SECTION 12 AFFORDABLE HOUSING Section 8 -102 of the Garfield County ULUR (Applicability — Affordable Housing) was amended by the adoption of Resolution 2011 — 83 by the Board of County Commissioners on December 19, 2011. The threshold for affordable housing was changed from developments proposing 5 or more lots anywhere in the County to 15 or more lots for projects located in Area No. 1. It is the Development Team's opinion that the land use application is not subject to the Garfield County's Affordable Housing regulations. A copy of Resolution 2011 — 83 is attached. The Board of County Commissioners of Garfield County, Colorado, was the applicant for a Text Amendment to amend the Unified Land Ilse Resolution of 2008, as it pertains to Section 8 -102, Applicability of the Affordable Housing regulations. B. On December 14, 2011 the Garfield County Planning and Zoning Commission held a public hearing and forwarded a recommendation of a 5 -2 vote to approve the proposed text amendment. C. On December 19, 2011, the Board of County Commissioners opened a public hearing at which hearing the public and interested persons were given the opportunity to express their opinions regarding said text amendment. D. The Board of County Commissioners closed the public hearing on December 19, 2011 to make a final decision. E. The Board of County Conunissioners on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That the hearings before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard; and 3. That the application has met the requirements of the Garfield County Unified Land Use Resolution of 2008, as amended. 4. The proposed text does not conflict with State statutory provisions regulating land use. . That the proposed text amendment is determined to be in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Garfield County Unified Land Use Resolution of 2008, and as subsequently amended by this Board, shall be and hereby is amended and said language will be incorporated into the codified Garfield County Unified Land Use Resolution as shown on the attached Exhibit A. These requirements for affordable housing shall apply to all land use change applications in Garfield County, such that -15 10% of the lots proposed in the development shall be developed with affordable housing units. These requirements shall apply to residential applications including rental housing, not commercial applications. In computing this requirement, any fraction of a unit lot above .581 will be rounded up and any fraction of a unit lot less than .50 will be rounded down. [Provided however that the number of units required under this Article shall not apply to non- expired Preliminary Plans approved by the BOCC under the Zoning Regulations of 1978, as amended and Subdivision Regulations of 1984; as amended.
