Lindauer and Joyce Risley have petitioned The Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. 106- 2- 33(3)(d) (1963 as amended) for the division of a 17 -acre tract from a larger tract more particularly described as follows: See Exhibit A attached hereto WHEREAS, The Petitioners have shown to the satisfaction of The Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of single - family residential use and other uses as allowed by the applicable zoning, and WHEREAS, Petitioners have demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on said 17 -acre tract, that there is adequate ingress and egress to said tract, that the location of spetic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield and that the said division will actually restrict the density of housing within said area and should therefore be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 106- 2- 33(3)(d) (1963 as amended); NOW, THEREFORE upon motio n of :.
