'CONDITIONS:
1. All installation must comply with all requirements of the County Individual Sewage Disposal Regulations, adopted pursuant to au-
thority granted in 66-44-4, CRS 1963, amended 66-3-14, CRS 1963.
2. This permit is valid only for connection to structures which have fully complied with County zoning and building requirements.
Connection to or use with any dwelling or structures not approved by the Building and Zoning office shall automatically be a viola-
tion of a requirement of the permit and cause for both legal action and revocation of the permit.
3. Section III, 3.24 requires any person who constructs, alters, or installs an individual sewage disposal system in a manner which in.
volves a knowing and material variation from the terms or specifications contained in the application of permit commits a Class I,
Petty Offense ($500.00 fine — 6 months in jail or both).

NARRATIVE:
On Tuesday August 31, 1982, Terry Howard, County Sanitarian, and I investigated some com-
plaints on individual sewage disposal systems in and around Silt. Carl Pitts and Ms.
Lyle Clauson had both called about improper or failing systems around them in the west
end of Silt.
Mr. Pitts showed us where Ms. Elizabeth Terrells(32677 Hwy 6 & 24, Silt CO 81652) leach
field was surfacing in a draw below a pond and park he had just built in a new subdivision.
We could not find Ms. Terrell at home but plan to talk with her at a future time. We
were told by Mr. Pitts and Ms. Clauson that Ms. Terrell was very reasonable and would
surely correct her problem with no trouble.
Mr. Pitts then explained that Wren McGruder had a house and a store on half a block just
east of his subdivision. The half block had not been annexed and the buildings were
each served by a holding tank. Mr. Pitts alledged that the holding tanks were being
pumped out onto a field adjacent to the half block causing odors and a nuisance. Terry
and I stopped at the house and found that it was now owned by Mr. McGruder's daughter,
Janet Barks. We explained to her that the holding tank was to be properly pumped and
hauled by a licensed septic tank hauler in the future. A letter is being sent out to
that effect. She explained that she was now trying to annex to the Town and put in a
sewer. She would however, have to get the money saved. She estimated between four and
five thousand dollars. We did not contact Mr. McGruder about the store, but heard he
had no plans to annex because of the taxes.
We also talked to Dave Weitzel, Town Manager, as he wanted to keep track of the situation.

Re: Use of Holding Tank for Sewage Disposal, Garfield County
Dear Ms. Barks:
On August 31, 1982, Terry Howard, County Sanitarian, and I spoke to you at
your residence in regard to the holding tank at your residence. We were in
the area investigating complaints of strong sewer odors in the vicinity.
Neighbors had made allegations that the contents of your holding tank had been
improperly disposed of in the past.
As you understood, the holding tank at your residence was allowed as a tem-
porary solution for wastewater disposal. You stated that you had begun inves-
tigating the requirements of annexing to the Town and connecting to the cental
system. This process needs to be completed as soon as feasible.
In the meantime, the holding tank when full must be pumped by a licensed septic
tank pumper and disposed of in the Town wastewater system. Please save all
bills from this service so that future question on proper disposal of the
holding tank contents can be answered.

Dear Mrs. Terrell:
As you recall, we put some dye into your septic system to
determine if it is affecting Mr. Pitt's pond. Apparently
the system does not seep into the pond, but it does appear
to seep from the bank beside the ponds near Highway 6 & 24.
This situation needs to be corrected.
Please contact this office so that we can discuss the simplest
methods of correction.

On October 20, 19B2, Ed Feld, County Sanitarian, Dick,Bowman, 4
and I stopped in West Silt to talk with Lyle Clauson about con-
tinued complaints of sewer odors in the area. I had previously
visited with Mrs. Clauson on August 31, 1902, along with Terry
Howard, then County Sanitarian. During this visit we investi-
gated rumors that an old holding tank in the alley below Mrs.
Clauson's property had not been taken out of service and back -
filled as was required during construction of a sewer line
through the alley. Mrs. Clauson's son indicated that a neigh-
bor had checked and found that the inlet port to the septic
tank was still visible in the alley but he could not tell
whether any water was in the tank.
I found the inspection hole in the alley and could see water in
the tank and see that the tank was at this time almost full
with water. The developer, Carl Pitts, had had a contractor
put in sewer lines for development that he had annexed into the
City adjacent to Mrs. Clauson and other people's property. We
learned that Mr. Pitts has a law suit against the constractor
for several deficiencies in constructing the system. We need
to make sure that if Carl Pitts does not win his suit, that we
take action to have the septic tank removed from the alley and
insure that the sewer line is indeed extended through the area
of the septic tank and tied into the City sewer.

ACTIVITY REPORT
On Wednesday, May 11, 1983, Ms. Lyle Clauson called from the Town of Silt to
again complain about septic odors in her neighborhood. A holding tank at a
house owned by Janet Banks was alleged to have been pumped onto a field
adjacent to the subdivision. Pumping of this nature has occurred in the past
and Ms. Banks has been sent letters stating that this practice is illegal.
Ms. Clauson had also called Ed Feld, Garfield County Sanitarian. I plan to
let the County followup on the matter and only assist if requested. Ed has
discussed annexation to the Town of Silt with Ms. Banks in the past.

Dear Ms. Barks:
On September 10, 1982, you received a letter from Mr. John Blair,
District Engineer for the Water Quality Control Commission,
Colorado Department of Health. The letter outlined the temporary
use of a holding tank until central sewage service became available.
Recently, this office has received complaints regarding odors
eminating from sewage being pumped from the holding tank unto your
property. Needless to say, this is not an acceptable practice and
contradicts the understanding with both this office and the Colorado
Department of Health.
I recently had a nice visit with your Father and he expressed to me
that both of you would like to alleviate the nuisance of the situation
by connecting to the now available Silt sewer system. As you know, this
would require annexation to Silt and it is my understanding you have
inquired about the costs and procedures.
I also spoke to the Mayor and City Clerk of Silt and they would accept
your annexation. I strongly suggest you contact them again and discuss
annexation or a pre annexation agreement. I believe the city would be
receptive to an understanding regarding your Father keeping his animals
for a specified time period.
As a suggestion, you might request a payment schedule to ease the
financial burden of annexing.
I would very much like to avoid formal legal procedures to correct the
problems, as I believe you sincerely would like to connect to the city
and be rid of the holding tank and the limitations it presents.
I am requesting that you notify me within ten (10) days of receipt of
this letter to let me know what you have done to alleviate the situation.
I would be happy to meet with you, your Father and the city people to
discuss what can be done and when.
