Dear Jim:
As president of Oak Meadows Water Association ( "OMWA" or
"Filing 2 "), express our board's deep concerns over the construction of
a new septic system near our water source.
You and 1 discussed this issue on June 23 and again today. Oak
Meadows Filing 2 draws most of its water from the Oak Meadows Spring
#1, located near the southeast corner of NE /4 Sec. 21- T78 -R89W. This
spring was developed in 1970, along with a spring house and storage
tank, at the end of county maintenance on Sun King Drive. In 1976,
Sun King was extended, and the road and utilities excavation reportedly
damaged the spring's sand and clay layers. To remedy this damage and
improve spring output in this dry year, Filing 2 is evaluating intercepting
the spring water south of Sun Ring Drive, just above the dumpster.
Construction has started on a new house on the lot above this
spring system (Lot 40, Filing 3, Block 3, Mr. O. Dujka). OMWA is
concerned that the development of a septic system on this lot will
seriously endanger the quality of Oak Meadows Spring #1. A new septic
system would be too close to our drinking water source, especially if the
collection system is extended. As you stated, the Colorado statute
requires 100' separation from septics to sources. The proposed leach
field is about 150', but that is uncomfortably close for safe water.
OMWA cannot preclude building on this lot, but we insist that
Filing 2 be included in the planning process for any proposed septic
system. Please inform me at 945 -1083 as, to our next step.

Dear Jim:
Duane Neuman has requested clarification of a lot purchased from
Mrs. Edith Hornik in Filing III of Oak Meadows.
Howard Motz, the original developer of Oak Meadows, sold the four lots to
the Horniks with water taps. Restone purchased the area from Motz. When
Redstone created the Association, the Hornik proprties were excluded.
Therefore those four lots, at least currently, are not subject to any
association covenants or restrictions.
The Association wishes to thank you for your attention.
