Subject: Pre -Final walk through to determine items to be complied with for Final inspection
approval and issuance of a Certificate of Occupancy for the property addressed
above.
Dear Mr. Gallicchio:
Thank you for meeting with me this morning for a pre -final walk through of your home. The
items that I would like to bring to your attention for correction in order for approval of the final
inspection are as follows:
1. The main entry stair has no handrail. U.B.C. (Uniform Building Code) Section 3306 0)
requires a stairway having four or more risers to have a handrail on at least one side. The handrail
shall be placed not less than 34 inches more than 38 inches above the nosing of the tread. The
handgrip portion shall be not less than 1 1/2 inches nor more than 2 inches in cross - section
dimension or the shape shall provide an equivalent gripping surface.
2. The guardrail's on the upper deck have a corner detail that will permit the passing of a 6 inch
sphere. U.B.C. Section 1711 requires that open guardrail's have intermediate rails or an
ornamental pattern such that a sphere 6 inches in diameter cannot pass through.
3. The Basement has no operable window or door that may be approved for emergency escape or
rescue. U.B.C. Section 1204 requires that basements have such a door or window. If a window,
it must have a minimum net dear openable area of 5.7 sq. ft. The minimum net clear height shall
be 24 inches and the minimum net clear width shall be 20 inches. If a door and stair is provided
the requirements of Chapter 33 are to be met.
4. The two small windows in the basement do not appear to provide the light and ventilation
required for the habitable space (the rec. room and the office) in the basement. U.B.C. Section
1205 requires habitable rooms to have natural light rough opening equal to one tenth of the floor
area. Ventilation is required by openings equal to one twentieth of the floor area. However,
ventilation may be supplemented or provided by mechanical means. The opening between the
accessory room to the main room in the basement does not provide a minimum of 25 sq. ft. or one
tenth of the sq. ft. of the room, which ever is greater.
5. The door at the North end of the pool area opens over a stair. This does not comply with
U.B.C. Section 3304 (i) Floor Levels at Doors. A floor or landing is required on each side of
this door or the door may open in the other direction.
6. A handrail is to be provided on one side of all stairways as indicated in item no. 1. above.

7. A smoke detector has not been located in the proximity of the main stair on the upper level as
required under U.B. C. Section 1210 (a) 4.
8. The main solid fuel fireplace in the living room has a natural gas pipe stubbed into the fire box.
The Gas pipe must have an accessible shut off within 4 feet of the fireplace and installed as
required under U.M.C. (Uniform Mechanical Code) Sections 503 (c) and 803. The damper must
be removed from the fireplace. Any gas burning appliance installed within the fireplace shall be
listed for such installation.
9. The decorative gas appliance being installed in the Master Bedroom must be verified to be
listed for installation in a sleeping room and the installation shall be in compliance with such
listing. The installation shall also comply with U.M.C. Section 504.
10. The kitchen is to be completed with hot and cold running water and a sink and cooking
appliance connected and operational.
11. The home is to have at least one complete bathroom with hot and cold running water, shower
or tub and water closet.
12. The brick veneer on the North East comer of the house is not adequately supported by the
foundation wall. A means of securing and supporting the veneer is to be applied in compliance
with U.B.C. Section 3306 (b).
13. The final site grading to carry water away from the foundation should be completed prior to
this coming winter. This grading should also provide that the height of on grade decks or patio
slabs does not exceed 30 inches vertically measured at a distance of 5 feet horizontally from the
walking surface of the deck or patio.
I understand that many of the sections referenced in this letter are not familiar to you or complete
in explaining what is required however, the subcontractors responsible for the work described
should have access to the code. If you have any questions please give me a call and I will be

BECAUSE OF PRACTICAL REASONS THE EXTERIOR WINDOWS NOW IN PLACE
WILL NOT BE REQUIRED TO BE REPLACED,

VALVE IS NOW LOCATED IN ALCOVE NEXT TO FIREPLACE WITHIN 4 FEET. THE

listed for installation in a sleeping room and the installation shall be in compliance with such
listing. The installation shall also comply with U.M.C. Section 504.
REMAINS TO BE VERIFIED THAT APPLIANCE IS CORRECT FOR THIS
INSTALLATION AND THE INSTALLATION IS SUBJECT TO A FINAL APPROVAL.

A CONCRETE SLAB DOWELED INTO THE EXISTING FOUNDATION TO SUPPORT
THE VENEER WILL BE INSTALLED WITHIN 30 DAYS OF THE FINAL INSPECTION.
13. The final site grading to carry water away from the foundation should be completed prior to
this coming winter. This grading should also provide that the height of on grade decks or patio
slabs does not exceed 30 inches vertically measured at a distance of 5 feet horizontally from the

AGREEMENT REGARDING CERTIFICATE OF OCCUPANCY
WHEREAS, Mr. Florent Gallicchio, (hereinafter "Owner") has applied for
a Certificate of Occupancy for a house located 37053 Highway 6 &24 near
New Castle, Garfield County, Colorado and,
WHEREAS, the following items have been determined to be apparent
defects or deficiencies with the application which prohibits the issuance of
a Certificate of Occupancy until they have been resolved pursuant to codes
adopted by Garfield County and approved by the Garfield County Chief
Building Official:
1. The habitable areas in the basement identified as the recreation room
and office do not have adequate ventilation as required under U.B.C.
(Uniform Building Code) Section 1205.
2. The door at the North end of the pool area swings over a landing and
is not in compliance with U.B.C. Section 3304 (i) 1. B.
3. The solid fuel fire place in the living room has been fitted with a
natural gas outlet for a log lighter or decorative gas log. The damper
is presently configured to close tightly.
4. The decorative natural gas appliance in the Master bedroom has not
been verified to be listed for such installation and the installation is
not complete.
5. The brick veneer on the North East corner is not adequately
supported.
and,
WHEREAS, the Owner is willing to make certain assurances and
agreements relating to these identified code deficiencies and on the basis of
such assurances the County is willing to issue a Certificate of Occupancy.
NOW, THEREFORE, it is agreed as follows:
A. The Owner agrees to do the following:

Deficiency No. 1.
ACTION REQUIRED OF THE OWNER:
A mechanical ventilation system approved by the building official will
be installed in this recreation room and office area.
Deficiency No. 2.
A landing and step is to be constructed and approved by the building
official on the south side of the door or the door is to be swung in the
other direction and not over the landing or step.
Deficiency No. 3.
The fireplace damper is to be removed or substantially removed to
prevent closure of the vent and to permit unburned natural gas to be
vented to the outside.
Deficiency No 4.
Information from the manufactured is to be provided indicating that
the appliance is listed and installed in accordance with the listing and
manufacturers installation instructions.
Deficiency No. 5.
An approved method of supporting the brick veneer is to be installed
or caused to be installed by owner.
FURTHER ACTION REQUIRED OF THE OWNER:
The owner will not or will not permit the use of the fireplace in the
living room or the decorative natural gas appliance in the master
bedroom until correction and verification of correct installation has
been confirmed by the building department.
The Owner will complete all work described herein and request
inspection of all work by the Garfield County Building Department.
All work shall be completed in compliance with the stated provisions
of the codes currently adopted by Garfield County in a manner that
will enable approval of all work. All work, inspections and approval of
work shall be completed within thirty (30) days of the date of signing

of this document.
B. In the event the Owner fails to perform as agreed on any of the
above, the County may revoke any permits which may have been
granted to the Owner. The County may require the habitation and
occupancy of the house cease immediately.
C. This agreement is binding upon the heirs, successors in title, and
assigns of the parties.
