AGREEMENT REGARDING CERTIFICATE OF OCCUPANCY
WHEREAS, Leonard & Mindy Langston, (hereinafter "Owner ") have
applied for a Certificate of Occupancy for a house located at 6500 Highway
82, Garfield County, Colorado and,
WHEREAS, the following items have been determined to be apparent
defects or deficiencies with the application which prohibits the issuance of
a Certificate of Occupancy until they have been resolved pursuant to codes
adopted by Garfield County and approved by the Garfield County Chief
Building Official:
1. A guardrail has not been completed on the east deck.
2. The stairs serving the front entrance have not been completed.
3. The inside stair way has not been completed.
and,
WHEREAS, the Owner is willing to make certain assurances and
agreements relating to these identified code deficiencies and on the basis of
such assurances the County is willing to issue a Certificate of Occupancy.
NOW, THEREFORE, it is agreed as follows:
A. The Owner agrees to do the following:
Deficiency No. 1.
ACTION REQUIRED OF THE OWNER:
Complete the guardrail to comply with U.B.C. (Uniform Building Code)
Section 1711. Guardrail height is to be a minimum of 36 inches high
and shall have intermediate rails or have an ornamental pattern such
that a sphere 6 inches in diameter cannot pass through.
Deficiency No. 2.
ACTION REQUIRED OF THE OWNER:
Complete the front entry stairs to comply with U.B.C. Section 3306.
The rise of each step shall not be less than 4 inches nor more than 8
inches and the run not less than 9 inches.

Deficiency No. 3.
ACTION REQUIRED OF THE OWNER:
The interior stairway shall be completed in compliance with U.B.C.
Section 3306. The maximum rise and minimum run shall be as
described in No 2. above and the minimum head room of 6 feet 8
inches, measured vertically from a plane parallel and tangent to the
stairway tread nosing to the soffit above at all points. Handrails and
guardrails are required.
NOTE: Temporary stairs, guardrails and or handrails may be approved
until final items are installed provided that they meet minimum
code provisions. Plans for temporary components are to be
submitted to Building Official for approval.
FURTHER ACTION REQUIRED OF THE OWNER:
The Owner will complete all work described herein and request
inspection of all work by the Garfield County Building
Department. All work shall be completed in compliance with the
stated provisions of the codes currently adopted by Garfield
County in a manner that will enable approval of all work. All
work, inspections and approval of work shall be completed
within thirty (30) days of the date of signing of this document.
B. In the event the Owner fails to perform as agreed on any of the
above, the County may revoke any permits which may have been
granted to the Owner. The County may require the habitation and
occupancy of the house cease immediately.
C. This agreement is binding upon the heirs, successors in title, and
assigns of the parties.
