Dear Jim,
I'm writing to notify you of our situation as per our phone con -
verstion this morning.
We had some tenants remove their trailer from our property on
August 31, 1991. It was re- rented by another party on September 1,
1991. This tenant never occupied the space and only paid rent for
one month. The case went into litigation and was heard in January
of 1992.
We -have been placing adds to attempt finding a suitable tenant for
the space since October 1, 1991. But, the winter months are
not a desirable time for mobile home owners to transport their
units.
Today we had someone, by the name of Robert R. Peters, pay his
full deposit to hold the space so he could move his trailer
onto it by March 15, 1992.
We hope you will consider the circumstances involved so that
we may protect our non - conformity status. To lose it would have
a detrimental financial effect on us. If by any chance occupancy
of the space, by Mr. Peters, does not occur we will need some
time to purchase a mobile home ourselves to occupy the space

This security deposit is received for application, at landlord's option, to any
rent arrearages, late rent penalty fees, all court costs, attorney fees and
expenses incurred by landlord resulting from suit for payment or posession,
unpaid utility charges, or to the repair of any damages to the rented premises,
normal wear and tear excepted; and the landlord shall retain the right to
inspect the premises for damages at reasonable times and upon reasonable
notice. It is understood and agreed that, in the event any portion of said
security deposit is applied for any of the pruposes listed, the tenant shall,
upon five (5) days notice, reimburse the landlord for the amounts so expended
so that the original amount shall remain on deposit, and upon the tenant's
failure to comply with this provision, his /her tenancy shall immediately
terminate and tenant shall vacate the premises. This security deposit shall not
be construed as being held in trust for tenant and landlord may commingle
said deposit with funds of Lessor. Upon termination of tenancy, the portion
of the security deposit not to be retained for purposes mentioned, shall be
returned to tenant, pursuant to 1973, C.R.S. 38 -12 -103 as amended.
