GARFIELD COUNTY BOARD OF ADJUSTMENT Meeting #80 March 31, 1977 Members Present County Officials Present Dave Stacey, Chairman W. C. Milner, Building Darlene Dodo, Secretary Official Ed Wilson Ed Feld, Sanitarian John Tripp Kay Johnson, Recording Joe Dice Secretary Laverne Starbuck Carter Jackson Pete Cabrinha Mary Odell Citizens Present Al Stark Mr. and Mrs. Griffin Dave Ostermann The meeting was called to order at 3:30 P.M. by Dave Stacey, Chairman. MOTION: made by Joe Dice and seconded by Darlene Dodo to approve the minutes of Meeting #79 as written. Board Vote: For: Dave Stacey, Darlene Dodo, Joe Dice, John Tripp Against: None The first application to be heard was that of Mr. Al Stark. Submitted and made a part of the record was an application with attached drawing of property, receipts from registered mailings, the fee of $25.00. The proof of publication was not submitted at the time of the hearing but was received on April 1, 1977. Mr. Stark brought a site plan of the new building and explained to the Board that he is requesting a 15.5 foot setback variance on the west side and a 20 foot setback variance on the east side of the property. The required setback is 50 feet. He stated that this building would have a minimal amount of parked cars. If there would be vehicles there, they wouldn't be parked for long periods of tine. Mr. Stacey then suggested if they should require parallel parking if the parking was going to be a hazard. Mr. Stark then added that the building will have roll up doors on each end. Page 2 Bud Milner stated that this type of use is a good one for this property. He stated also that there would be ample room for parking. Mr. Ed Feld asked if they were going to require a sewer system. Mr. Stark answered no. The building would only be used for storage. Mr. Pete Cabrinha asked if there would be any offices in the building. Mr. Stark said no that each person would have a key to the storage compartments. Dave Stacey then asked the Board for their thoughts. Carter Jackson saw no problem with it and stated that this was a good use of the land. John Tripp asked Bud Milner if there is a requirement for parking and Mr. Milner said no. Joe Dice then inquired if it was possible to require parking. Mr. Milner stated that you could put that restriction on the variance. MOTION: made by Carter Jackson and seconded .by John Tripp to approve the request with the stipulation that only parallel parking be permitted in the 15 foot frontage zone. Board Vote: For: Dave Stacey, Darlene Dodo, Joe Dice, John Tripp, Ed Wilson Against: None The second application to be heard was that of Mr. David Griffin. Submitted and made a part of the record was an application with attached drawing of property, receipts from registered mailings, the fee of $25.00, and the proof of publication. Mr. Griffin advised the Board that in March or April of 1968 he put in two trailers for his ranch. One of the trailers has been there since that time. The other site has had no trailer there for over six months which as a result of the Zoning Resolution, prohibits the placement of another trailer at that property site. If Mr. Griffin would have kept a mobile home there since 1968 he would have had a non - conforming use and would be allowed to continue that use. Mr. Milner stated that this procedure before the Board of Adjustment is the only way he can obtain approval to place a mobile home back on that property. But Mr. Milner stated to the Board that they must find a hardship as a result of zoning. Carter Jackson inquired about the right to place a mobile home for the purpose of an accessory use to a working farm or ranch operation. Mr. Milner stated that you could only have one trailer on the ranch and he already has one there. Then Mr. Milner read the term "abandonment" from the Zoning Resolution to the Board of Adjustment. • Page 3 Section 5.07 of the Zoning Resolution entitled "Abandonment" reads as follows: Whenever non - conforming use of a building or land has been discontinued for a period of six (6) months, future use of the land or building shall be in conformity with provisions of this resolution. Mr. Stacey then asked Mr. Feld about the sewer system. Mr. Feld stated that there were water table problems in the area. He then read from the Garfield County Individual Sewage Disposal Systems Regulations, Section 3.23 (C) - General Prohibitions - which reads as follows: No individual sewage disposal system presently in use which does not comply with the provisions of this regulation regarding minimum separation between the maximum seasonal level of the groundwater table and the bottom of an absorption system, shall be permitted to remain in use without compliance with this resolution later than October 1, 1975. Mr. Feld stated that Mr. Griffin's property has a system that constitutes an illegal system because of its cesspool status. Mr. Griffin stated that if it was going to cost a lot he wouldn't want to put another mobile home there because he would not fix the system. Mr. Dave Ostermann then stated that he was in favor of this variance. He said that the person that wanted to place a mobile home on the property was employed by him and couldn't find a place to live. Mr. Stacey then asked Mr. Milner to advise the Board about the courts reversing some of the decisions of other Boards. Mr. Milner stated that each month in the Zoning Bulletin there are court reversals and stated to the Board that they must find a hardship created by zoning. Then Mr. Stacey asked the Board for their opinions on this variance. Mr. Joe Dice stated that he thinks people with private land should be able to do what they want with their land within reason. He agreed that it was hard to find housing around here. And that most people can afford to live in a trailer. He stated that he was not in favor of a lot of trailers but didn't know where to draw the line. He stated that the rules and regulations should be guidelines to follow. Mr. Dice stated that he was in favor of approving the variance request with some conditional use regarding sewage. a Page 4 Mr. Ed Wilson stated that if there had not been two trailers there before he would be against approving this request, but was concerned about the sewer problem. Carter Jackson stated that the point of hardship was that there had been two trailers prior to zoning. If a trailer had not been there previously he would be opposed to it. He stated that you have to hold to the values not to be parking trailers all over the valley. Pete Cabrinha stated that he would be in favor of this variance if the sewage system would be upgraded. Darlene Dodo agreed with Joe Dice. John Tripp was in favor of the variance as long as the sewage system was taken care of properly. Laverne Starbuck was concerned about where the trash was put and if there was any storage area so that it wouldn't be all over the property. Mr. Griffin stated that there was a lot of storage area. Ms. Starbuck was in favor of this variance only on a temporary basis. Mary Odell asked Mr. Griffin a few questions regarding his sketch map. She was concerned if there was enough water available for two trailers and Mr. Griffin said there was. She was in favor of the variance on a temporary basis. Mr. Stacey stated that they should look at what the law says and they are hot guidelines and stated that he was abstaining from voting on this particular variance application. MOTION: made by Joe Dice and seconded by Darlene Dodo to grant a variance to place a mobile hone provided that both trailers comply with the Garfield County Individual Sewage Disposal Systems Regulations.
