Mr. Reiger pointed out a high concentration of fiberglass insulation particles in the inside air. Indoor air quality is not yet regulated under the Uniform Building Code, however UCADB Section 302 (15) may allow a building or structure used for dwelling purposes to be declared unsafe due to air quality, if a "health officer" determines the condition is likely to cause sickness or disease. Mr. Reiger mentioned health problems possibly resulting from the fiberglass inhalation, and that he has had air samples analyzed, but he did not say what, if any, health risks had been declared. While examining the attic furnace installation, I noticed that the unit was labeled for installation on a noncombustible floor or approved protection shield, but was installed on an unprotected plywood platform. In addition, one side of the furnace lacked the required 7 inch clearance to combustibles. With the approach of the heating season, and because Mr. Reiger mentioned that the furnace seems to run continuously, this condition appears to be a fire hazard. UCADB Section 302 (16) deems a building dangerous because of faulty heating apparatus which creates a fire hazard, as determined by the fire marshal. In summary, it is my opinion that sufficient conditions and defects exist at the subject property to declare the structures "dangerous buildings" under the provisions of Section 302 of the UCADB. Once a building has been so classified, the abatement process shall be initiated as required by UCADB Section 401 (a). Due to the nature of the dangerous conditions, I recommend that it would be reasonable to prohibit occupancy of the unoccupied guest house until the hazards have been abated. A reasonable time for the abatement of the hazards of the main house is not so cut and dried. Consideration must be given to the severe influences of winter on the described conditions and the increasing probability of risk to the occupants and property into the winter season.
