BUILDING AND PLANNING
AGREEMENT REGARDING CERTIFICATE OF OCCUPANCY
WHEREAS, Jess & Cindy Robinson (hereinafter "Owner ") have applied
for a Certificate of Occupancy for a house located at 0450 County Road 251
near Rifle, Garfield County, Colorado and,
WHEREAS, the following items have been determined to be apparent
defects or deficiencies with the application which prohibits the issuance of
a Certificate of Occupancy until they have been resolved pursuant to codes
adopted by Garfield County and approved by the Garfield County Chief
Building Official:
1. The deck foundation and guardrail has not been completed.
2. The steel I beam and steel columns in the garage have not been
protected as required under U.B.C. (Uniform Building Code) Section
503 (d) exception 3.
3. The foam insulation is exposed in the basement area and is not in
compliance with U.B.C. Section 1712.
4. The L.P. gas piping that was installed did not have a pressure test that
was witnessed by a County inspector.
and,
WHEREAS, the Owner is willing to make certain assurances and
agreements relating to these identified code deficiencies and on the basis of
such assurances the County is willing to issue a Certificate of Occupancy.
NOW, THEREFORE, it is agreed as follows:
A. The Owner agrees to do the following:
Deficiency No. 1.
ACTION REQUIRED OF THE OWNER:
Provide foundation support for the deck columns to a depth of at least
36 inches below finished grade. Complete the guardrail in a manner
consistent with the remainder of the guardrail.

Deficiency No. 2.
ACTION REQUIRED OF THE OWNER:
Provide protection as for one hour fire resistance for the steel Beam
and steel columns in the garage. This is accomplished by providing
one layer of 5/8 inch Type X gypsum wallboard and taping and sealing
all joints.
Deficiency No. 3.
ACTION REQUIRED OF THE OWNER:
The foam insulation is required to be covered in order to provide for
an acceptable flame spread rating. The covering may be a minimum of
1/4 inch plywood or any thickness of gypsum wallboard installed so
that no foam is exposed.
Deficiency No. 4.
ACTION REQUIRED OF THE OWNER:
The L.P. gas piping will be required to be pressure tested and the test
witnessed by a Garfield County Inspector. The test will be at a
minimum pressure of 10 p.s.i. and shall be maintained for at least 15
minutes. This test has been scheduled for Sept. 29, 1994, in the
morning.
FURTHER ACTION REQUIRED OF THE OWNER:
The Owner will complete all work described herein and request
inspection of all work by the Garfield County Building
Department. All work shall be completed in compliance with the
stated provisions of the codes currently adopted by Garfield
County in a manner that will enable approval of all work. All
work, inspections and approval of work shall be completed
within thirty (30) days of the date of signing of this document.

B. In the event the Owner fails to perform as agreed on any of the
above, the County may revoke any permits which may have been
granted to the Owner. The County may require the habitation and
occupancy of the house cease immediately.
C. This agreement is binding upon the heirs, successors in title, and
assigns of the parties.
