Dear Art,
A review of the architecturally designed plans, filed with the referenced
building permit application, for conformance to UBC requirements and
local amendments thereto, is complete to a level customary for the trade.
Permit approval allows the construction of a new single family dwelling
described as:
Basement- Built -in 2- car Garage, Mechanical /Storage, Unfinished area
Main Level- Living Room, Dining Room, Kitchen, Laundry, 2 BRs, 1 full
Bath
Upper Level- MBR w/ private MBath, Loft area

Except for the following, and the "red- lined" references to your
departmental plan review checklist noted on the plans, which are expected
to be field enforced, the design reasonably conforms to minimum
requirements of the UBC:

1. The basement area designated as "Media /Den" has no windows to
conform with UBC Sec. 1205 (c). This area is initially intended to be
"unfinished ", however an informational note was "red- lined" on the plans.
2. Log diameters were not specified on the plans. According to the
Architect, the logs range from 12" diameter to 16" diameter, with no log
less than 12" diameter. The log spans in this design were evaluated by
conventional log industry standards and found to be adequate. Established
log industry standards were not applied beyond simple span analysis. Any
standards applicable to log homes are typically a matter for local policy.
Approval of the plans is recommended and, upon verification of compliance
with local regulations outside the scope of the UBC, issuance of the
building permit. If there are any questions regarding this "approval ",

AGREEMENT REGARDING CERTIFICATE OF OCCUPANCY
WHEREAS, Frank and Mary Cesark, (hereinafter "Owner ") have applied
for a Certificate of Occupancy for a house located on lot 35 of Canyon Creek
Estates, Garfield County, Colorado and,
WHEREAS, the following items have been determined to be apparent
defects or deficiencies with the application which prohibits the issuance of
a Certificate of Occupancy until they have been resolved pursuant to codes
adopted by Garfield County and approved by the Garfield County Chief
Building Official:
1. Hand rails have not been installed on the exterior front and back
stairs or on the stairs from the garage into the house as required
under U.B.C. (Uniform Building Code) Section 3306 (a) and (i).
2. The door between the garage and the house is not self closing as
required under U.B.C. Section 503 (d), Exception 3.
3. The garage side of the required occupancy separation wall has been
penetrated with an air duct opening into the garage in violation of
U.B.C. Section 503 (d), Exception 3.
4. The stair from the first story to the second story does not have a
guardrail as required under U.B.C. Section 3306 (k), referencing
Section 1711• Section 1711 has language stating, "Open guardrails
shall have intermediate rails or an ornamental pattern such that a
sphere 6 inches in diameter cannot pass through."
5. The fireplace has been fitted with a natural gas outlet for a log lighter
or decorative natural gas log. The damper closes in a manner that will
not permit the escape of unburned natural gas to the exterior.
and,
WHEREAS, the Owner is willing to make certain assurances and
agreements relating to these identified code deficiencies and on the basis of
such assurances the County is willing to issue a Certificate of Occupancy.

NOW, THEREFORE, it is agreed as follows:
A. The Owner agrees to do the following:
Deficiency No. 1.
ACTION REQUIRED OF THE OWNER:
Provide handrails for these stairways that comply with U.B.C. Section
3306 (a) and (i).
Deficiency No. 2.
ACTION REQUIRED OF THE OWNER:
Provide an approved means for closing the door between the garage
and the house.
Deficiency No. 3.
ACTION REQUIRED OF THE OWNER:
Install or cause an approved fire damper to be installed at the point of
penetration in the garage side of the occupancy separation wall.
Deficiency No. 4
ACTION REQUIRED OF THE OWNER:
Install or cause to be installed an approved guardrail on the stair that
will not permit the passing of a 6 inch sphere.
Deficiency No 5.
ACTION REQUIRED OF THE OWNER:
Remove or cause the fireplace damper to be removed or substantially
removed to prevent closure of the vent and to permit unburned
natural gas to be vented to the outside.
FURTHER ACTION REQUIRED OF THE OWNER:
The owner will not or will not permit the installation of a natural

gas log lighter or gas log until correction and verification of
correct installation has been confirmed by the building
department.
The owner will take precautions in the use of the stairways to prevent
injury to themselves or others.
The Owner will complete all work described herein and request
inspection of all work by the Garfield County Building Department.
All work shall be completed in compliance with the stated provisions
of the codes currently adopted by Garfield County in a manner that
will enable approval of all work. All work, inspections and approval of
work shall be completed within Thirty (30) days of the date of signing
of this document.
B. In the event the Owner fails to perform as agreed on any of the
above, the County may revoke any permits which may have been
granted to the Owner. The County will require the habitation and
occupancy of the house cease immediately.
C. This agreement is binding upon the heirs, successors in title, and
assigns of the parties.
