BUILDING AND PLANNING
AGREEMENT REGARDING CERTIFICATE OF OCCUPANCY
WHEREAS, Michael Fergen (hereinafter "Owner ") has applied for a
Certificate of Occupancy for a house constructed under building permit
#5032 and located at 45855 Hwy 6 & 24, Canyon Creek lot 20, Garfield
County, Colorado and,
WHEREAS, the following items have been determined to be apparent
defects or deficiencies with the application which prohibits the issuance of
a Certificate of Occupancy until they ae by been
r resolved pursuant County rsuant to c odes
adopted by Garfield County and approved
Building Official:
1. Front steps now exceed the maximum 8 inch rise.
2. The rear deck and guardrail off of the living room has not been
completed and is a portion of the approved permit.
3. Insulation has not been installed along the rim joist.
and,
WHEREAS, the Owner is willing to make certain assurances and
agreements relating to these identified code deficiencies and on the basis of
such assurances the County is willing to issue a Certificate of Occupancy.
NOW, THEREFORE, it is agreed as follows:
A. The Owner agrees to do the following:
Deficiency No. 1.
ACTION REQUIRED OF THE OWNER:
Provide entry stairs, handrail and guardrail if greater than 30 inches
above grade. Stair riser is to not exceed 8 inches.
Deficiency No. 2.
ACTION REQUIRED OF THE OWNER:
Permit is stopped for subject a if permit is
period of days. If the Owner intends to resume

construction after the 180 day period a letter is to be submitted to the
Building Official stating the reason and requesting an extension of up
to 180 days in order to complete this permit.
Deficiency No. 3.
ACTION REQUIRED OF THE OWNER:
provide insulation around the rim joist in the crawl space. Please note
that foam plastic or !craft backing cannot be exposed in the crawl
space.
FURTHER ACTION REQUIRED OF THE OWNER:
The Owner will complete all work described herein and request
inspection of all work by the Garfield County Building
Department. All work shall be completed in compliance with the
stated provisions of the codes currently adopted by Garfield
County in a manner that will enable approval of all work. All
work, inspections and approval of work shall be completed
within Thirty (30) days of the date of signing of this document.
B. In the event the Owner fails to perform as agreed on any of the
above, the County may revoke any permits which may have been
granted to the Owner. The County may require the habitation and
occupancy of the house cease immediately.
C. This agreement is binding upon the heirs, successors in title, and
assigns of the parties.

WHEREAS, Michael Fergen (hereinafter "Owner ") has applied for a
Certificate of Occupancy for a house constructed under building permit
#5032 and located at 45855 Hwy 6 & 24, Canyon Creek lot 20, Garfield
County, Colorado and,
WHEREAS, the following items have been determined to be apparent
defects or deficiencies with the application which prohibits the issuance of

adopted by Garfield County and approved by the Garfield County Chief
Building Official:
1. Front steps now exceed the maximum 8 inch rise.

WHEREAS, the Owner is willing to make certain assurances and

Building Official stating the reason and requesting an extension of up
