RE: Bridge over Fourmile Creek
Dear Mr. Mezei:
This letter is to document our field investigation conducted on February 5th at the location
of the proposed bridge across Fourmile Creek in Garfield County. Our determination was
that the construction of the proposed bridge will not require a Section 404 Permit if there
will be no fill material placed within the stream channel below the ordinary high water
level of the stream. It is also my understanding that construction of a roadway west of the
bridge may require a Section 404 Permit due to wetland impacts, and there is no guarantee
that such a Permit will be issued in the future. Potential wetland impacts cannot be
determined at this time due to snow cover.
By copy of this letter, we are notifying the construction Contractor that no fill material,
including temporary fill, may be placed within the channel of Fourmile Creek below the
ordinary high water mark. In addition, we are notifying the Contractor and the Owner that
future roadway construction west of the bridge may require a Section 404 Permit, and that
there is no guarantee that the Corps of Engineers will issue a 404 Permit in the future.

RE: Williams Bridge
Dear Mark:
Enclosed are preliminary drawings for the Williams' Bridge to be constructed across
Fourmile Creek above the Black Diamond Mine Road. As we discussed, the bridge
was located so that the abutments did not encroach into the flood fringe. The site
has been reviewed by the Corp. of Engineers and it was determined that this phase
of the project will not require a 404 Permit.
If you would like additional supporting information, please feel free to give me a
call. Barring unforeseen complications, Mr. Neuman intends on starting
construction of the abutments the week of February 15th. Thank you for your help
in the project.
