No. 90R -84 THIS AGREEMENT, made this 11 day of June , 19 90 , by and between PUBLIC SERVICE COMPANY OF COLORADO, a Colorado corporation, hereinafter referred to as "Company" and Dick Nord a n* Individual _ hereinafter referred to as Applicant, WITNESSETH: WHEREAS, Company is a public utility supplying electric energy and electric service to various areas in the State of Colorado, and WHEREAS, Applicant has requested Company to construct and install the necessary electric distribution facilities to provide ,* Permanent service to serve a new Lome with uuderpround 120/240 volt single phase service at 1080 Co Rd 216 • in Garfield County , Colorado. WHEREAS -, Company's Service Connection and Distribution Line Extension Policy requires a Construction Payment for the installation of said facilities. NOW, THEREFORE, in consideration of the mutual covenants and promises herein contained, it is mutually agreed as follows: 1) Company agrees to construct with reasonable promptness, the electric distribution facilities for which the Applicant has made a Construction Payment, iti R81Sg / excluding Service Laterals), and to notify Applicant when construction is completed and service is available ((he Extension Completion Date). ,,. 2) Applicant agrees, upon execution of this Agreement, to advance to Company a Construction Payment in the amount of Four Thousand Six hundred and Ninety Dollars ($4,690.00) 3) (a) Said Construction Payment may be refundable to Applicant in part or in its entirety during a five (5) year period commencing with the Extension Completion Date. Any possible refunds will be made in accordance with the terns and conditions of the Company's Service Connection and Distribution Line Extension Policy. This policy is on file with The Public Utilities Commission of the State of Colorado and is available for inspection. In no event will any refund exceed the Construction Payment nor will any refund be made after five (5) years from the Extension Completion Dale, as delermined from the Company's records. (b) In the alternative, the Applicant can directly pass through to purchasers of Applicant's property covered by this extension arty costs associated with the extension. (c) Applicant elects between 3 (a) and 3 (b) above as follows: ❑ 1) Company shall collect amounts front its customers due to connections to the extension covered by this agreement and refund those amounts to Applicant pursuant to 3 (a) herein. ❑ 2) Company shall not collect any amounts from its customers due to connections to the extension covered by this agreement. Applicant hereby represents that costs associated with this extension shall be collected directly by Applicant pursuant to 3 (b) above. 4) Nothing in this agreement shall be construed to waive the right to refund, if any, which may accrue as a result of excess construction allowance associated with .service lateral installations pursuant to the Rules and Regulations currently on file with The Public Utilities Commission of the Stale of Colorado. 5) Applicant agrees to execute the Company's standard right -of -way agreements granting free of charge to Company, such rights - of -way as may be required, and recognizes this Agreement is contingent upon Company obtaining any other rights -of -way front other parties if required. 6) In the event Applicant should require additional electric distribution facilities other than for which the Construction Payment has been made hereunder. such facilities shall be provided by separate agreements. IT IS MUTUALLY AGREED that the application and interpretation of this Agreement, including the definitions of terms used herein, shall be in accordance with Company's Electric Service Rules and Regulations, including Company's Service Connection and Distribution Line Extension Policy, on file and in effect from time to tune with The Public Utilities Commission of the State of Colorado and that said Rules and Regulations constitute a part of this Agreement and are binding on the parties hereto. On the topic of easing the federal credit crunch, the President stated that his proposed regulatory reforms will make it easier for bankers to make loans to small businesses, cutting down on paperwork and reducing the burden of disruptive bank examiners. MHI is preparing an analysis of the impacts of the President's economic proposals on the manufactured housing industry and will keep you informed on developments relating to these economic and regulatory changes. National Commission on Manufactured Housing Holds Third Meeting Holding its third meeting on March 11 -12, the National Commission on Manufactured Housing continued its fact - finding mission by hearing from members of MHI, ARR, and representatives from the Farmers Home Administration, the Department of Energy, the Government National Mortgage Association, the National Cooperative Bank and the National Institute of Building Sciences. The Commission also hired an executive director, Wilden, who is currently the Division Director for HUD's housing program for elderly and disabled Americans. The next Commission meeting is scheduled for May 6 -7 in Washington, D.C. TECHNICAL ACTIVITIES HUD Wind Safety Standards To Be Released For Public Comment The Office of Management and Budget (OMB) has completed its initial analysis of HUD's proposed wind safety rule and released it for the traditional 15 -day Congressional review before it is placed in the Federal Resister for public comment. OMB is requiring HUD to prepare a regulatory impact analysis that must be submitted to OMB with a proposed final rule. HUD was given permission to release a proposed wind safety rule for a 30 -day public comment period. - MHI's Technical Activities Committee (TAC) Wind Safety Task Force has been busy preparing a preliminary set of cost estimates of the possible first -cost increases that can be expected for typical manufactured homes. These estimates conclude that where HUD would prescribe a minimum of 80 mph wind safety (Zone I), manufactured homes's first cost would rise about four percent for a multisection and six percent for a single- section home; for HUD's proposed Zone II, where homes would be designed to withstand 100 mph winds, a multisection might rise as much as 21 percent and a single- section 29 percent; where HUD would specify in Zone III that manufactured homes would be designed to withstand 110 mph winds, a multisection might rise as much as 29 percent and a single- section 39 percent. In each case, this is an estimate of the total increase for both the home and its foundation system. MHI has made these cost estimates available to both OMB and HUD. Several MHI staff members and members of MHI's Technical Activities Committee recently met with NCSBCS Manufactured Home Committee members to discuss the proposed wind safety revisions for manufactured homes to see if there is common ground for possible joint wind safety recommendations to HUD. Agreement was reached for MHI to continue its cost estimating work, to include three possible design options that might be considered by HUD in finalizing its wind safety rule. -- FEDERATED STATES Colorado Association Wins Landmark Zoning Case The Colorado Court of Appeals has ruled that zoning ordinances that permit modular (UBC) homes while excluding HUD -Code homes are not legal. The decision in the case, Colorado Manufactured Housing Association vs. City of Pueblo, CO, supported the Colorado Manufactured Housing Association's and MHI's longheld belief that preferential treatment for modular homes over HUD -Code homes is illegal and d unjustifiable. The Court ruled that HUD Code manufacturers, retailers and buyers can sue for mono amages for lost business and attorney's fees where zoning excludes HUD -Code homes, but permits U homes. HUD Reaffirms Zoning Preemption Consistent with recent letters to St. Clair County, Illinois and Beloit, Wisconsin, HUD has sent a letter to Madison County, Illinois, advising that zoning discrimination aimed solely at excluding HUD -Code homes violates federal law. The HUD letter advised Madison County officials that their "ordinances appear to preclude or at least restrict the siting of manufactured homes that only meet federal standards."
