Dear Fred / Whom It May Concern
I would like to request an extension of time for a Preliminary Plat Submittal on the above
referenced project, under the new 2008 Garfield County Land Use Regulations.
To date I have successfully submitted, completed and been approved for both Sketch Plan and
Preliminary Plan Phases of the required Planning Process. However, due to time constraints, I
am unable to make the Final Plat submittal deadline as prescribed under the previous Land
Use Regulations, nor am I able to commit to the financial burden it poses due to the current
economy conditions.
Please consider this request based of these conditions during your next hearing with the

GENERAL PROJECT INFORMATION:
Project Description /Background:
The 7,3 acre parcel is west of CR 114 within the Los Amigos Ranch Subdivision and is zoned PUD
(Multi - Family). Water and sanitary sewer service is to be provided by Red Canyon Water Company
and Spring Valley Sanitation District, respectively.
The Eagle Ridge Townhomes Preliminary Plan was conditionally approved by the Board of County
Commissioners (BOCC) on January 21, 2008. On December 1, 2008, the BOCC approved a one
year extension for the Preliminary Plan and set December 17, 2009 as the deadline for the submittal
of the Final Plat for Eagle Ridge Townhomes Subdivision.
Request
As stated above, the Eagle Ridge Townhome Preliminary Plan expires December 17, 2009 and in
order to continue with the project and submit a Final Plat the Applicant is requesting a one year
extension under the Unified Land Use Resolution of 2008. The Applicant anticipates submitting the
Final Plat in the near future. The Board has the authority under Section 4 -103 of the Unified Land
Use Resolution of 2008 to grant such requests:
Section 4 -103 (G) (8) (a) (1) Conditional Approval. The Board's decision to approve
or conditionally approve the preliminary plan, minor exemption, major exemption or rural
lands development exemption shall be effective for a period of up to one year or until the
final or exemption plat has received a Determination of Completeness pursuant to Section
4- 103(C), Determination of Completeness, whichever occurs first. Prior to expiration of

the original approval, the applicant may make a one -time request for an extension of up to
one year, upon a demonstration of why the original conditions of approval cannot be met.
I. PROCESS
If the Applicant wishes to pursue the one year extension the following steps are required:
1. Pre- application Meeting (held 12/11/2009)
2. Applicant to submit a letter requesting a one year extension for the Preliminary Plan.
3. Staff schedules public meeting with the BOCC and prepares Staff memorandum and other
applicable documents,
4. Public meeting before the BOCC
5. Signing and recording of the Resolution
