FERRIN and ROSIE B. FERRIN, Defendants. _ `- LF THIS MATTER comes before the Court upon the Complaint of the Board of County Commissioners of Garfield County, State of Colorado, generally requesting entry of a permanent injunction against the Defendants, Cleyo H. and Rosie B. Ferrin. The Court having considered the files and pleadings in this matter, as well as having heard the evidence presented at trial on the 13th day of December, 1995, and otherwise being fully advised in the premises, does hereby find and order as follows: 1. The Court retains jurisdiction over the parties and subject matter of this action pursuant to the provisions of Rule 65, C.R.C.P., as well as other applicable rules and statutes of the State of Colorado. 2. Venue for this action properly lies in Garfield County, State of Colorado. 3. The evidence presented at trial demonstrates the following by a preponderance of evidence: a. The Plaintiff has properly adopted the Uniform Building Code of 1988 and that such code is applicable to all structures intended for human habitation and use. b. As adopted by the Plaintiff, the Uniform Building Code of 1988 contains certain exemptions, none of which are applicable to the structure present on the property owned by the Defendants. c. The Plaintiff has adopted a Zoning Code and Regulations for Garfield County, which prohibit the use of property in the A /R /RD zone district for a day nursery without the issuance of a conditional use permit. As defined within the zoning code, a day care nursery is a properly licensed child care facility servicing at least eight (8) children. 1 f ' d. The Zoning Code as adopted by the Plaintiff defines the term "salvage yard" and does not permit such use within the A /R /RD zone district. e. The property owned by the Defendants, generally located at 1756 County Road 241, New Castle, Colorado, contains two (2) structures described in testimony as the "main house and the cabin ". f. The "main house" as depicted in Exhibit A -3 is the subject of a properly issued building permit. g. The "cabin" as depicted in Exhibit A -1 is not the subject of a properly issued building permit. h. The evidence and testimony demonstrates that the property generally has been utilized for a day nursery within the definition of the Garfield County Zoning Resolution. i. The proof fails to demonstrate that the "cabin" was utilized as part of the day nursery. j. The evidence demonstrated the collection of various material on the property of the Defendants. However, the testimony also demonstrated that the language of the definition of "salvage yard" was so broad and ill- defined that it . encompassed many activities that the Plaintiff did not intend to control, nor make unlawful through the enactment of that definition. __� 4. Under the law and evidence presented to this Court, the \rs "cabin" located on the property of the Defendants cannot be utilized for human activity until a building permit has been 1 , issued in relation to that structure and all terms and conditions of that building permit and the Uniform Building Code as adopted by Garfield County have been met regarding that structure. The requirements of the Uniform Building Code include the necessity for a properly permitted ISDS system. - - 5. While the proof fails to demonstrate that the "cabin" set forth above was utilized for day nursery purposes, the property generally was utilized for such purposes. The property that is the subject for this litigation cannot be used for day care nursery purposes, as defined by the Plaintiff, without the issuance of a conditional use permit authorizing that activity. 6. The term "salvage yard" is so broadly defined by the Plaintiff that it cannot be enforced against these Defendants. WHEREFORE, THIS COURT ORDERS that these Defendants are permanently enjoined from undertaking the following activity on the property that is the subject of the Plaintiff's Complaint with the conditions set forth herein: 1. No human activity shall be permitted in the structure 2 known as the "cabin" as such is located on property known variously as 1756 or 1760 County Road 241, New Castle, Colorado, without issuance of a building permit from Garfield County and compliance with the terms of that building permit and the Uniform Building Code as adopted by Garfield County. In regard to that structure, the Defendants are hereby ordered to submit a complete application for issuance of such building permit within 21 days of the day of this Order. Review of compliance with the terms of that permit will be undertaken on the review date set forth below. Should the Defendants fail to comply with the injunction set forth herein, or the terms of the order set forth herein, this Court reserves the right to consider all available remedies to enforce this injunction and order, including the removal of the offending structure. 2. To the extent that the child care activities of the Defendants meet the terms of "day nursery" as defined by the Garfield County Zoning Resolution, the Defendants shall obtain a conditional use permit authorizing such activity. The Defendants 0 are herein perm$n.1tly enjoined from undertaking "day nursery" on the subject property prior to or without such " issuance of such a conditional use permit. While the Court determines that the evidence has failed to demonstrate use of the "cabin" for day nursery operations, no child care activities may take place in the "cabin" that is located on the Defendants' property. 3. The Court declines to issue any injunction regarding the location of the "salvage yard" alleged to be located on the property of the Defendants. The over breadth of the definition of that term by the Plaintiff, does not permit application of the definition to any activities of these Defendants. 4. R. 241, New Castle olorado- --- of Dear Cleyo: Per your request, Schmueser Gordon Meyer has performed a site investigation and subsequent analysis on the Ferrin Heights Cabin located as referenced above. The purpose of our investigation was to structurally evaluate the Ferrin Heights Cabin as it relates to its ability to adequately perform under UBC criteria. We performed a field evaluation on February 14, 1996, and based upon the observations made in the field, have subsequently performed calculations which identify the live load capacities on the major structural elements for the framing and have developed details (attached) which, when constructed, will correct deficient areas within the building construction observed in the field. Structure Description Briefly, as can be observed on the attached sketches, the structure consists of a two -story wood frame structure founded on reinforced concrete slabs with the depths identified on Sheet 3 of 5 attached. These reinforced concrete slabs were not observed in the field to have any frost protection associated with their construction. Under the living /bedroom area of the cabin (i.e., second story addition), there was not an adequate foundation system provided. Sheets 1 of 5 and 2 of 5 identify the major framing elements of the roof over the ground floor level of the cabin and the second story addition. Additionally, on Sheet 2 of 5, the floor joist for the living /bedroom area of the cabin are identified. For the 2 x 6 roof rafters located both over the ground floor level and second story addition, the total load capacity of these rafters is 98 Ibs /SF. This far exceeds the UBC requirements of 40 Ibs /SF snow load plus the observed 15 lb/SF ± dead load. For the 2 x 8 floor joists supporting the living /bedroom, the total load capacity was 89 Ibs /SF. This also far exceeds UBC live load and dead Toad criteria. Noted Deficiencies and Proposed Repairs As was briefly noted above, the two major deficiencies identified or observed in the field related both to foundation conditions supporting the structure itself. Where there was provided a reinforced concrete slab, there was observed no frost protection. The UBC requires the foundation system to be located below frost depth. On Sheet 3 of 5, you will note that we provided a plan view description of those areas observed to be deficient with frost protection. Therefore, we have also shown a proposed frost protection construction for those areas and an accompanying detail shown on Sheet 5 of 5. February 15, 1996 Mr. Cleo Ferrin Page 2 The other area noted as being deficient is the lack of adequate foundation under the living room /bedroom area of the house. Again, on Sheet 3 of 5, you will note the areas located to receive a new masonry foundation wall. This foundation wall would be proposed to be constructed under the area of the living room /bedroom area of the cabin. On Sheet 4 of 5, a cross section is provided which identifies the construction requirements for this new foundation construction. Based upon our observations in the field, it is possible that the new masonry foundation construction may also be deficient in having adequate frost protection for it. Therefore, you will note that on the detail provided on Sheet 4 of 5, we have referenced further frost protection measures that may be provided in the event that frost protection cannot be provided. This provision references the detail on Sheet 5 of 5. A final area noted as being deficient in the structure deals with the east bearing wall supporting the ceiling and roof over the living room /bedroom area of the house. This bearing wall is, in turn, supported by floor joists (i.e., existing 2 x 8 joists at 16" on center). To provide adequate support for this bearing wall, we would require that two 71/2" MICROLAM members be provided in the floor structure directly below this bearing wall. One end of the MICROLAM members would need to be supported on the existing 8 x 8 x 16" block wall (i.e., north wall of the ground floor) and the other end would be supported by the new foundation wall on the north end of the structure. Surface Drainage With the details provided with this report for repairs of deficient areas within the structure, considerable earthwork is proposed to achieve frost protection for both the proposed foundation areas of the cabin as well as the existing slab areas of the cabin. With this requirement for fill, we would also require that the surface drainage provided with this fill meet standard UBC requirements which dictate that surface drainage is not directed towards the structure. We would recommend that minimum slopes of 2% be maintained within the first three feet away from the structure. After this 3 -foot limitation, we would recommend slopes no steeper than 2:1. If it is determined that slopes steeper than 2:1 are required to accomplish the required construction, then the final face slope shall be erosion protected, utilizing either crib wall construction, rubble wall construction or some other means of providing erosion protection to the face of the slope. Conclusions This report has been based upon conditions observed during our cursory evaluation of the structure on February 14, 1996. Also, information regarding specific construction materials and procedures discussed were based upon interview with yourself during the field investigation. No destructive investigations in the field were performed to verify nailing patterns, joints, insulation, etc. Therefore, during construction, if any information discussed in this report is contrary to actual field conditions, we would request that we be contacted SCHMUESER GORDON MEYER, INC. We understand that this work is being required of yourselves to be performed prior to March 1. Because the nature of the work involves excavation and backfilling of earth in and around the structure, we would recommend correspondence between yourselves and Garfield County be initiated immediately. We feel that, because of the amount of earthwork involved and because of the time year, the work proposed will be compromised because of the potential for frost to affect not only excavation but, more importantly, proper backfilling procedures. However, we would recommend that, as soon as the frost leaves the ground, work be initiated. I hope this report and attached sketches serve their intended purpose. Adequate and complete information will prevent delays in the plan review process. Reviewing a plan and the discovery that required information has not been provided by the applicant may result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor may be required to provide this information before the plan review may proceed. This causes delays because other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. If you do not, it may he helpful to obtain a book titled "Dwelling construction under the Uniform Building Code. This book is available to you through this department at our cost. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project. To provide for a more understandable plan in order to determine compliance with the building, plumbing and mechanical codes, applicants are requested to review the following check list prior to and during design. Applicants are required to indicate appropriately and to submit completed check list at time of application for a permit: 1. Is a site plan included that indicates the distance of the proposed building or addition to property lines, other buildings, set back easements and utility easements?
