PERMISSION IS HEREBY GRANTED TO THE APPLICANT AS OWNER, CONTRACTOR AND /OR THE AGENT OF THE CONTRACTOR OR OWNER TO
CONSTRUCT THE STRUCTURE AS DETAILED ON PLANS AND SPECIFICATIONS SUBMITTED TO AND REVIEWED BY THE BUILDING DEPARTMENT
IN CONSIDERATION OF THE ISSUANCE OF THIS PERMIT THE SIGNER HEREBY AGREES TO COMPLY WITH ALL BUILDING CODES AND LAND USE
REGULATIONS ADOPTED BY GARFIELD COUNTY PURSUANT TO AUTHORITY GIVEN IN 30.28.201 CRS AS AMENDED. THE SIGNER FURTHER
AGREES THAT IF THE ABOVE SAID ORDINANCES ARE NOT FULLY COMPLIED WITH IN THE LOCATION, ERECTION, CONSTRUCTION AND USE OF

Subject: Work done prior to the issuance of a building permit.
Attachment.
The U.B.C. (Uniform Building Code) Section 304 Fees, Subsection (e)
Investigation Fees: Work without a permit. States in part, "An
investigation fee, in addition to the permit fee, shall be collected whether or
not a permit fee is then subsequently issued. The investigation fee shall be
equal to the amount of the permit fee required by this code."
The permit fee for this permit is $317,00 which indicates that the
investigation fee is also $317.00. It is my understanding that you were
misinformed by Bobby Gordon that you would not need a permit for this
project because it is an agricultural building. This is incorrect because the
building does not qualify as an agricultural building under codes adopted by
Garfield County. (Please see attachment) However, I will consider that you
received incorrect information and you will not be charged the investigation
fee on this project. A copy of this will be sent to Mr. Gordon for his future
reference. If you have any questions please give me a call.

AGRICULTURAL BUILDINGS
Garfield County has specifically exempted qualified agricultural buildings from needing a Building
Permit. "Buildings or structures used for the sole purpose of providing shelter for agricultural
implements, farm products, livestock or poultry shall be exempted from regulation "...by the 1988
Uniform Building Code, as adopted by Garfield County.
If a building or structure does not strictly meet the above definition, then a permit must be
obtained from the Garfield County Building and Planning Department.
Further, according to the definition of an Agrucultural Building in the 1988 U.B.C. - An
Agricultural Building is a building designed and constructed to house farm implements, hay, grain,
poultry, livestock or other horticultural (farm or garden) products.
It may also help to understand what an agricultural building is not, according to the UBC.
An Agricultural building;
* Can not be a place of human habitation.
* Can not be a place of employment where agricultural products are processed, treated or
packaged.
* Can not be used by the Public.
ZONING
An agricultural building can only be built on Agriculturally zoned land. There are only
two Zone Districts in Garfield County that allow Agricultural use. (1) A/I - Agriculture/
Industrial and (2) A/R/RD - Agricultural/Residential/Rural Density.
