Metro will commence a tentative preliminary feasibility study immediately to see if this is advisable, if so our engineer's preliminary plans should be ready to begin reviews for approval by early spring. Completion may be anticipated as early as early '82, unless one or more permits, approvals or state funding requests are not forthcoming in the course of the formal procedure, in which case it would be necessary to wait for the completion of some other solution acceptable to all. 2. Completion of the Court's recommended solution obtained after a full investi- gation and documentation as to permit compliance, damage of utilities, owner- ship of the road, etc.:' and the final determination of the courts (after all appeals) as to who should implement such recommendations. Given today's court calendars and formal legal procedure and estimated date for such completion is impossible to state. Metro has commenced investigation procedure already and legal action is pending. 3. The completion of the road to county specs. and acceptance by the county. Such work having received the prior approval of all concerned (See Item 1) and having been implemented by a formally established street improvement district. Completion could be as early as early '82. 4. Completion of some other mutually acceptable alternative solution. Persons on wishing to pursue a more expedient specific alternative should submit a formal written proposal to Metro, outlining in detail the various procedural and physical steps involved, including funding responsibility, construction responsibility, maintenance requirements, plans and agreements, specs, com- pletion date, etc. Any and all such proposals will be received by the Metro staff and considered by the board at the earliest possible date. Submit to Lamont Kinkade, 105 Canary Ct., Grand Junction, CO 81503. It is estimated that a less formal alternative volunterred under these guidelines could be completed long before other more formal solutions could even get seriously underway. We would greatly appreciate your cooperation in expediting one of the above alternatives in order to end the interruption of service as soon as possible. Toward that end, please advise as to your preference or any quicker alternative you might want to submit as out- lined in Items 4. 'CE1� September 3, 1980 • Mr: and Mrs. Hardrick • Recent maintenance work on Rifle Village South Metropolitan District water facilities have revealed that, subsequent to the installation and certification of water lines in the west end of Remington Ave., the maximum elevation of the street was summarily lowered. This was presumably done to increase the value And utility of the sites to the north which were originally much lower than the natural elevation of the road. In doing so, the minimum cover required to protect the `' water lines from freezing was removed. Naturally, we cannot endanger the entire water system by allowing water to freeze and break that unused portion of line. The obvious and easiest solution is simply to drain the line until someone steps forward and accepts responsibility for the damage and arranges to rectify the situation in an acceptable fashion. Since it is currently unclear who has the authority or responsibility . for construction or maintenance of such streets, we have attempted to determine how such road construction was approved and by whom. It was our hope that this information would help determine who should ' or could be expected to repair the damage in time to allow use of the line this winter. Our inquiries have yielded the following information: 1. The subdivision as approved contains no specs for road grades or elevations. 2. Construction permits are required by Garfield County for the building or relocating of streets and roads in Gar- • field County. However, no such permit was ever requested or granted. (Permits are required to Avoid situations like this.) 3. The street in question was dedicated to the public use (whoever that is) but will only be accepted by the county when it meets their standards. One of which is that it not endanger public utilities. Mr. and Mrs. Hardrick -2- September 3, 1980 4. Utilities currently using this "dedicated land" were never informed of any major change in elevation or subse- quent endangerment of utilities as required by law. 5. It appears that a street improvement district is anticipated to again change the elevation, and hopefully take whatever remedial actions are necessary to make the road acceptable to the county and the utilities involved. 6. While the Metro district is willing to cooperate in the raising and /or lowering of manhole covers and meter pit lids to whatever elevation is ultimately agreed upon, we cannot and will not suffer the expense of relocating an entire utility line every time someone decides to improve their land by summarily bulldozing a road away. In view of the above, it appears that the most acceptable solution • is to expedite the formation of the street improvement district so that Metro will have someone with whom to cooperate in determining what the future "approved" street elevation should be. Hopefully, adequate remedial action will be completed prior to the first' freeze. Toward this end, I would appreciate any information you could supply on the improvement district's intentions and when I might be able to review their proposal for street improvements in this area.
