Subject: Construction of an above grade deck at the home of Angelo and Shana
Dormio located at 45855 Hwy. 6 & 24, Lot #23. Enclosure.
Dear Mr. Westberg:
When I spoke to you before Thanksgiving regarding the deck on the Dormio
residence you assured me that you were going to apply for a permit after the holiday
to correct the defects and complete the deck in compliance with the U.B.C. I have
not heard from you as of this date. I consider this to be a matter for your immediate
attention.
Based upon information from this departments inspectors, I believe this deck to be
unsafe under Section 203 of the Uniform Building Code. Enclosed is a notice and
order for the repair of the deck as provided for under provisions set forth in the
Uniform Code for the Abatement of Dangerous Buildings. If you have any
questions please give me a call. Your immediate attention to this matter is expected
and will be appreciated.

NOTICE and ORDER
OF
Chief Building Official
Property described below and located at:
Construction of an above grade deck at the home of Angelo and Shana Donnio
located at 45855 Hwy. 6 & 24, Lot #23, Garfield County, Colorado.
The Garfield County Chief Building Official finds the deck described above to be dangerous under
the following provisions of Section 302 of the U. C. A.D.B. (Uniform Code for the Abatement of
Dangerous Buildings)
Section 302
5. Whenever any portion or member or appurtenance thereof is likely to fail, or become
detached or dislodged, or to collapse and thereby injure persons or damage property.
8. Whenever the building or structure, or any portion thereof, because of faulty construction
or any other cause, is likely to partially or completely collapse.
9. Whenever, for any reason., the building or structure, or any portion thereof, is manifestly
unsafe for the purpose for which it is being used.
13. Whenever any building or structure has been constructed, exists, or is maintained in
violation of any specific requirement or prohibition applicable to such building or structure
provided by the building regulations of this (County), as specified in the Building Code or
Housing Code, or of any law or ordinance if this state or (county) relating to the
condition, location or structure of buildings.

Action required to be taken as determined by the chief building official:
The contractor is to apply for a building permit and provide detail plans for the
reconstruction of the deck. Upon receiving the permit the work will be undertaken and
completed within two (2) weeks. Application for the permit is to be made within seven
(7) days of the date of this notice.

Advisement:
If the work is not commenced within the time specified the Building Official will post the
area to prevent further occupancy or use until the work is completed.
Advisement:
Any person having any record title or legal interest in the building may appeal from the
notice and order or any action of the building official to the Board of Appeals (Board of
Review), provided the appeal is made in writing as provided in the UCADB and filed with
the building official within 30 days from the date of service of the notice and order and
that failure to appear constitutes a waiver of all right to an administrative hearing and
determination of the matter.

Dear Mr. Westberg:
It is my understanding hat you were the contractor and builder of a the deck at the
above residence. You were also the contractor and builder of the home. I am sure
that you were aware that the deck was not a part of the original application and
permit and requires an application for a permit, the approval of plans and the
issuance of a building permit prior to construction.
We have no record of such application or approval to begin. construction. Neither
do we have record of any inspection requests or inspections completed for this
project other than a request from the Dorn io s for us to look at this project, - . _ _

The Uniform Building Code, Section 302, as adopted by Garfield County requires
that an application be filed, plans and other data be submitted to obtain a permit.
