IN CONSIDERATION OF THE ISSUANCE OF THIS PERMIT THE SIGNER HEREBY AGREES TO COMPLY WITH ALL BUILDING CODES AND LAND USE
REGULATIONS ADOPTED BY GARFIELD COUNTY PURSUANT TO AUTHORITY GIVEN IN 30.28.201 CRS AS AMENDED. THE SIGNER FURTHER

RE: Katz Property Special Use Permit
Dear Mark:
Please let this letter serve as a request for procurement of a Flood -
plain Special Use Permit for the Katz property. You will find attached
data supplementing the request inclusive of: Legal descriptions of the
property, a map of the property and a set of drawings for a proposed
addition to the existing building for which a Special Use Permit was
previously procured.
On the enclosed map, you will note that a building envelope has been
established from which, from a floodplain standpoint, a building could
be located on the Katz property. Essentially, we have utilized the
previous floodplain study along with the letter of map revision from
FEMA dated December 22, 1988, to identify the floodplain (floodway plus
flood fringe) location on the Katz property. We have identified the •
building envelope as being that area of the floodplain that is the
floodway fringe in addition to the property outside the floodplain.
For a person to locate a residence or develop any type of structure
within the buiding envelope located in the floodway fringe, the
following items must be addressed:
A. the development, use, fill, construction, substantial irnprovanent
or alteration on or above any portion of the flood fringe or
flood prone areas which, alone, or accumulative with other activ-
ities, would cause or result in dangerous or substantial solid
debris carried downstream by floodwaters.
B. 'Ihe storage or processing of materials that, in time of flooding,
are buoyant, flammable, explosive, or otherwise potentially
injurious to human, animal or plant life.
C. The disposal of garbage or other solid waste materials.
D. The placement of any mobile homes.
E. The obstruction which would adversely affect the efficiency of,
or restrict the flow capacity of a designated floodplain so as to
cause foreseeable damage to others.

I would like to develop a performance standard for construction within
these building envelopes which lie in the flood fringe of the Roaring
Fork River.
Regarding item A above, in reviewing the required performance stand-
ards, item 6.09.02 (3)(6) of the Floodplain Regulations, the building
must be built to withstand the forces and velocities from the
floodwaters.
Regarding item B, no storage or processing of hazardous materials
should be allowed.
Regarding item C, the disposal of garbage or other solid waste mater-
ials must not be allowed.
Regarding item D, no mobile homes should be allowed to be installed in
the flood fringe.
Regarding item E, no developnent should be allowed in the floodway of
the Roaring Fork River.
Previous studies have indicated that full devlopnent within the flood -
way fringe (if flood - proofed) would not restrict the floodway's flow
capacity. Further, Section 6.09.02 (3), performance standards must be _
met for a developnent being located in the flood fringe. As you will
note on the attached map, in addition to the location of the building
envelopes, contours of the floodwaters have been located. In essence,
depending upon the actual location of any building within the huilding
envelope, one could review the enclosed map and find the elevation of
the floodwaters to the nearest 1/2 foot. Once determining the eleva-
tion of the floodwaters, a person could determine the elevation of the
lowest floor of the proposed structure. In addition, based upon the
topo presented on the map along with the contours of the water surface,
information should be sufficient to determine flood - proofing measures
that may need to be taken. Essentially, to recap the performance stan-
dards from the standpoint of constructing a typical structure in the
building envelopes which may be located in the floodway fringe of the
Roaring Fork River, the following items must be addressed:
1. The lowest floor for residential structures should be constructed
one foot above the maximum water elevation of the 100 -year flood
event.
2. The proposed structure must be capable of resisting hydrostatic
and hydrodynamic loads and buoyancy effects.

3. Utility and sanitary facilities must be water tight.
4. Septic and dosing tanks should be constructed to resist buoyant
effects during the 100 -year event.
5. Leach fields should be constructed such that the bottom of the
bed is four feet above the ordinary high groundwater and such
that the top of the bed is protected from scouring of the 100 -
year flood event. In addition, the leach field must be construc-
ted to eliminate infiltration from the 100 -year flood event into
the bed.
Finally, any other performance standards not discussed herein for
construction or development in a floodway fringe from the Garfield
County Floodplain Regulations, shall be adhered to.

RE: Katz Property - Garage Construction
Dear Mark:
This letter is intended to discuss the construction of the proposed Katz garage located in the
floodplain of the Roaring Fork River at 0182 109 Road, Glenwood Springs, Colorado.
More specifically, it is intended to address the construction of the garage as it relates to
performance standards and resistance to hydrostatic pressure, hydrodynamic forces and scour
protection, since this building will be located below the 100 -year floodplain elevation on the
Roaring Fork River. SGM has previously conducted studies to identify that this property does
in fact lie within the 100 -year floodplain of the Roaring Fork River. However, proposed
construction of the garage is proposed to be located in the flood fringe of the Roaring Fork
River. We are in receipt of drawings prepared by Larry Zugschwerdt, which identify the
proposed construction of the Katz garage.
In light of these drawings and in light of the performance criteria identified in the Floodplain
Regulations for Garfield County, we would offer the following comments:
1. The proposed finished floor of the garage is to be approximately four feet lower
than the finished floor of the existing residence. Therefore, we would
recommend that the foundation stem walls extend to an elevation equal to the
finished floor of the adjacent residence.
2. Once extending the foundation to the finish floor elevation of the adjacent
residence, we would recommend that the foundation be constructed of either
concrete or fully grouted masonry. Reinforcing (vertical) should be #4 bars at
16" on center. If the wall is to be masonry, we would recommend, in addition,
that the construction of the masonry wall over and above the stated
requirement above, be constructed of standard masonry construction related
to bond beam placement and reinforcing, as well as truss tie reinforcing.
3. By review of the letter, Mr. Katz should be notified that the storage or
processing of materials that, in time of flooding, are buoyant, flammable,
explosive, or otherwise potentially injurious to human, animal or plant life, shall
be stored above the 100 -year floodplain (i.e. concrete or masonry wall).

4. We would recommend that the backfilling of the disturbed areas for the
foundation construction also consider the use of riprap placed within 12" of
finished grade consisting of rock with an average diameter of 12 ". This riprap
may be placed on the surface or, as previously stated, within 12" of the
surface and then backfilled with topsoil. During a time of flooding, this topsoil
may ultimately be removed by flood waters, but the riprap would be there to
provide the necessary scour protection.
