The dwelling was originally the parsonage for the adjoining Baptist Church facility. As a result of a housing complaint, I had the occasion to visit the property. In addition to what turned out to be an individual sewage disposal system problem, I was made aware the dwelling no longer is a single family dwell- ing, but rather a duplex or triplex. As yet, I haven't been able to contact the property manager to find out for sure exactly how many apartments and people reside in the building. I discussed with Bill Thompson what very possibly may be a life - safety problem as the result of an unpermitted remodel of the building. As an example, the basement apartment had only one exit, one small window not large enough to exit through and the stairway was closed. As we discussed, the zoning may be in question. Also, there may have been an illegal subdivision (lot split), depending on the original church property approvals. I'll let you and Bill know when I receive more information. The apartment became unlivable by all environmental health standards as of February 10, 1984. The sewer system malfunctioned at that time and the manager, Jim Barnett was notified. Today, five days later, NOTHING has been done to rectify this awful situation. Raw sewage is . backed up in our bathroom half - filling our tub and commode. Aside from this, we signed a lease that was to include all utilities and we have gone a total of nine days without heat since we first moved in October 27th, 1984. Some of those days with- out heat were recorded temperatures of 13 -15 degrees below zero, farenheit. We are hereby giving notice that due to the condition existing at this apartment, we will not be returning to the apartment. We will expect a refund according to the following: Refund of rent due from February 10 - 29, 1984 (20 days x $9.48 /day) $189.60 Security Deposit 100.00 $289.60 If we do not receive payment by return mail we will go next to the Building and Sanitation Department of Garfield County to determine if, in fact, you are in conformance with zoning regulations in the rental of this property. I discussed the overall situation with the property manager, Jim Barnett, and he stated the house had been converted to a duplex. He did not know any details regarding lot splits (if any) or building conversion approvals. It is beginning to appear the above practice is gaining popularity in the neighborhood. Next to the above referred house is the Baptist Church. Word is filtering in that a family is living in the basement, possibly the pastor and his family. A wood burning stove pipe now is attached to the side of the church from the basement to the roof. Next to the church is the recently constructed single family dwelling which Portia Carlson moved onto a foundation. This, too, is now believed to be a duplex. Bill Thompson wanted me to let you know that he and Ron Leach, the Carbondale Fire District Chief, will visit and inspect the dwellings for fire and building code violations. Bill or I will keep you informed. That inspection revealed a sewage backup on the ground floor of the building as a result of the septic system malfunctioning.
