Box 77 Silt, CO 81652 Dear Jack & Ava, Thank you for bringing in all the necessary information to apply for the Building Permit you need for your storage building. It appears that the information you have brought in is satisfactory. I would like to address some of the issues raised in your letter. You say it is a mystery to you why this is happening. Please allow me to explain; Garfield County has adopted the 1988 Uniform Building Code(UBC). This, in effect, makes it the "LAW" of building construction in Garfield County. The intent and purpose of the UBC is to ensure that all buildings in the county are built to certain minimum, recognized standards of construction and safety. The UBC also specifies how this process is to take place. Since Garfield County has chosen to adopt this UBC code, it needs to be followed. Here are some of the relevant items of the UBC that pertain to your storage building. SCOPE - Sec 103 of the UBC states "The provisions of this code shall apply to the construction, alteration, moving, demolition, repair and use of any building or structure within this jurisdiction (Garfield County)... Sec. 301(a) - "Except as specified in Subsection(b) (exempted construction), no building or structure regulated by this code(your building is regulated by this code)shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a permit for each building or structure has first been obtained from the building official. Therefore, it should be clear to you that the building you constructed is required to have a permit, which you did not do. Sec. 302 of the UBC covers what is necessary to apply for a permit. Since it has been determined that the structure needs a permit, you need to obtain one. Sec. 303(a) covers the issuance of a permit. "If the building official finds that the work described in an application for a permit and the plans, specifications and other data filed therewith conform to the requirements of this code...the building official shall issue a permit ...to the applicant. Based on the initial investigation by Mr. Jeff Simonson, P.E. indicated that the structure you built, in fact, did not meet the minimum code requirements with regard to the wood structural members, and did not meet the minimum code requirements for the concrete monoslab supporting the structure. This type of problem is exactly what the UBC addresses. These problems could have been addressed and corrected during the plan review stage, had you obtained a permit before construction. Since you did not, we have to address these problems now, after the fact. Electrical - you apparently installed electricity in this building without an electrical permit. A Electrical Permit is required by Colorado State Law for any electrical installation. Garfield County is required to follow State Law. It is a mystery to me why you choose to remove the wiring. We are not requiring you to remove the electric in this structure. We are only requiring that you obtain an electrical permit (as required by Colorado State Law), and to pass a final electrical inspection (as required by Colorado State Law). (Continued) Jack & Ava Bowles - Page 2 Again, you do not need to remove the electrical, you only have to get a permit and get it inspected. If you still choose to remove it, that's fine. You mentioned financial difficulties. It may be wise to first investigate the cost of an electrical permit, compared to the cost and hassle of removing all the wiring. Do whatever you wish, but remember that we are not requiring that it be removed. Since you built this building without a permit, we have to charge an Investigation Fee, as required by the UBC. Specifically; Sec. 304 (e) Investigation Fees: Work without a Permit. 1. Investigation. Whenever any work for which a permit is required by this code has been commenced without first obtaining a permit, a special investigation shall be made before a permit may be issued for such work. 2. Fee. An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law. The fact that the building has been standing and is visible from certain locales is completely irrelevant, as I have explained above. Garfield County has chosen to adopt the code as law, and citizens of Garfield County are required to follow it. Our job as the Building Department is to enforce and apply the provisions of the UBC, which is exactly what we are doing. You and your building are not being treated any differently than an identical situation on a different piece of property by different people. You have mentioned your hectic work schedules and financial difficulties. We are willing to work with you to help you through this entire process. You mentioned that you need to be able to complete your home to be able to move stored items from the storage building into your home so that you can make the necessary repairs to the structure of the storage building. We feel that by structuring the project this way will allow you to do things in a sequential order, starting with the home first, and the storage building second. Therefore, Mr. Mark Bean, Director of our Building and Planning Department has proposed the following; 1. We will hold your permit application to allow you to finish your home to the point where you may occupy it. The information you have provided in your application is fine, and the deficiencies outlined in Mr. Simonson's analysis will need to be corrected, along with the other - u • tlined in our previous letters. 2. When your new home is ready, we will give you a Temporary Certificate of Occupancy. This temporary CO will be conditional on your paying all the necessary fees to obtain the Building Permit for your storage building at that time. 3. Make al necessary repairs to the storage and call for a final inspection within 6 months of the issuance of the Building Permit. Issuing the temporary Certificate of Occupancy will be conditional upon your obtaining the building permit for the storage shed. 4. When the storage building is complete and has passed our final inspection, the Temporary Certificate of Occupancy for your home will become final, and that should be the end of the entire ordeal.
